{"id":100834,"date":"2024-03-19T23:37:33","date_gmt":"2024-03-20T04:37:33","guid":{"rendered":"https:\/\/milesfortis.com\/?p=100834"},"modified":"2024-03-19T23:37:33","modified_gmt":"2024-03-20T04:37:33","slug":"100834","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=100834","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.nssf.org\/articles\/indiana-utah-governors-sign-second-amendment-privacy-laws\/\" target=\"_blank\" rel=\"noopener\">INDIANA, UTAH GOVERNORS SIGN SECOND AMENDMENT PRIVACY LAWS<\/a><\/p>\n<p>WASHINGTON, D.C.\u00a0\u2014 NSSF<sup>\u00ae<\/sup>, The Firearm Industry Trade Association, applauds Indiana Gov. Eric Holcomb and Utah Gov. Spencer Cox for signing the NSSF-supported Second Amendment Privacy Acts in their respective states. The laws will bar the use of a firearm-retailer specific Merchant Category Code (MCC) for banks, credit card companies or financial service providers to track the lawful sale of firearms and ammunition.<\/p>\n<p>Both governors signed their laws,\u00a0<strong><a href=\"https:\/\/iga.in.gov\/legislative\/2024\/bills\/house\/1084\/details\">Indiana\u2019s HB 1084<\/a><\/strong>\u00a0and\u00a0<a href=\"https:\/\/le.utah.gov\/~2024\/bills\/static\/HB0406.html\"><strong>Utah\u2019s HB 406<\/strong><\/a>, in their respective states last week. NSSF worked closely with legislators in those states to bring legislation to protect private and legal purchases from exploitation. The laws are designed to protect the privacy of lawful and private firearm and ammunition purchases from being abused for political purposes by corporate financial service providers and unlawful government search and seizure of legal and private financial transactions.<\/p>\n<p>\u201cCorporate banks and the federal government have already proven they will run roughshod over Second Amendment and Privacy rights. The need to safeguard private and legal purchases of firearms and ammunition by law-abiding citizens has never been greater,\u201d said Lawrence G. Keane, NSSF Senior Vice President &amp; General Counsel. \u201cNSSF thanks both Governor Holcomb and Governor Cox for their leadership in signing these laws that will protect the rights of the citizens in their states. No American should fear being placed on a government watchlist simply for exercising their Constitutionally-protected rights to keep and bear arms.\u201d<\/p>\n<p>The U.S. Treasury\u2019s Financial Crimes Enforcement Network (FinCEN)\u00a0<strong><a href=\"https:\/\/www.foxnews.com\/politics\/biden-admin-confirms-terms-maga-trump-kamala-private-bank-transaction-searches\">admitted<\/a><\/strong>\u00a0to U.S. Sen. Tim Scott (R-S.C.) in a letter that it violated the Fourth Amendment rights of law-abiding citizens that protect against illegal search and seizure when it collected the credit card purchase history from banks and credit card companies of individuals who purchased firearms and ammunition in the days surrounding Jan. 6, 2020. Treasury\u2019s FinCEN had no cause, and sought the information without a warrant, to place these law-abiding citizens on a government watchlist only because they exercised their Second Amendment rights to lawfully purchase firearms and ammunition.<\/p>\n<p>The idea of a firearm-retailer specific MCC was borne from antigun New York Times columnist\u00a0<a href=\"https:\/\/www.nssf.org\/articles\/new-york-times-proposes-credit-card-monitoring-gun-rights\/\"><strong>Andrew Ross Sorkin<\/strong><\/a>\u00a0and Amalgamated Bank, which has been called \u201c<strong><a href=\"https:\/\/nypost.com\/2023\/02\/07\/how-amalgamated-bank-became-the-the-lefts-private-banker\/\">The Left\u2019s Private Banker<\/a><\/strong>\u201d and bankrolls the Democratic National Committee and several antigun politicians. Amalgamated Bank lobbied the Swiss-based International Organization for Standardization (ISO) for the code\u2019s creation. NSSF has called on Congress to investigate Amalgamated Bank\u2019s role in manipulating the ISO standard setting process.<\/p>\n<p>Sorkin\u00a0<strong><a href=\"https:\/\/www.nssf.org\/articles\/gun-control-reveals-merchant-code-is-stepping-stone-to-watchlists-and-bans\/?hilite=sorkin\">admitted<\/a><\/strong>\u00a0creating a firearm-retailer specific MCC would be a first step to creating a national firearm registry, which is forbidden by federal law.<\/p>\n<p>Indiana and Utah join Florida, Idaho, Mississippi, Montana, North Dakota, Texas and West Virginia with laws protecting citizens\u2019 Second Amendment privacy. Several other states are considering similar legislation. U.S. Rep. Elise Stefanik (R-N.Y.) introduced\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/7450?s=1&amp;r=4\"><strong>H.R. 7450<\/strong><\/a>, the\u00a0<strong><a href=\"https:\/\/www.nssf.org\/articles\/nssf-hails-introduction-of-rep-elise-stefaniks-protecting-privacy-in-purchases-act\/\">NSSF-supported Protecting Privacy in Purchases Act<\/a><\/strong>, in the U.S. House of Representatives. California\u2019s Gov. Gavin Newsom\u00a0<strong><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB1587\">signed a law<\/a><\/strong>\u00a0requiring the use of a firearm-retailer specific MCC and Colorado\u00a0<a href=\"https:\/\/www.coloradopolitics.com\/local-government\/colorado-senate-considers-bill-to-track-suspicious-gun-and-ammo-purchases\/article_f1a91258-c6ca-11ee-b899-1780ca15aeb3.html\"><strong>is considering<\/strong><\/a>\u00a0similar legislation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>INDIANA, UTAH GOVERNORS SIGN SECOND AMENDMENT PRIVACY LAWS WASHINGTON, D.C.\u00a0\u2014 NSSF\u00ae, The Firearm Industry Trade Association, applauds Indiana Gov.
