Vance is right: the federal judge who blocked the Department of Government Efficiency (DOGE) from exposing wasteful spending by the Treasury Department violated the U.S. Constitution.<\/p>\n<p>On Saturday, Judge Paul Engelmayer sided with 19 pro-waste state attorneys general who filed a lawsuit against the President Trump-created, Elon Musk-led DOGE seeking to prevent scrutiny of how Treasury is spending taxpayer dollars.<\/p>\n<p>Judge Engelmayer issued a temporary injunction preventing DOGE and Treasury officials from examining Treasure expenditures \u2013 and declared that the Democrats have a strong case for a permanent ban.<\/p>\n<p>However, as Vice President\u00a0<a href=\"https:\/\/x.com\/JDVance\/status\/1888607143030391287\">Vance wrote<\/a>\u00a0on X.com (formerly Twitter), judges don\u2019t have the legal authority to dictate the actions of generals, prosecutors and the president:<\/p>\n<blockquote><p>\u201cIf a judge tried to tell a general how to conduct a military operation, that would be illegal.<\/p>\n<p>\u201cIf a judge tried to command the attorney general in how to use her discretion as a prosecutor, that&#8217;s also illegal.<\/p>\n<p>\u201cJudges aren&#8217;t allowed to control the executive&#8217;s legitimate power.\u201d<\/p><\/blockquote>\n<p>In his response, Yale Law\u00a0<a href=\"https:\/\/x.com\/Jed_Rubenfeld\">Prof. Jeb Rubenfeld\u00a0<\/a>agreed with Vance and explained how Judge Engelmayer\u00a0<a href=\"https:\/\/x.com\/Jed_Rubenfeld\/status\/1888999774407290952\">violated the Constitution<\/a>\u00a0with his ruling:<\/p>\n<blockquote><p>\u201cJD is correct about this, and his examples are exactly right.
