{"id":101817,"date":"2024-05-10T18:46:45","date_gmt":"2024-05-10T23:46:45","guid":{"rendered":"https:\/\/milesfortis.com\/?p=101817"},"modified":"2024-05-10T18:46:45","modified_gmt":"2024-05-10T23:46:45","slug":"101817","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=101817","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.militarytimes.com\/education-transition\/2024\/04\/16\/supreme-court-rules-in-favor-of-veteran-who-sued-over-gi-bill-limits\/\" target=\"_blank\" rel=\"noopener\">Supreme Court rules in favor of veteran who sued over GI Bill limits<\/a><\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\"><a href=\"https:\/\/www.militarytimes.com\/military-honor\/salute-veterans\/2023\/11\/08\/advocates-push-supreme-court-to-expand-veterans-education-benefits\/\" target=\"_blank\" rel=\"noopener\">The Supreme Court<\/a>\u00a0on Tuesday ruled in favor of a veteran who unsuccessfully tried to use both his\u00a0<a href=\"https:\/\/www.militarytimes.com\/education-transition\/2020\/01\/13\/court-rules-again-to-give-veterans-access-to-both-post-911-and-montgomery-gi-bill-education-benefits\/\" target=\"_blank\" rel=\"noopener\">Post-9\/11 GI Bill and Montgomery GI Bill benefits<\/a>, saying that Veterans Affairs officials erred in limiting his education support.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">The 7-2 decision could have<a href=\"https:\/\/www.militarytimes.com\/education-transition\/2020\/12\/26\/one-vets-gi-bill-fight-could-win-benefits-for-millions-of-other-students\/\" target=\"_blank\" rel=\"noopener\">\u00a0far-reaching impact on student veterans\u00a0<\/a>who use up their VA benefits but still wish to continue degree programs. Lawyers for the plaintiff have estimated as many as 1.7 million veterans nationwide could benefit from the ruling, but federal officials have estimated the number to be less than 30,000 individuals.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">The case has been\u00a0<a href=\"https:\/\/www.militarytimes.com\/education-transition\/2020\/04\/01\/attorneys-want-court-to-fast-track-gi-bill-legal-case-because-of-coronavirus-financial-impact\/\" target=\"_blank\" rel=\"noopener\">closely watched by veterans advocates for nearly nine years\u00a0<\/a>because of its potential ramifications. VA pays out more than $8 billion in education payments annually, and the Supreme Court ruling could boost that figure even higher.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">The legal fight centered on\u00a0<a href=\"https:\/\/www.militarytimes.com\/education-transition\/2020\/12\/26\/one-vets-gi-bill-fight-could-win-benefits-for-millions-of-other-students\/\" target=\"_blank\" rel=\"noopener\">Jim Rudisill,<\/a> a 43-year-old Army veteran who was wounded in a roadside bomb attack in Iraq in 2005. Rudisill used all of his Post-9\/11 GI Bill benefits shortly thereafter, but later wanted to tap into his unused Montgomery GI Bill benefits to attend Yale Divinity School as part of the process to become an Army chaplain.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">When VA officials denied that move, Rudisill sued, claiming they were unfairly limiting his options. Writing for the majority, Justice Ketanji Brown Jackson called the government\u2019s denial \u201cnonsensical\u201d and reversed lower court rulings supporting VA\u2019s position.<\/p>\n<p><!--more--><\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">Most veterans attending college today with federal financial support use the Post-9\/11 GI Bill program, a generous benefit passed in 2008 that awards eligible veterans 36 months of tuition payouts, housing stipends and other financial assistance.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">The Montgomery GI Bill program was the predecessor to that benefit, and is being phased out by the department. It offers far less money, but still can provide several thousands of dollars annually to veterans for tuition costs if they paid into the program at the start of their military service.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">Currently, VA officials make students give up eligibility for the Montgomery GI Bill program when they register to begin using the Post-9\/11 GI Bill. That means that once their education benefits from that program are exhausted, they cannot receive more tuition support from the other program.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">But Rudisill\u2019s attorneys argued that the limit is unfair and unfounded in federal law. Jackson agreed with that stance in her opinion.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">\u201cIf service members serve for long enough, they may be entitled to both [education benefits],\u201d Jackson wrote. \u201cBut such service members cannot receive disbursements from both entitlement programs at the same time, nor may they receive any combination of benefits for longer than 48 months.\u201d<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">That\u2019s because separate federal rules cap any government higher education payouts at 48 months, and prohibit using such benefits concurrently. Therefore, even if veterans qualify for both programs, they can only use them both in very limited circumstances.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">But in Rudisill\u2019s case, a majority of justices said that he should have been able to access about 10 months of Montgomery GI Bill benefits to attend Yale.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">In his dissent, Justice Clarence Thomas said Rudisill clearly forfeited his remaining Montgomery GI Bill support when he opted for the more generous Post-9\/11 GI Bill benefits, making his case moot.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 kEzXdV body-paragraph body-paragraph\">The full decision is available on the\u00a0<a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/22-888.html\" target=\"_blank\" rel=\"noopener\">Supreme Court\u2019s website<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court rules in favor of veteran who sued over GI Bill limits The Supreme Court\u00a0on Tuesday ruled in favor of a veteran who unsuccessfully tried to use both his\u00a0Post-9\/11 GI Bill and Montgomery GI Bill benefits, saying that Veterans Affairs officials erred in limiting his education support.
