{"id":102827,"date":"2024-07-03T17:31:59","date_gmt":"2024-07-03T22:31:59","guid":{"rendered":"https:\/\/milesfortis.com\/?p=102827"},"modified":"2024-07-03T17:31:59","modified_gmt":"2024-07-03T22:31:59","slug":"102827","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=102827","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/thereload.com\/supreme-court-sidesteps-pending-gun-cases\/\" target=\"_blank\" rel=\"noopener\">Supreme Court Sidesteps Pending Gun Cases<\/a><\/p>\n<p>The Supreme Court has decided against providing further guidance on the Second Amendment\u2014at least for now.<\/p>\n<p><span data-preserver-spaces=\"true\">The High Court released its\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/070224zor_2co3.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">final orders list<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0for the term on Tuesday. It featured the Justices\u2019 decision to grant, vacate, and remand (GVR) seven cases dealing with laws prohibiting specific people from having guns back to the lower courts for new decisions. They also vacated and remanded a case dealing with New York\u2019s concealed carry restrictions and denied a request to review a collection of cases on Illinois\u2019 ban on the sale of AR-15s and other popular firearms.<\/span><\/p>\n<p>The orders list is the earliest indication of how active the Court plans to be on the Second Amendment moving forward. After a session that featured three gun-related cases\u2014but\u00a0<a href=\"https:\/\/thereload.com\/supreme-court-upholds-domestic-violence-restraining-order-gun-ban-in-8-1-vote\/\">just one<\/a>\u00a0Second Amendment case\u2014the Court\u2019s decision to kick the can on addressing a series of outstanding questions suggests a limited appetite among the Justices for further refinement of its\u00a0<em>Bruen<\/em>\u00a0test at this time.<\/p>\n<p>The Court left little concrete evidence of its thinking in deciding against taking up the pending gun cases. Only the petition denial for the six separate lawsuits challenging the state and municipal \u201cassault weapon\u201d and magazine bans in Illinois featured comments. Justice Samuel Alito noted that he would have voted to review the cases immediately. Meanwhile, Justice Clarence Thomas issued a statement urging the Court to take up the issue once it receives a case that has advanced through the entire appellate process.<\/p>\n<p>\u201cThis Court is rightly wary of taking cases in an interlocutory posture,\u201d he wrote. \u201cBut, I hope we will consider the important issues presented by these petitions after the cases reach final judgment. We have never squarely addressed what types of weapons are \u2018Arms\u2019 protected by the Second Amendment.\u201d<\/p>\n<p>The decision to hold off on reviewing the constitutionality of Illinois\u2019 hardware bans is likely to disappoint gun-rights advocates, who have long sought the High Court\u2019s opinion on bans on popular firearms like the AR-15. However, the Court\u2019s decision to sidestep the question of gun rights for felons and other prohibiting categories is also likely to frustrate the Biden administration.<\/p>\n<p><span data-preserver-spaces=\"true\">The Department of Justice (DOJ) had\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/thereload.com\/feds-ask-supreme-court-to-decide-if-weed-smokers-other-non-violent-felons-can-own-guns\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">previously asked the Court<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0to address whether the federal gun bans for drug users and felons were constitutional after two separate federal appeals courts struck them down as applied to particular defendants. In\u00a0<\/span><em><a class=\"editor-rtfLink\" href=\"https:\/\/thereload.com\/fifth-circuit-says-lifetime-gun-ban-for-marijuana-users-is-unconstitutional\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">United States v. Daniels<\/span><\/a><\/em><span data-preserver-spaces=\"true\">, the Fifth Circuit held the federal drug user gun ban unconstitutional as applied to a specific non-violent marijuana user. In\u00a0<em><a class=\"editor-rtfLink\" href=\"https:\/\/thereload.com\/federal-appeals-court-rules-second-amendment-protects-non-violent-felons-gun-rights\/\" target=\"_blank\" rel=\"noopener\">Garland v. Range,<\/a><\/em>\u00a0an en banc panel for the Third Circuit struck down the felon-in-possession ban as applied to a man with a 30-year-old conviction for lying to get food stamps.<\/span><\/p>\n<p>After the Supreme Court upheld the federal gun ban for people subject to domestic violence restraining orders in last month\u2019s\u00a0<em>U.S. v. Rahimi\u00a0<\/em>decision, the DOJ was unsatisfied with the guidance they offered. It\u00a0<a href=\"https:\/\/thereload.com\/doj-asks-supreme-court-to-resolve-question-of-gun-rights-for-felons\/\">again\u00a0urged the Court<\/a>\u00a0to issue a decision on whether it can legally disarm felons under the Second Amendment.<\/p>\n<p>\u201cAlthough this Court\u2019s decision in\u00a0<em>Rahimi<\/em>\u00a0corrects some of the methodological errors made by courts that have held Section 922(g)(1) invalid, it is unlikely to fully resolve the existing conflict,\u201d Solicitor General Elizabeth Prelogar wrote.<\/p>\n<p>\u201cThe substantial costs of prolonging uncertainty about the statute\u2019s constitutionality outweigh any benefits of further percolation,\u201d she added. \u201cUnder these circumstances, the better course would be to grant plenary review now.\u201d<\/p>\n<p>Instead, the Justices sent\u00a0<em>Range<\/em>,\u00a0<em>Daniels,<\/em>\u00a0and five other related cases back down to their respective circuit courts \u201cfor further consideration in light of\u00a0<em>United States v.
