{"id":103928,"date":"2024-08-28T14:17:23","date_gmt":"2024-08-28T19:17:23","guid":{"rendered":"https:\/\/milesfortis.com\/?p=103928"},"modified":"2024-08-28T14:18:11","modified_gmt":"2024-08-28T19:18:11","slug":"103928","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=103928","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.breitbart.com\/2nd-amendment\/2024\/08\/28\/massachusetts-supreme-court-switchblade-carry-ban-violates-second-amendment\/\" target=\"_blank\" rel=\"noopener\">Massachusetts Supreme Court: Switchblade Carry Ban Violates Second Amendment<\/a><\/p>\n<p class=\"subheading\">The Massachusetts Supreme Court ruled Tuesday the state\u2019s ban on carrying switchblade knives violates the Second Amendment.<\/p>\n<p class=\"a9d-pre\">The case is\u00a0<em><a class=\"x5l\" href=\"https:\/\/www.mass.gov\/files\/documents\/2024\/08\/27\/p13432.pdf\" target=\"_blank\" rel=\"noopener external\">Commonwealth v. David E. Canjura<\/a>.<\/em><\/p>\n<p class=\"a9d-pre\">Canjura was arrested on July 3, 2020, and a search of his person uncovered a knife \u201cwith a spring-assisted blade.\u201d He was charged with \u201ccarrying a dangerous weapon,\u201d among other charges, but challenged the constitutionality of the switchblade carry ban \u201cin a pretrial motion to dismiss.\u201d<\/p>\n<p class=\"a9d-pre\">He \u201cargued that because a switchblade is an \u2018arm,\u2019 [the] prohibition on carrying a switchblade violated his Second Amendment right to bear arms for self-defense.\u201d<\/p>\n<p class=\"a9d-pre\">The Massachusetts Supreme Court weighed Canjura\u2019s motion via the U.S. Supreme Court\u2019s\u00a0<em>Heller<\/em>\u00a0(2008) and\u00a0<em>Bruen<\/em> (2022) decisions, noting, \u201cThe central component\u2019 of the Second Amendment is the \u2018inherent right of self-defense,\u2019 which \u201cguarantee[s] to \u2018all Americans\u2019 the right to bear commonly used arms in public subject to certain reasonable, well-defined restrictions.\u201d<\/p>\n<p class=\"a9d-pre\">They observed, \u201cWhile both\u00a0<em>Heller<\/em>\u00a0and\u00a0<em>Bruen<\/em>\u00a0involved handguns, Second Amendment protections subsume more than just firearms.\u201d<\/p>\n<p>The Massachusetts Supreme Court then focused specifically on\u00a0<em>Bruen\u2019s \u201c<\/em>two part test<em>\u201d\u00a0<\/em>and found \u201cthe Commonwealth does not identify any laws regulating bladed weapons akin to folding pocketknives generally, or switchblades particularly, in place at the time of the founding or ratification of the Fourteenth Amendment.\u201d<\/p>\n<p>They subsequently observed that the Commonwealth \u201chas not met its burden of demonstrating a historical tradition justifying the regulation of switchblade knives\u2026\u201d<\/p>\n<p>The Massachusetts Supreme Court wrote: \u201cIn this case, we are asked to decide whether\u2026[the] prohibition against carrying a switchblade knife violates the Second Amendment to the United States Constitution, considering\u2026<em>Bruen<\/em>.\u00a0We conclude it does.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Massachusetts Supreme Court: Switchblade Carry Ban Violates Second Amendment The Massachusetts Supreme Court ruled Tuesday the state\u2019s ban on carrying switchblade knives violates the Second Amendment.
