However, judges thus far appear skeptical of disrupting at least one realm of gun law: background check requirements.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"\" data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Even in novel formats, background check requirements have largely escaped falling victim to the text, history, and tradition-based legal test so many other gun laws\u00a0<\/span><\/span><a class=\"editor-rtfLink\" href=\"https:\/\/thereload.com\/report-far-more-gun-laws-struck-down-in-wake-of-bruen-than-heller\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">have been felled<\/span><\/span><\/a><span class=\"\" data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0by in the courts. Most recently, the \u201cenhanced\u201d background check requirements for 18-20-year-old gun buyers in the 2022 Bipartisan Safer Communities Act were\u00a0<\/span><\/span><a class=\"editor-rtfLink\" href=\"https:\/\/thereload.com\/fifth-circuit-upholds-enhanced-gun-background-checks-for-young-adults\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">upheld as constitutional<\/span><\/span><\/a><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0by the Fifth Circuit Court of Appeals.<\/span><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u201cThe [Second Amendment\u2019s] plain text covers plaintiffs\u2019 right \u2018to keep and bear arms,\u2019\u201d Judge Jerry E. Smith, a Ronald Reagan appointee, wrote on behalf of a unanimous panel\u00a0<\/span><a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-10837-CV0.pdf\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">in\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">McRorey v. Garland<\/span><\/em><\/a><span class=\"text-node\">. \u201cAnd on its face \u2018keep and bear\u2019 does not include purchase\u2014let alone without background check. That is so in either the contemporary or the Founding-era context.\u201d<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">As a result, there is now precedent in the country\u2019s most conservative circuit blessing a background check scheme that effectively creates a ten day waiting period. And it\u2019s difficult to see gun-rights challengers having better luck elsewhere.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"\" data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">In part, gun-rights litigants have a dicta problem.\u00a0<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The language deployed by the Supreme Court to hedge its majority opinions in\u00a0<\/span><\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Heller<\/span><\/span><\/em><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0and\u00a0<\/span><\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen<\/span><\/span><\/em><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0is repeatedly\u00a0<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">being<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0used<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0to uphold modern gun laws, even those that\u00a0<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">would<\/span><\/span><span class=\"\" data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0seem to lack a historical analogue at first glance.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><!--more--><\/p>\n<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1891bb6e elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1891bb6e\" data-element_type=\"section\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<div class=\"elementor-container elementor-column-gap-default\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">In the\u00a0<\/span><\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">McRorey<\/span><\/span><\/em><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0decision, the Fifth Circuit panel drew from a portion of Justice Scalia\u2019s\u00a0<\/span><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/554\/570\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">opinion<\/span><\/a><span class=\"text-node\">\u00a0in\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Heller<\/span><\/em><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">that emphasized how the Court\u2019s holding was not casting doubt on \u201claws imposing conditions and qualifications on the commercial sale of arms.\u201d<\/span><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">That dicta, coupled with the panel\u2019s view that purchasing firearms is merely ancillary to \u201ckeeping\u201d or \u201cbearing\u201d firearms, is how it justified eschewing a historical inquiry. So, they didn\u2019t require the federal government to provide Founding-Era analogues to a requirement that young adults go through a three-to-ten-day waiting period and background check before buying a gun.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u201c<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen<\/span><\/em><span class=\"text-node\">\u00a0and\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Heller<\/span><\/em><span class=\"text-node\">\u00a0make clear that background checks preceding firearm sales are presumptively constitutional,\u201d Judge Smith wrote. \u201cPlaintiffs fail to rebut that presumption.\u201d<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The lower court decision Smith and his co-panelists were deciding on appeal reached a similar conclusion, mainly based on what the lower court viewed as the\u00a0<\/span><\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen<\/span><\/span><\/em><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0opinion\u2019s implied blessing of objective, shall-issue carry permitting regimes and their associated background check procedures.