The owner of a software company near Seattle, he drives a leased Chevrolet Bolt. He\u2019s never been responsible for an accident.<\/div>\n<div>So Mr. Dahl, 65, was surprised in 2022 when the cost of his car insurance jumped by 21 percent. Quotes from other insurance companies were also high. One insurance agent told him his LexisNexis report was a factor.<\/div>\n<div>LexisNexis is a New York-based global data broker with a \u201cRisk Solutions\u201d division that caters to the auto insurance industry and has traditionally kept tabs on car accidents and tickets. Upon Mr. Dahl\u2019s request, LexisNexis sent him a 258-page \u201c<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/consumer.risk.lexisnexis.com\/consumer\" target=\"_blank\" rel=\"noopener noreferrer\">consumer disclosure report<\/a>,\u201d which it must provide per the Fair Credit Reporting Act.<\/div>\n<div><\/div>\n<div>What it contained stunned him: more than 130 pages detailing each time he or his wife had driven the Bolt over the previous six months. It included the dates of 640 trips, their start and end times, the distance driven and an accounting of any speeding, hard braking or sharp accelerations. The only thing it didn\u2019t have is where they had driven the car.<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div><\/div>\n<div>\n<div>\n<div>On a Thursday morning in June for example, the car had been driven 7.33 miles in 18 minutes; there had been two rapid accelerations and two incidents of hard braking.<\/div>\n<div><\/div>\n<div>According to the report, the trip details had been provided by General Motors \u2014 the manufacturer of the Chevy Bolt. LexisNexis analyzed that driving data to create a risk score \u201cfor insurers to use as one factor of many to create more personalized insurance coverage,\u201d according to a LexisNexis spokesman, Dean Carney. Eight insurance companies had requested information about Mr. Dahl from LexisNexis over the previous month.<\/div>\n<div>\u201cIt felt like a betrayal,\u201d Mr. Dahl said. \u201cThey\u2019re taking information that I didn\u2019t realize was going to be shared and screwing with our insurance.\u201d<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div>\n<div data-testid=\"imageblock-wrapper\">\n<figure role=\"group\" aria-label=\"media\">\n<div data-testid=\"photoviewer-children-figure\"><\/div>\n<div data-testid=\"photoviewer-children-figure\"><picture><source media=\"(max-width: 599px) and (min-device-pixel-ratio: 3),(max-width: 599px) and (-webkit-min-device-pixel-ratio: 3),(max-width: 599px) and (min-resolution: 3dppx),(max-width: 599px) and (min-resolution: 288dpi)\" \/><source media=\"(max-width: 599px) and (min-device-pixel-ratio: 2),(max-width: 599px) and (-webkit-min-device-pixel-ratio: 2),(max-width: 599px) and (min-resolution: 2dppx),(max-width: 599px) and (min-resolution: 192dpi)\" \/><source media=\"(max-width: 599px) and (min-device-pixel-ratio: 1),(max-width: 599px) and (-webkit-min-device-pixel-ratio: 1),(max-width: 599px) and (min-resolution: 1dppx),(max-width: 599px) and (min-resolution: 96dpi)\" \/><\/picture><\/div><figcaption data-testid=\"photoviewer-children-caption\"><\/figcaption><\/figure>\n<\/div>\n<\/div>\n<div>\n<div>\n<div>In recent years, insurance companies have offered incentives to people who install dongles in their cars or download smartphone apps that monitor their driving, including how much they drive, how fast they take corners, how hard they hit the brakes and whether they speed. But \u201cdrivers are historically reluctant to participate in these programs,\u201d as Ford Motor put it in a\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/patentimages.storage.googleapis.com\/1d\/13\/d2\/197982a7afa0d8\/US20220188935A1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">patent application<\/a>\u00a0that describes what is happening instead: Car companies are collecting information directly from internet-connected vehicles for use by the insurance industry.<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div><\/div>\n<div>\n<div>\n<div>Sometimes this is happening with a driver\u2019s awareness and consent. Car companies have established relationships with insurance companies, so that if drivers want to sign up for what\u2019s called usage-based insurance \u2014 where rates are set based on monitoring of their driving habits \u2014 it\u2019s easy to collect that data wirelessly from their cars.<\/div>\n<div>But in other instances, something much sneakier has happened. Modern cars are internet-enabled, allowing access to services like navigation, roadside assistance and car apps that drivers can connect to their vehicles to locate them or unlock them remotely. In recent years, automakers, including G.M., Honda, Kia and Hyundai, have started offering optional features in their connected-car apps that rate people\u2019s driving. Some drivers may not realize that, if they turn on these features, the car companies then give information about how they drive to data brokers like LexisNexis.<\/div>\n<\/div>\n<\/div>\n<div><\/div>\n<p><!--more--><\/p>\n<div><\/div>\n<div><\/div>\n<div>\n<div>\n<div>Automakers and data brokers that have partnered to collect detailed driving data from millions of Americans say they have drivers\u2019 permission to do so. But the existence of these partnerships is nearly invisible to drivers, whose consent is obtained in fine print and murky privacy policies that few read.<\/div>\n<div>Especially troubling is that some drivers with vehicles made by G.M. say they were tracked even when they did not turn on the feature \u2014 called OnStar Smart Driver \u2014 and that their insurance rates went up as a result.<\/div>\n<div>\u201cGM\u2019s OnStar Smart Driver service is optional to customers,\u201d a G.M. spokeswoman, Malorie Lucich, said. \u201cCustomer benefits include learning more about their safe driving behaviors or vehicle performance that, with their consent, may be used to obtain insurance quotes. Customers can also unenroll from Smart Driver at any time.