{"id":103815,"date":"2024-08-22T11:58:23","date_gmt":"2024-08-22T16:58:23","guid":{"rendered":"https:\/\/milesfortis.com\/?p=103815"},"modified":"2024-08-22T11:58:23","modified_gmt":"2024-08-22T16:58:23","slug":"103815","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=103815","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/saf.org\/saf-scores-victory-in-california-non-resident-carry-case\/\" target=\"_blank\" rel=\"noopener\">SAF SCORES VICTORY IN CALIFORNIA NON-RESIDENT CARRY CASE<\/a><\/p>\n<p>BELLEVUE, WA \u2013 The Second Amendment Foundation (SAF) and its partners, in a challenge of California\u2019s ban on non-resident concealed carry, won a victory when a federal judge granted a\u00a0<a href=\"https:\/\/saf.org\/wp-content\/uploads\/2024\/08\/CRPA-v.-LASD-win.pdf\">preliminary injunction<\/a>\u00a0in the case.<\/p>\n<p>U.S. District Court Judge Sherilyn Peace Garnett, a 2022 Joe Biden appointee, granted in part and denied in part the plaintiffs\u2019 motion for preliminary injunction. The state has 21 days to file a response, and within 30 days plaintiffs must \u201cmeet and confer\u201d with the state and Los Angeles County Sheriff\u2019s Department \u201cto submit a proposed order entering the preliminary injunction consistent with the specific findings\u201d made by the court order.<\/p>\n<p>SAF is joined by the California Rifle &amp; Pistol Association, Gun Owners of America, Gun Owners Foundation, Gun Owners of California and seven private citizens. The LA County Sheriff\u2019s Office is the main defendant, along with Attorney General Rob Bonta and the La Verne Police Department.<\/p>\n<p><strong>In her decision, Judge Garnett observed, <em>\u201cthe State bears the burden of showing whether California\u2019s residency requirements for a CCW license is \u2018consistent with the Nation\u2019s historical tradition of firearm regulation.\u201d A few pages later,<\/em><\/strong> she notes,<strong><em> \u201cthe State has not carried its burden at this stage to show that the limitation of CCW licenses to California residents is part of a historical tradition of this Nation.\u201d<\/em><\/strong><\/p>\n<p>\u201cAmericans do not leave their Second Amendment right to bear arms at the California border,\u201d said SAF founder and Executive Vice President Alan M. Gottlieb. \u201cCalifornia is behind the curve in recognizing that the Second Amendment was incorporated to the states via the 14<sup>th<\/sup>\u00a0Amendment since SAF\u2019s Supreme Court victory in the 2010 McDonald ruling.\u201d<\/p>\n<p>\u201cThe writing is clearly on the wall,\u201d added SAF Executive Director Adam Kraut, \u201cwhen Judge Garnett noted the Court already found that we are likely to succeed on the merits of our argument that California\u2019s residency requirement for CCW applications is unconstitutional.