<\/span><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u201cThe\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen<\/span><\/em><span class=\"text-node\">\u00a0majority therefore seems to acknowledge the facial constitutionality of regimes requiring background checks and attendant waiting periods to ensure a potential purchaser is not prohibited from exercising Second Amendment rights, so long as the waiting periods are not \u2018lengthy,\u2019\u201d District Judge Reed O\u2019Connor\u00a0<\/span><a href=\"https:\/\/www.courtlistener.com\/docket\/67374680\/30\/mcrorey-v-merrick-b-garland\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">wrote<\/span><\/a><span class=\"text-node\">.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">And while that practice has not only been limited to cases involving background checks and waiting periods (a federal\u00a0<\/span><a href=\"https:\/\/thereload.com\/seventh-circuit-upholds-illinois-assault-weapon-magazine-bans\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">appeals court cited<\/span><\/a><span class=\"text-node\">\u00a0the\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Heller<\/span><\/em><span class=\"text-node\">\u00a0opinion\u2019s dicta about military M16s not being protected by the Second Amendment to uphold a ban on civilian AR-15s, for instance), it poses a particular hurdle for challenges to those policies. That\u2019s because, unlike outright hardware or carry bans, background checks and, to a certain extent, waiting periods are much\u00a0<\/span><a href=\"https:\/\/www.axios.com\/2023\/04\/28\/fox-news-poll-voters-want-gun-control\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">more popular<\/span><\/a><span class=\"text-node\">.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Put another way, a ruling striking down the National Instant Criminal Background Check System is likely to engender far more backlash, including from people otherwise sympathetic to gun rights, than one doing away with gun-free zones or AR bans. Though judges\u00a0<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">are meant<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0to\u00a0<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">be insulated<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0from the whims of public opinion, they often remain sensitive to considerations beyond the letter of the law. That includes the judges on the Supreme Court.<\/span><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">To date, the Court\u2019s major decisions upholding gun rights have all\u00a0<\/span><a href=\"https:\/\/thereload.com\/analysis-the-popularity-of-the-bruen-decision-should-not-come-as-a-surprise-member-exclusive\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">been broadly popular<\/span><\/a><span class=\"text-node\">\u00a0because they have more or less struck down restrictions that most of the country had long ago rejected. Handgun bans were broadly unpopular well before\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Heller<\/span><\/em><span class=\"text-node\">\u00a0and the vast majority of states had already adopted permissive concealed carry laws before\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen<\/span><\/em><span class=\"text-node\">.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Some of the conservative Justices have also shown signs they aren\u2019t necessarily looking to get ahead of public opinion on guns in the Court\u2019s most recent cases.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The Justices agreed to review the federal gun ban for persons subject to domestic violence restraining orders and\u00a0<\/span><a href=\"https:\/\/thereload.com\/analysis-reading-the-scotus-tea-leaves-in-rahimi-member-exclusive\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">strongly suggested<\/span><\/a><span class=\"text-node\">\u00a0they intended to overturn that ruling during oral arguments last November. Additionally, the Court has taken up a case against the ATF\u2019s reclassification of bump stocks as machine guns. While those\u00a0<\/span><a href=\"https:\/\/thereload.com\/supreme-court-debates-legality-of-bump-stock-ban\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">oral arguments<\/span><\/a><span class=\"text-node\">\u00a0were less suggestive of a particular outcome, they did feature multiple instances of conservative Justices expressing sympathy for the need to outlaw both machine guns and bump stocks.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u201cLook, intuitively, I am entirely sympathetic to your argument,\u201d Justice Amy Coney Barrett said in an exchange with the Solicitor General on why bump stocks should be banned. \u201cI mean, it seems like, yes, that this is functioning like a machinegun would.\u201d<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u201cI can certainly understand why these items should be made illegal,\u201d Justice Neil Gorsuch\u00a0<\/span><a href=\"https:\/\/thereload.com\/analysis-where-will-the-supreme-court-come-down-on-bump-stocks-member-exclusive\/\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">added<\/span><\/a><span class=\"text-node\">\u00a0separately.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The Court\u2019s\u00a0<\/span><\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Bruen\u00a0<\/span><\/span><\/em><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">opinion sets a difficult bar to clear for most gun restrictions, but that doesn\u2019t necessarily mean the Justices will follow through in striking down many of the more popular gun laws currently on the books. So, g<\/span><\/span><span data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">un-rights<\/span><\/span><span class=\"pf-delete\" data-preserver-spaces=\"true\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\"> advocates should not count on background check challenges succeeding.