\u201d<\/div>\n<\/div>\n<\/div>\n<div><\/div>\n<div>\n<div>\n<div>Even for those who opt in, the risks are far from clear. I have a G.M. car, a Chevrolet. California\u2019s privacy regulator is\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/www.reuters.com\/business\/autos-transportation\/california-agency-probes-automakers-data-privacy-practices-2023-07-31\/%23:~:text=The%20California%20Privacy%20Protection%20Agency,which%20companies%20it%20is%20reviewing.\" target=\"_blank\" rel=\"noopener noreferrer\">currently investigating<\/a>\u00a0automakers\u2019 data collection practices. Warnings about the tracking are scattered across online discussion boards dedicated to vehicles manufactured by G.M. \u2014 including Corvettes, a sports car designed for racking up \u201cacceleration events.\u201d (One driver\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/www.midenginecorvetteforum.com\/forum\/me-discussion-photos-videos\/420220-heads-up-beware-of-the-smart-driver-feature-of-onstar\/page6\" target=\"_blank\" rel=\"noopener noreferrer\">lamented<\/a>\u00a0having data collected during a \u201ctrack day,\u201d while testing out the Corvette\u2019s limits on a professional racetrack.)<\/div>\n<div><\/div>\n<div>Numerous people on the forums complained about spiking premiums as a result. A Cadillac driver in Palm Beach County, Fla., who asked not to be named because he is considering a lawsuit against G.M., said he was denied auto insurance by seven companies in December. When he asked an agent why, she advised him to pull his LexisNexis report. He discovered six months of his driving activity, including many instances of hard braking and hard accelerating, as well as some speeding.<\/div>\n<div><\/div>\n<div>\u201cI don\u2019t know the definition of hard brake. My passenger\u2019s head isn\u2019t hitting the dash,\u201d he said. \u201cSame with acceleration. I\u2019m not peeling out. I\u2019m not sure how the car defines that. I don\u2019t feel I\u2019m driving aggressively or dangerously.\u201d<\/div>\n<div><\/div>\n<div>When he finally obtained car insurance, through a private broker, it was double what he had previously been paying.<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div><\/div>\n<div>\n<div>\n<div>The Cadillac owner, Mr. Dahl and the drivers on the forums had all been enrolled in OnStar Smart Driver. OnStar is G.M.\u2019s Internet-connected service for its cars and Smart Driver is a free, gamified feature within G.M.\u2019s connected car apps (all part of OnStar, but branded MyChevrolet, MyBuick, MyGMC and MyCadillac).<\/div>\n<div><\/div>\n<div>Smart Driver can \u201chelp you become a better driver,\u201d according to a\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/www.onstar.com\/services\/smart-driver\" target=\"_blank\" rel=\"noopener noreferrer\">corporate website<\/a>, by tracking and rating seatbelt use and driving habits. In a recent promotional campaign, an Instagram influencer used Smart Driver in a\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/www.instagram.com\/p\/C2VIJnvRWCf\/\" target=\"_blank\" rel=\"noopener noreferrer\">competition<\/a>\u00a0with her husband to find out who could collect the most digital badges, such as \u201cbrake genius\u201d and \u201climit hero.\u201d<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div>\n<section id=\"car_privacy_ig_embed\" data-id=\"100000009351006\" data-source-id=\"100000009351006\" She said it is \u201cimpossible for consumers to try and understand\u201d the legalese-filled policies for car companies, their connected services and their apps. She called cars \u201ca privacy nightmare.\u201d<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div><\/div>\n<div>\n<div>\n<div>\u201cThe car companies are really good at trying to link these features to safety and say they are all about safety,\u201d Ms. Caltrider said. \u201cThey\u2019re about making money.\u201d<\/div>\n<div>Neither the car companies nor the data brokers deny that they are engaged in this practice, though automakers say the main purpose of their driver feedback programs is to help people develop safer driving habits.<\/div>\n<div>After LexisNexis and Verisk get data from consumers\u2019 cars, they sell information about how people are driving to insurance companies. To access it, the insurance companies must get consent from the drivers \u2014 say, when they go out shopping for car insurance and sign off on boilerplate language that gives insurance companies the right to pull third-party reports. (Insurance companies\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/www.marketwatch.com\/guides\/insurance-services\/car-insurance-no-credit-history\" target=\"_blank\" rel=\"noopener noreferrer\">commonly ask for access<\/a>\u00a0to a consumer\u2019s credit or risk reports, though they are\u00a0<a title=\"\" href=\"https:\/\/archive.is\/o\/6YyXQ\/https:\/\/www.ncsl.org\/state-legislatures-news\/details\/states-consider-limits-on-insurers-use-of-consumer-credit-info\" target=\"_blank\" rel=\"noopener noreferrer\">barred from doing so<\/a>\u00a0in California, Massachusetts, Michigan and Hawaii.)<\/div>\n<div>An employee familiar with G.M.\u2019s Smart Driver said the company\u2019s annual revenue from the program is in the low millions of dollars.<\/div>\n<div>LexisNexis Risk Solutions, which retains consumers\u2019 driving data for six months, has \u201cstrict privacy and security policies designed to ensure that data is not accessed or used impermissibly,\u201d the company said in a statement.<\/div>\n<\/div>\n<aside aria-label=\"companion column\"><\/aside>\n<\/div>\n<div><\/div>\n<div>\n<div>\n<div>Verisk provides insurers with trip data and a risk score \u201capproved by insurance regulators in 46 states and the District of Columbia,\u201d said a spokeswoman, Amy Ebenstein.
