{"id":101571,"date":"2024-04-26T19:38:02","date_gmt":"2024-04-27T00:38:02","guid":{"rendered":"https:\/\/milesfortis.com\/?p=101571"},"modified":"2024-04-26T19:38:02","modified_gmt":"2024-04-27T00:38:02","slug":"101571","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=101571","title":{"rendered":""},"content":{"rendered":"<div class=\"post-desc\">\n<p><a href=\"https:\/\/www.dailysignal.com\/2024\/04\/15\/indiana-prosecutor-laments-that-self-defense-laws-exist-protect-defensive-gun-users\/\">Indiana Prosecutor Laments That Self-Defense Laws Exist, Protect Defensive Gun Users.<\/a><\/p>\n<\/div>\n<div class=\"post-footer container-fluid\">\n<div class=\"row post-meta\">\n<p>Apparently, some Indianapolis public officials have forgotten how their own self-defense laws work and why they exist in the first place.<\/p>\n<p>In an interview that\u2019s equal parts amusing and alarming, Indiana\u2019s Marion County Prosecutor Ryan Mears recently\u00a0<a href=\"https:\/\/www.wthr.com\/article\/news\/crime\/indianapolis-law-enforcement-sees-rise-self-defense-shootings-impd-chief-chris-bailey-marion-county-prosecutor-ryan-mears-indianapolis-mayor-hogsett\/531-d3f15498-60d0-4dfd-947d-98215a1253ea\">lamented an increase<\/a>\u00a0in self-defense shootings in Indianapolis.<\/p>\n<p>Mears complained to reporters that shootings involving self-defense claims are challenging to prosecute. This \u201cmean[s] that someone lost their life\u201d and \u201cthat case might ultimately be cleared\u201d without the shooter being charged, he said.<\/p>\n<p>Mears also implied that\u00a0<a href=\"https:\/\/www.dailysignal.com\/tag\/defensive-gun-use\/\">defensive gun users\u00a0<\/a>who can\u2019t be prosecuted are just as bad as the criminals they shot, simply by virtue of the fact that both parties were armed.<\/p>\n<p>With all due respect to Mears, the county prosecutor seems to miss the point.<\/p>\n<p>As in virtually every other state, Indiana law justifies the use of deadly force only when a person has a reasonable belief that such force is necessary to prevent serious bodily injury, commission of a forcible felony, or unlawful entry into a home or vehicle.<\/p>\n<p>Moreover, a person generally can\u2019t rely on the protection of self-defense laws if he or she was\u00a0<a href=\"https:\/\/www.dailysignal.com\/tag\/crime\">committing a crime<\/a>\u00a0or fleeing after committing one, provoked the threat, or engaged in \u201cmutual combat.\u201d<\/p>\n<p>In other words, to the extent that self-defense shootings are difficult to prosecute, it\u2019s because there\u2019s pretty good evidence that the shooter was morally and legally justified in doing what he did.<\/p>\n<p>You would think that someone like Mears would comprehend this, given his position as a prosecutor.<\/p>\n<p>The importance of armed self-defense can\u2019t be overstated. Almost every major study has found that Americans use their firearms in self-defense between\u00a0<a href=\"https:\/\/nap.nationalacademies.org\/read\/18319\/chapter\/3#15\" target=\"_blank\" rel=\"noreferrer noopener\">500,000 and 3 million<\/a>\u00a0times annually, according to a 2013 report by the Centers for Disease Control and Prevention. In 2021, the most comprehensive study ever conducted on the issue concluded that\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4109494\">roughly 1.6 million defensive gun uses<\/a>\u00a0occur in the United States every year.<\/p>\n<\/div>\n<\/div>\n<p><!