Local governments seeking to push gun control have been clever about finding ways to restrict people\u2019s right to keep and bear arms in ways not foreseen by previous preemption laws.\u00a0 For example, in Iowa, the\u00a0<a href=\"https:\/\/www.ammoland.com\/2024\/04\/louisiana-pre-emption-bill-passes-senate-28-11-on-to-house\/Present%20law%20limits%20a%20political%20subdivision's%20authorityto%20enact%20certainordinances%20orregulations%20involvingfirearms.%20In%20this%20regard,%20present%20law%20prohibits%20a%20governingauthorityof%20apolitical%20subdivision%20from%20enactinganyordinance%20or%20regulation%20that%20is%20more%20restrictivethan%20state%20law%20concerningthe%20sale,%20purchase,%20possession,%20ownership,%20transfer,%20transportation,license,%20or%20registration%20of%20firearms,%20ammunition,%20or%20components%20of%20firearms%20or%20ammunition.Proposed%20law%20prohibits%20a%20governingauthorityfrom%20enforcinganyordinance,%20order,regulation,%20policy,%20procedure,%20rule%20or%20anyother%20form%20of%20executive%20or%20legislative%20action%20morerestrictive%20than%20state%20law%20concerningin%20anywaythe%20manufacture,%20sale,%20purchase,%20possession,carrying,%20storage,%20ownership,%20taxation,%20transfer,%20transportation,%20license,%20or%20registration%20offirearms,%20ammunition,%20components%20of%20firearms%20or%20ammunition,%20firearms%20accessories,%20knives,edged%20weapons,%20or%20any%20combination%20thereof.\" target=\"_blank\" rel=\"noopener\" data-uri=\"771d5f3622f2941311d72a425607af16\">Dubuque City Council voted\u00a0<\/a>to create a zoning ordinance to prohibit otherwise legitimate gun sales. In Montana, the<a href=\"https:\/\/www.ammoland.com\/2019\/10\/montana-supreme-court-strikes-down-missoula-gun-control-scheme\/#axzz8XZVEdy9s\" target=\"_blank\" rel=\"noopener\" data-uri=\"108256cd6f2cbaf92f191008c220f57e\">\u00a0city government of Missoula<\/a>, dominated by the University of Montana, voted to require government approval of all firearm sales in the city.\u00a0 In response, state legislatures are strengthening preemption bills to prevent such abuses.<\/p>\n<p><strong>Several changes are being proposed in the preemption statute for the State of Louisiana. The differences between\u00a0<a href=\"https:\/\/www.legis.la.gov\/Legis\/ViewDocument.aspx?d=1351135\" target=\"_blank\" rel=\"noopener\" data-uri=\"2d3316e0a99efa55ff48548af522ea0d\">the present law and the proposed bill<\/a>\u00a0are shown on the Louisiana Legislature website.<\/strong><\/p>\n<blockquote><p><span style=\"font-size: 12pt; color: #000000;\"><strong>Present law limits a political subdivision\u2019s authority to enact certain ordinances or regulations involving firearms. In this regard, present law prohibits a governing authority of a political subdivision from enacting any ordinance or regulation that is more restrictive than state law concerning the sale, purchase, possession, ownership, transfer, transportation,license, or registration of firearms, ammunition, or components of firearms or ammunition.<\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt; color: #000000;\"><strong>Proposed law prohibits a governing authority from enforcing any ordinance, order, regulation, policy, procedure, rule or any other form of executive or legislative action more restrictive than state law concerning in any way the manufacture, sale, purchase, possession,carrying, storage, ownership, taxation, transfer, transportation, license, or registration of firearms, ammunition, components of firearms or ammunition, firearms accessories, knives,edged weapons, or any combination thereof.<\/strong><\/span><\/p><\/blockquote>\n<p>The differences are significant. Present law\u00a0<b>limits<\/b>\u00a0a political subdivision\u2019s authority to enact ordinances or regulations. The proposed bill\u00a0<b>prohibits<\/b>\u00a0all governmental authorities (except the state legislature) from enforcing a wider range of items, expanded beyond\u00a0<b>ordinances or regulations<\/b>\u00a0involving firearms to any<b>\u00a0ordinance, order, regulation, policy, procedure, rule or any other form of executive or legislative action.\u00a0<\/b><\/p>\n<p><!--more--><\/p>\n<div class=\"code-block code-block-5\">\n<div id=\"div-gpt-ad-1681151398698-0\" data-google-query-id=\"CLLVlMzdzoUDFSO-0QQdK7wMOg\">\n<div id=\"google_ads_iframe_\/22702991301\/Ammoland\/AL_In-Content_1_0__container__\"><\/div>\n<\/div>\n<\/div>\n<p>The list of things that may not be regulated\u00a0<b>is expanded\u00a0<\/b>to include\u00a0<b>manufacture, carrying, storage, and taxation.<\/b>\u00a0The items protected are expanded to include\u00a0<b>firearms accessories, knives, edged weapons, or any combination thereof<\/b>.<\/p>\n<p>When local governments work hard to find ways to restrict the right to keep and bear arms, responsible legislatures are finding ways to specifically prohibit them from doing so. Some states, such as\u00a0<a href=\"https:\/\/www.ammoland.com\/2023\/01\/nikki-fried-loses-gun-law-preemption-florida-gun-owners-win\/#axzz8XZVEdy9s\" target=\"_blank\" rel=\"noopener\" data-uri=\"a17d2dfe2f94f35997be1cbb524c4eac\">Florida, have imposed<\/a>\u00a0financial penalties for government entities and personal liabilities for local politicians who enact ordinances that violate the preemption laws.<\/p>\n<p>Bill 124 in Louisiana still has to pass the House. It seems likely to pass the House and be sent to the Governor for signature.<\/p>\n<div class=\"code-block code-block-6\">\n<div id=\"div-gpt-ad-1681151438500-0\" data-google-query-id=\"CLPVlMzdzoUDFSO-0QQdK7wMOg\">\n<div id=\"google_ads_iframe_\/22702991301\/Ammoland\/AL_In-Content_2_0__container__\">\n<div id=\"AmmolandDFPAdParallaxerCont_138471735029\">\n<div class=\"ammoland-parallaxer-eCreatBase\">\n<div class=\"ammoland-parallaxer-eCreat\"><\/div>\n<\/div>\n<div>\n<div>In spite of clear guidance from the Supreme Court in the Bruen decision, a <a href=\"https:\/\/www.ammoland.com\/2024\/03\/repressive-states-no-right-to-carry-ban-on-semi-autos-no-suppressors-and-high-taxes\/#axzz8XZVEdy9s\" target=\"_blank\" rel=\"noopener\" data-uri=\"1c950987f2630ebfdd25bba4140546b3\">few repressive states<\/a>\u00a0continue to defy the court and illegally restrict the right to keep and bear arms.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>The United States is bifurcating into a few states (8-9) that defy the Supreme Court and the vast majority that respect the Second Amendment. This is not a healthy situation for a constitutional republic.
