{"id":102441,"date":"2024-06-14T17:27:51","date_gmt":"2024-06-14T22:27:51","guid":{"rendered":"https:\/\/milesfortis.com\/?p=102441"},"modified":"2024-06-14T17:27:51","modified_gmt":"2024-06-14T22:27:51","slug":"102441","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=102441","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.nationalreview.com\/corner\/sotomayors-mistake\/\" target=\"_blank\" rel=\"noopener\">Sotomayor\u2019s Mistake<\/a><\/p>\n<p>In her dissenting opinion in\u00a0<em>Cargill<\/em>, Justice Sotomayor offers a concession that she may come to regret down the road:<\/p>\n<blockquote><p><span style=\"font-size: 12pt; color: #000000;\"><strong>On October 1, 2017, a shooter opened fire from a hotel room overlooking an outdoor concert in Las Vegas, Nevada, in what would become the deadliest mass shooting in U. S. history. Within a matter of minutes, using several hundred rounds of ammunition, the shooter killed 58 people and wounded over 500. <span style=\"font-size: 14pt;\">He did so by affixing bump stocks to commonly available, semiautomatic rifles.<\/span><\/strong><\/span><\/p><\/blockquote>\n<p>One of the important Second Amendment questions that has not yet been considered\u00a0<a href=\"https:\/\/www.oyez.org\/cases\/2015\/14-10078\" target=\"_blank\" rel=\"noopener\" data-testid=\"standard-link\">at length<\/a> by the Supreme Court centers around which commercially available weapons ought to be counted within the provision\u2019s definition of \u201carms.\u201d The gun-control movement insists that modern sporting rifles such as the AR-15 are sufficiently exotic as to escape protection. Second Amendment advocates, by contrast, consider such a distinction to be arbitrary, reasoning that if semi-automatic handguns are protected, then there is no reason that semi-automatic rifles aren\u2019t, too.<\/p>\n<p>Since the\u00a0<em>Heller<\/em>\u00a0ruling in 2008, however, this debate has been focused more on whether AR-15s are\u00a0<em>mainstream<\/em>\u00a0than on whether they are functionally different than other guns. This is because, as Mark W. Smith\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3538052#:~:text=The%20Heller%20court%20established%20the,purposes%20like%20self%2Ddefense.%E2%80%9D\" target=\"_blank\" rel=\"noopener\" data-testid=\"standard-link\">explains<\/a>:<\/p>\n<blockquote><p><span style=\"font-size: 12pt; color: #000000;\"><strong>The Supreme Court\u2019s landmark decision in District of Columbia v. Heller established the \u201ccommon use\u201d test based on the text and original meaning of the Second Amendment and under the Supreme Court\u2019s traditional role of enforcing national, constitutional baselines against local outliers. <\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt; color: #000000;\"><strong>The Heller court established the \u201ccommon use\u201d test to decide how a court should determine whether particular objects, or arms, should be protected by the Second Amendment. Specifically, do the arms being legislated or regulated constitute arms in \u201c\u2018common use\u2019\u2026 for lawful purposes like self-defense.\u201d<\/strong><\/span><\/p><\/blockquote>\n<p>To get around this problem, those who wish to ban the AR-15 have taken to claiming that the rifle is not, in fact, \u201cin common use,\u201d and that, as a result, it is not protected under the Second Amendment. Remarkably, Justice Sotomayor just pulled the rug from underneath that argument \u2014 and, to make matters worse, did so in an official Supreme Court opinion\u00a0<em>on the subject of firearms law<\/em>. Look, again, at the language that Sotomayor uses to describe the AR-15:<\/p>\n<blockquote><p><span style=\"font-size: 12pt; color: #000000;\"><strong>He did so by affixing bump stocks to commonly available, semiautomatic rifles.<\/strong><\/span><\/p><\/blockquote>\n<p>Sotomayor even uses the word \u201ccommon\u201d! Not \u201ceveryday\u201d or \u201cuniversal\u201d or \u201cnormal\u201d or \u201cusual,\u201d but\u00a0<em>common<\/em>\u00a0\u2014 the very word that was used in\u00a0<em>Heller<\/em>.<\/p>\n<p>Naturally, I do not expect Sotomayor to remain consistent. If, in the course of a case delineating the meaning of \u201carms,\u201d she is asked to decide whether the AR-15 is in common use, she will undoubtedly insist that it is not.