--more--><\/p>\n<div class=\"post-footer container-fluid\">\n<div class=\"row post-meta\">\n<p>For this reason, The Daily Signal publishes a monthly article highlighting some of the previous month\u2019s many news stories on defensive gun use that you may have missed\u2014or that might not have made it to the national spotlight in the first place. You may explore more using The Heritage Foundation\u2019s interactive\u00a0<a href=\"https:\/\/datavisualizations.heritage.org\/firearms\/defensive-gun-uses-in-the-us\/\" target=\"_blank\" rel=\"noreferrer noopener\">Defensive Gun Use Database<\/a>.<\/p>\n<p>(The Daily Signal is the news and commentary outlet of The Heritage Foundation.)<\/p>\n<ul>\n<li><strong>March 2, Waco, Nebraska:\u00a0<\/strong>Police said a man refused to remove his camper from a family member\u2019s property, then\u00a0<a href=\"https:\/\/www.1011now.com\/2024\/03\/13\/fight-between-family-members-ends-with-beating-gunshot-wound-york-county\/\">assaulted the relative\u00a0<\/a>with a blunt object, hitting him in the head and knocking him to the ground. The victim drew a gun and shot the man in the arm to end the assault, police said. The man was charged with second-degree assault, among other offenses.<\/li>\n<li><strong>March 4, Bristol, Tennessee:\u00a0<\/strong>An\u00a0<a href=\"https:\/\/www.salisburypost.com\/2024\/03\/06\/salisbury-man-arrested-in-tennessee-during-thwarted-armed-robbery\/\">off-duty corrections officer thwarted an armed robbery<\/a>\u00a0at a convenience store while on the way to work, police said. The officer held the robber at gunpoint until police arrived, and the Police Department later issued a statement of gratitude. The suspect was charged with aggravated robbery and possession of a firearm by a convicted felon.<\/li>\n<li><strong>March 8, Chicago:\u00a0<\/strong>Police said a\u00a0<a href=\"https:\/\/abc7chicago.com\/chicago-shooting-concealed-carry-attempted-robbery-auburn-gresham\/14503621\/\">60-year-old holder of a concealed carry permit<\/a>\u00a0engaged in a shootout with an armed robber who approached him while he made an ATM withdrawal. Despite sustaining a gunshot wound himself, the permit holder fatally shot the robber. The victim was admitted to a hospital in stable condition.<\/li>\n<li><strong>March 9, Espanola, New Mexico:\u00a0<\/strong>An\u00a0<a href=\"https:\/\/www.riograndesun.com\/news\/alleged-burglar-shot-by-homeowner-idd\/article_a4211972-dfde-11ee-b3a5-d745500ddcc7.html\">elderly homeowner fatally shot a burglar<\/a>\u00a0who assaulted him and his wife after they confronted him in their garage. Police said the burglar was well known to them in connection with similar crimes in the area.<\/li>\n<li><strong>March 11, Lakeland, Florida:\u00a0<\/strong>Police said a legally armed man used two of his firearms\u2014a handgun and rifle\u2014to defend himself, his girlfriend, and her two children during an exchange of gunfire\u00a0<a href=\"https:\/\/www.theledger.com\/story\/news\/crime\/2024\/03\/12\/two-killed-including-3-year-old-child-in-north-lakeland-shooting\/72941396007\/\">with two gunmen<\/a>\u00a0who approached them as they prepared to leave a friend\u2019s house in their car. The legally armed boyfriend shot and killed one assailant, but unfortunately not before the attackers\u2019 gunfire fatally struck the woman\u2019s 3-year-old boy. Her boyfriend was wounded, but not in a life-threatening way. The woman and the other child were unharmed, police said.<\/li>\n<li><strong>March 14, Blackfoot, Idaho:\u00a0<\/strong>Police said that an\u00a0<a href=\"https:\/\/www.idahostatejournal.com\/freeaccess\/authorities-release-name-of-suspect-who-was-fatally-shot-during-home-invasion-near-blackfoot\/article_8c286728-e171-11ee-9ba8-b7f87f34d276.html\">elderly homeowner fatally shot an intruder<\/a>\u00a0who broke into her home in the middle of the day and viciously assaulted her, causing injuries that required hospital treatment.