Berkeley Professor Weighs in<\/a><\/p>\n<section class=\"post-body pf-candidate\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p id=\"isPasted\" class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Erwin Chemerinsky, Berkeley Law School dean and author of \u201cNo Democracy Lasts Forever: How the Constitution Threatens the United States,\u201d is not a fan of the United States Constitution, which obviously makes him an ideal academic to teach the next generation of lawyers how to practice law.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Via\u00a0<\/span><a href=\"https:\/\/www.latimes.com\/opinion\/story\/2024-08-23\/constitution-undemocratic-amendments-rewrite\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Los Angeles Times<\/span><\/a><span class=\"text-node\">\u00a0(emphasis added):<\/span><\/p>\n<div class=\"thm-piano-mop-premium pf-candidate\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">No matter the outcome of the November elections, it is urgent that there be a widespread recognition that American democracy is in danger and that reforms are essential<\/span><\/strong><span class=\"text-node\">. No form of government lasts forever, and it would be foolhardy to believe that the United States cannot fall prey to the forces that have ended democracies in many other countries.<\/span><\/em><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong class=\"\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Although the causes are complex, many of today\u2019s problems can be traced back to choices made in drafting the Constitution<\/span><\/em><\/strong><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">, choices that are increasingly haunting us. After 200 years,\u00a0<\/span><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">it is time to begin thinking of drafting a new Constitution to create a more effective, more democratic government<\/span><\/strong><span class=\"text-node\">.<\/span><\/em><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Signs abound that American democracy is in serious trouble.\u00a0<\/span><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Confidence in the institutions of American government is at an all-time low<\/span><\/strong><span class=\"text-node\">. The Pew Research Center has been tracking public trust in government since 1958. It has gone\u00a0<\/span><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">from a high-water mark of 77% in 1964 to our contemporary 20%<\/span><\/strong><span class=\"text-node\">.* A poll in September 2023 indicated that only 4% of U.S. adults said the American political system worked \u201cextremely or very well.\u201d A recent Gallup poll had only 16% of Americans expressing approval for how Congress is performing its job.<\/span><\/em><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Especially individuals in their 20s and 30s are losing faith in democracy.\u00a0<\/span><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">A Brookings Institution study found that 29% of \u201cyoung Americans say that democracy is not always preferable to other political forms<\/span><\/strong><span class=\"text-node\">.\u201d<\/span><\/em><\/span><\/p>\n<\/blockquote>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">*These people never ask fundamental questions like: why is trust in government at an all-time low? Nothing is different about this guy\u2019s analysis; he simply chalks it up to some vague failings of \u201cdemocracy\u201d without legitimizing the mistrust, which isn\u2019t fit to be printed in the self-anointed guardians of Democracy\u2122 like the Los Angeles Times.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">**Here I feel compelled to offer the obligatory but necessary caveat that we don\u2019t actually have a pure democracy. In generic terms, \u201cdemocracy\u201d means rule by the people. In practice, pure democracy is merely mob rule, which is not and has never been a foundation of Western civilization excepts for brief stints of upheaval like the French Revolution \u2014 and we saw how that story ended.<\/span><\/p>\n<p><iframe loading=\"lazy\" title=\"Isn't it time to start thinking of a new Constitution? Legal scholar says yes\" src=\"https:\/\/www.youtube.com\/embed\/uKvGq1500BU\" width=\"695\" height=\"391\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\nContinuing:<\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">There is an alternative to a spate of separate amendments: starting fresh by passing a new Constitution<\/span><\/strong><span class=\"text-node\">. It does not take much reflection to see the absurdity of using a document written for a small, poor and relatively inconsequential nation in the late 18th century to govern a large country of immense wealth in the technological world of the 21st century.<\/span><\/em><\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span style=\"font-size: 12pt; color: #000000;\"><strong class=\"\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">It may seem strange and frightening to suggest thinking of a new Constitution at a time of great partisan division<\/span><\/em><\/strong><em class=\"pf-delete\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">.
