{"id":100572,"date":"2024-03-08T16:41:58","date_gmt":"2024-03-08T22:41:58","guid":{"rendered":"https:\/\/milesfortis.com\/?p=100572"},"modified":"2024-03-08T16:41:58","modified_gmt":"2024-03-08T22:41:58","slug":"100572","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=100572","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.courtnewsohio.gov\/cases\/2024\/SCO\/0307\/221482.asp\" target=\"_blank\" rel=\"noopener\">Warning shots get \u2018self-defense\u2019 protections too, Ohio Supreme Court rules<\/a><\/p>\n<p>A Clark County man was entitled to argue self-defense when he intentionally shot toward a person, and was not required to show he intended to kill or harm the man who threatened him, the Supreme Court of Ohio ruled today.<\/p>\n<p>A divided Supreme Court\u00a0<a title=\"The ruling of a reviewing court to set aside the decision of a lower court.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/v.asp\" rel=\"tooltip\">vacated<\/a>\u00a0the felonious assault\u00a0<a title=\"A judgment that a defendant is guilty of a particular criminal offense.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/c.asp\" rel=\"tooltip\">conviction<\/a>\u00a0of Tyler Wilson for his altercation at a Springfield gas station in 2021. At trial, Wilson was\u00a0<a title=\"A jury's verdict that a defendant is not guilty in a criminal case, or the judge's finding that the evidence is insufficient to convict.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/a.asp\" rel=\"tooltip\">acquitted<\/a>\u00a0of attempted murder but convicted of felonious assault after he fired a shot at Billy Reffett. The shot struck the window frame of Reffett\u2019s truck, near his head.<\/p>\n<p>The\u00a0<a title=\" A formal court proceeding in which a judge or a jury decides disputed facts and determines guilt or liability based on the evidence presented.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/t.asp\" rel=\"tooltip\">trial<\/a>\u00a0judge refused to instruct the\u00a0<a title=\"The group of persons selected to hear the evidence in a trial and decide a verdict based on the facts.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/j.asp\" rel=\"tooltip\">jury<\/a>\u00a0to consider Wilson\u2019s argument that he acted in self-defense. The judge ruled Wilson was not claiming self-defense because Wilson\u00a0<a title=\"Evidence presented orally by witnesses in court proceedings.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/t.asp\" rel=\"tooltip\">testified<\/a>\u00a0that he did not aim the gun at Reffett and had no intention of harming him but was just trying to get Reffett to \u201cback off.\u201d<\/p>\n<p>In the Court\u2019s lead\u00a0<a title=\"A judge\u2019s written explanation of the decision of the court in a case.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/o.asp\" rel=\"tooltip\">opinion<\/a>, Justice Melody Stewart stated that the Ohio self-defense law does not require an intent to harm or kill another, just the \u201cintent to repel or escape force.\u201d Shooting toward another with the intent to stop an aggressor is sufficient to justify a self-defense\u00a0<a title=\"A judge\u2019s directions to the jury on the questions it must answer and the legal rules it must apply.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/j.asp\" rel=\"tooltip\">jury instruction<\/a>, she concluded.<\/p>\n<p>The Supreme Court\u00a0<a title=\"The ruling of a reviewing court that sends back a case to the lower court.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/r.asp\" rel=\"tooltip\">remanded<\/a>\u00a0the case to the Clark County Common Pleas Court to vacate Wilson\u2019s\u00a0<a title=\"The punishment ordered by a court for a defendant convicted of a crime.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/s.asp\" rel=\"tooltip\">sentence<\/a>\u00a0and conduct further proceedings.<\/p>\n<p>Justices Michael P. Donnelly and Jennifer Brunner joined Justice Stewart\u2019s opinion. Justice Patrick F. Fischer concurred in judgment only without a written opinion.<\/p>\n<p>In a\u00a0<a title=\"An opinion disagreeing with the judgment reached by the majority of the court.\" href=\"https:\/\/www.courtnewsohio.gov\/glossary\/d.asp\" rel=\"tooltip\">dissenting opinion<\/a>, Justice Joseph T. Deters wrote that Wilson\u2019s version of what had happened did not warrant a self-defense instruction.<\/p>\n<p>Because Wilson insisted that he was not aiming the gun at Reffett or trying to shoot him, Wilson was arguing that he had not committed felonious assault. Arguing he was not guilty of felonious assault is different than claiming he acted in self-defense, which would require Wilson to admit he attempted to harm Reffett but was justified in doing so, Justice Deters explained.<\/p>\n<p>Chief Justice Sharon L. Kennedy and Justice R.
