Impact of Trump \u2018Gender Ideology\u2019 Order on Firearm Transactions to Be Determined<\/a><\/p>\n

\u201cTrans star of hit HBO series says renewed passport now says male after Trump order,\u201d\u00a0Fox News reported in late February<\/a><\/em>. \u201cHunter Schafer, a transgender actor and star of the HBO series \u2018Euphoria,\u2019 revealed that her new passport was issued with a male gender marker because of an executive order signed by President Donald Trump.\u201d<\/p>\n

The Executive Order<\/a> Schafer referred to, \u201cDefending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,\u201d signed by Trump on Feb. 20, asserts:<\/p>\n

\u201cIt is the policy of the United States to recognize two sexes, male and female.\u201d<\/strong><\/span><\/p><\/blockquote>\n

OK, but this is\u00a0AmmoLand Shooting Sports News<\/em>, and while all peaceable human beings are encouraged here to recognize and claim their right to keep and bear arms, it\u2019s fair to wonder what any of this has to do with that. Trump\u2019s order offers a tangentially related clue:<\/p>\n

\n

\u201cAgencies shall remove all statements, policies, regulations, forms, communications, or other internal and external messages that promote or otherwise inculcate gender ideology, and shall cease issuing such statements, policies, regulations, forms, communications or other messages.\u201d<\/strong><\/span><\/h3>\n<\/blockquote>\n

Gun owners will recall that in 2020, the Bureau of Alcohol, Tobacco, Firearms and Explosive\u00a0revised the ATF Form 4473<\/a>\u00a0\u201cFirearm Transaction Record,\u201d required when purchasing a firearm from a federally licensed dealer. Among other changes, \u00a0ATF added a box under \u201cSex\u201d for prospective gun purchasers to check if they self-identify as \u201cnon-binary.\u201d<\/strong><\/p>\n

What this means is the Form 4473 will need to be revised again if ATF is to comply with the executive order. As\u00a0Orchid Advisors reported on\u00a0AmmoLand<\/em><\/a>\u00a0in 2019:<\/p>\n

\u201c[A] 60-day notice seeking public comment \u2026 is required in accordance with the Paperwork Reduction Act of 1995 (\u201cPRA\u201d). In essence, the PRA requires government agencies to seek approval every three years for continued use of forms utilized by government agencies and to seek public comment on the form or its new revision, if applicable.\u201d<\/strong><\/span><\/p><\/blockquote>\n

As far as form changes go, it\u2019s hardly a big one, although some on either side of the issue would argue the sociological implications actually\u00a0are<\/em>\u00a0a big deal. In 2019, the \u201clibertarian\u201d\u00a0CATO Institute took issue<\/a>\u00a0with \u201cATF\u2019s rigid and unreasoned stated policy\u201d of insisting on selecting \u201cmale\u201d or \u201cfemale\u201d for transfers before the \u201cnon-binary\u201d option was added in. They presumably will make the same arguments if it\u2019s revised back out.<\/p>\n

As long as \u201cgun rights advocates\u201d are picking things to get upset about, I\u2019d suggest that\u2019s a bit of a red herring argument, and the true outrage ought to be reserved for a prior restraint that presumes a delegated federal override of \u201cshall not be infringed.\u201d Imagine explaining the 4473 to Tench Coxe or Samuel Adams, and what their reaction would be if you told them that before the national government would allow them to own a gun, they\u2019d have to \u2013 among other things and under penalty of perjury \u2013 disclose who they were, where they lived, what they were buying, and what was or is now between their legs.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"