<\/li>\n<li><strong>March 19, Zolfo Springs, Florida:\u00a0<\/strong>A sheriff\u2019s deputy responded to a call about an armed domestic violence offender\u00a0<a href=\"https:\/\/www.wtsp.com\/article\/news\/crime\/hardee-deputies-man-shot-ran-away\/67-5124f244-724b-4703-8f66-528fc7f34264\">violating a no-contact<\/a>\u00a0order, investigators said. The deputy found the offender in the backyard of the victim\u2019s home, armed with an AR-15, and exchanged gunfire with him. When the offender began shooting at the house, the victim\u2019s father became worried for the safety of his family. He\u00a0<a href=\"https:\/\/www.yahoo.com\/news\/dad-grabs-pistol-joins-deputy-112514372.html?soc_src=social-sh&amp;soc_trk=tw&amp;tsrc=twtr\">grabbed his own handgun and joined the deputy in the gunfight<\/a>. The suspect fled but was captured two days later and\u00a0faces serious criminal charges. The victims and the deputy were not injured.<\/li>\n<li><strong>March 20, Rock Cave, West Virginia:\u00a0<\/strong>Police said a\u00a0<a href=\"https:\/\/www.cbsnews.com\/pittsburgh\/news\/west-virginia-boy-self-defense-shooting-father-mother\/\">15-year-old boy fatally shot his father in self-defense<\/a>\u00a0after the man fired a shotgun at his wife, then pointed the weapon at the boy. The victims weren\u2019t injured.<\/li>\n<li><strong>March 25, Madison Township, Ohio:\u00a0<\/strong>Police said scammers\u00a0<a href=\"https:\/\/dayton247now.com\/news\/local\/two-people-in-hospital-after-assault-shooting-at-clark-county-home\">targeted an elderly man<\/a>, telling him over multiple phone calls that an incarcerated relative needed a significant amount of money for bail. They threatened the man with violence when he seemed hesitant to comply with instructions. A woman whom police believe associated with the scammers came to the elderly man\u2019s house and assaulted him, inflicting serious injuries. He fatally shot her in self-defense, police said.<\/li>\n<li><strong>March 28, Melrose, Florida:<\/strong>\u00a0An\u00a0<a href=\"https:\/\/www.wcjb.com\/2024\/03\/29\/i-am-god-gainesville-man-shot-chest-through-bible-during-violent-rampage\/\">armed driver shot and wounded<\/a>\u00a0a mentally disturbed man who assaulted him with a shovel, breaking his arm, police said. This followed a bizarre and frightening rampage in which the mentally disturbed man\u2014claiming to be God\u2014walked into traffic while holding his baby and a Bible, laid down on top of the baby in the middle of the street, and assaulted anyone who tried to intervene. The baby was evaluated at a pediatric emergency room; \u00a0the driver was treated at a hospital for his injuries. The suspect was expected to face criminal charges.<\/li>\n<li><strong>March 31, Lincolnton, North Carolina:\u00a0<\/strong>Police said a customer at a gas station shot and wounded a robber who\u00a0<a href=\"https:\/\/www.wsoctv.com\/news\/local\/person-shoots-thief-during-attempted-robbery-lincolnton-gas-station-police-say\/S5T7H2V2ANEIHPBNWYME7YIP74\/\">tried to steal his car<\/a>\u00a0and threatened him with a knife. The robber was arrested; the customer was not injured.<\/li>\n<\/ul>\n<p>These examples provide just a small glimpse into how ordinary Americans routinely use\u00a0<a href=\"https:\/\/www.dailysignal.com\/tag\/firearms\/\">their firearms\u00a0<\/a>to protect themselves and others.<\/p>\n<p>Lawfully possessing a firearm didn\u2019t turn them into \u201cbad actors\u201d deserving of condemnation and punishment.
