{"id":106640,"date":"2025-01-07T14:18:34","date_gmt":"2025-01-07T20:18:34","guid":{"rendered":"https:\/\/milesfortis.com\/?p=106640"},"modified":"2025-01-07T14:18:34","modified_gmt":"2025-01-07T20:18:34","slug":"106640","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=106640","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.libertyparkpress.com\/scotus-distributes-2a-cases-for-friday-conference\/\" target=\"_blank\" rel=\"noopener\">SCOTUS Distributes 2A Cases for Friday Conference<\/a><\/p>\n<p>The U.S. Supreme Court has distributed a couple of important Second Amendment cases for conference this Friday, and all eyes will be watching to see whether oral arguments are scheduled as a result.<\/p>\n<p>According to\u00a0<a href=\"https:\/\/www.scotusblog.com\/2025\/01\/gun-rights-advocates-bring-twin-challenges-to-maryland-gun-control-law\/\">SCOTUSblog<\/a>, the cases of\u00a0<em><a href=\"https:\/\/www.saf.org\/snope-v-brown\/\">Snope v. Brown<\/a><\/em><em>\u00a0<\/em>and\u00a0<em><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-373\/327402\/20241002151533724_Petition.pdf\">Maryland Shall Issue v. Moore<\/a><\/em> both challenge Maryland\u2019s restrictive gun control laws.<\/p>\n<p><em>Snope<\/em>\u00a0is a case brought by the Second Amendment Foundation, Citizens Committee for the Right to Keep and Bear Arms, the Firearms Policy Coalition, and private citizen, David Snope. It challenges Maryland\u2019s ban on so-called \u201cassault weapons\u201d and this would be the third time the case has been brought to the high court for review.<\/p>\n<p>SAF, CCRKBA and FPC contend the ban is unconstitutional on the grounds that the Second Amendment makes no distinction between the types of \u201carms\u201d it protects. The modern semiautomatic rifle, epitomized by the AR-15 and its clones, is the most popular rifle in America. Millions are owned and used b y law-abiding citizens for hunting, competition, recreation, predator control and personal and home defense.<\/p>\n<p>According to a SAF news release Tuesday, \u201cSAF\u00a0<a href=\"https:\/\/saf.org\/wp-content\/uploads\/2024\/08\/Bianchi-Petition.pdf\">sought cert<\/a>\u00a0after the Fourth U.S. Circuit Court of Appeals ruled\u00a0<em>en banc\u00a0<\/em>that the modern semiautomatic rifles banned by Maryland fall outside the protection of the Second Amendment because they are too similar to military arms. SAF and its partners contend this reasoning \u201cis becoming a commonplace misapplication\u201d of Supreme Court precedents established by the 2008\u00a0<em>Heller<\/em>\u00a0ruling, 2010\u00a0<em>McDonald<\/em>\u00a0decision and 2022\u00a0<em>Bruen<\/em>\u00a0decision.<\/p>\n<p>\u201c<em>Snope<\/em>\u00a0provides the Supreme Court with an excellent vehicle to correct the widespread misapplication of the Court\u2019s precedent regarding these firearms and the Second Amendment, itself,\u201d said SAF Executive Director Adam Kraut. \u201cThe case is on appeal from final judgment with an\u00a0<em>en banc<\/em>\u00a0decision of a circuit court. Moreover, the specific type of firearm in question is commonly owned across the country, placing it well within the scope and protection of the Second Amendment. By granting cert in\u00a0<em>Snope<\/em>, the high court can help settle the matter once and for all.\u201d<\/p>\n<p><em>Moore<\/em>\u00a0challenges Maryland\u2019s licensing requirement to even own a gun. As noted by SCOTUSblog, \u201cMoreover, they contend that Justice Thomas\u2019s footnote in\u00a0<em>Bruen<\/em>\u00a0was limited to licenses to carry guns in public and does not apply to laws, like Maryland\u2019s, which require a license to own a gun at all. But in any event, the challengers argue that the state\u2019s requirements are \u201cabusive\u201d because they collectively impose an excessive delay: up to a month for a background check to obtain a license, up to a week for a second background check to purchase a gun, and additional time to complete a firearm-safety course.\u201d<\/p>\n<p>This case should have the attention of gun rights activists and anti-gunners in Oregon and Washington, where the effort is ongoing to require people to get a permit to purchase from the police prior to being able to buy a gun.<\/p>\n<p>If the Court grants certiorari in these cases, the outcome could have a devastating effect on gun control in the United States. Several states have banned so-called \u201cassault weapons,\u201d and a ruling that modern semi-autos are protected by the Second Amendment would almost certainly nullify those bans.<\/p>\n<p>Another case up for consideration is\u00a0<em><a href=\"https:\/\/www.saf.org\/gray-v-jennings\/\">Gray v. Jennings<\/a>,\u00a0<\/em>involving SAF, FPC and others, challenges a ban on so-called \u201cassault weapons\u201d and \u201clarge-capacity magazines\u201d in Delaware.
