The Republican-controlled committee voted 8-2 on Dec. 17 to temporarily repeal a long-standing Department of Natural Resources (DNR) rule that prohibited guns \u201cthat might be used for the purpose of fishing.\u201d The DNR has indicated it will permanently repeal the rule as part of a lawsuit settlement, mostly because it just stupid.<\/p>\n<h2 class=\"wp-block-heading\">Legal Challenge Spurs Change<\/h2>\n<p>The rule\u2019s repeal stems from a lawsuit filed by the conservative Wisconsin Institute for Law and Liberty on behalf of Sheboygan Falls resident Travis Kobs. The lawsuit argued the regulation was unconstitutional, effectively creating a blanket firearm ban on state waterways.<\/p>\n<p>DNR attorney Chandra Harvey explained to the committee that the rule, dating back to at least the 1950s, was originally designed to prevent the illegal shooting of fish. However, the passage of Wisconsin\u2019s concealed carry law in 2011 brought the rule into conflict with state statutes protecting the right to carry firearms.<\/p>\n<div class=\"td-a-rec td-a-rec-id-content_inline tdi_2_ac6 td_block_template_1\">\n<div id=\"wh_17415148_1\" class=\"ads_container\">\u201cThe regulation no longer aligns with current state law,\u201d Harvey told the committee.<\/div>\n<\/div>\n<h2 class=\"wp-block-heading\">Divided Opinions on Gun Access<\/h2>\n<p>The committee\u2019s decision was not without controversy. Democratic Senators Kelda Roys of Madison and Chris Larson of Milwaukee voted against the repeal, citing concerns over increased gun access, a seemingly blanket argument by Democrats on any committee.<\/p>\n<div id=\"thetr-839401036\" class=\"thetr-inline\">\n<div id=\"gpt-ad-9368036598708-0\" data-google-query-id=\"CM_1nP_A04oDFbdkCQkdArAycg\">\n<div id=\"google_ads_iframe_\/22097785553\/TTAG_Desktop_Inline_0__container__\">During the public hearing, Roys referenced a tragic school shooting in Madison that occurred earlier the same week, leaving three people dead, and which had nothing to do with concealed carry or fishing.<\/div>\n<\/div>\n<\/div>\n<p>\u201cI think there are still good reasons why we should not have more guns in more places, especially given recent events in my district,\u201d Roys said.<\/p>\n<p>Larson questioned whether the DNR had issued any citations under the rule. Harvey confirmed that no citations had been issued for carrying guns while fishing, prompting Republican Senator Steve Nass of Whitewater to remark, \u201cNobody\u2019s pulling their pistol out to shoot fish.
