Brown<\/em><\/a>\u2014the Maryland \u201cassault weapons\u201d ban challenge\u2014<em><strong data-start=\"331\" data-end=\"344\">13 times.<\/strong>\u00a0<\/em>That\u2019s not just some bureaucratic delay. It\u2019s a signal. It means the nine justices are circling this case, taking it seriously, and possibly gearing up to act.<\/p>\n<p class=\"\">In fact, as Mark Smith of the\u00a0<em>Four Boxes Diner<\/em>\u00a0points out, the\u00a0<em>Dobbs<\/em>\u00a0case that overturned\u00a0<em>Roe v. Wade<\/em>\u00a0was relisted\u00a0<strong>12 times<\/strong>\u00a0before the Court granted review.\u00a0<em>Snope<\/em>\u00a0just passed that.<\/p>\n<p><strong>For pro-gun Americans who\u2019ve had enough of being treated like second-class citizens when it comes to constitutional rights, this might be the moment we\u2019ve been waiting for.<\/strong><\/p>\n<blockquote>\n<p class=\"\"><span style=\"font-size: 12pt; color: #000000;\"><strong>\u201cThis is not a trivial matter. It strikes at the heart of the Second Amendment\u2019s protections.\u201d\u00a0\u2014\u00a0<em>Roger Katz,\u00a0<\/em><\/strong><em><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ammoland.com\/2025\/02\/will-the-supreme-court-finally-defend-the-2nd-amendment-the-fate-of-snope-antonyuk-hangs-in-the-balance\/\" rel=\"\" data-uri=\"ee052fa0dd817c3834673216725819b8\">AmmoLand News.<\/a><\/span><\/em><\/span><\/p>\n<\/blockquote>\n<p class=\"\">Katz is right. The question before the Court is simple but profound:<\/p>\n<p><strong>Can a state ban semiautomatic rifles that are in common use for lawful purposes\u2014like the AR-15, America\u2019s most popular rifle?<\/strong><\/p>\n<p class=\"\">Under\u00a0<em>Heller<\/em>,\u00a0<em>McDonald<\/em>, and\u00a0<em>Bruen<\/em>, the answer should be\u00a0<strong>no<\/strong>. But gun control states like Maryland [NJ, NY, CT, IL, et al] think they\u2019ve found a loophole, labeling AR-15s \u201cassault weapons\u201d and pretending that changes the Constitution.<\/p>\n<p class=\"\">Let\u2019s be clear:<\/p>\n<ul>\n<li>Americans\u00a0<strong>commonly own<\/strong>\u00a0AR-15s in the multiple millions.<\/li>\n<li>They\u2019re used for\u00a0<strong>self-defense<\/strong>,\u00a0<strong>sport shooting<\/strong>, and\u00a0<strong>home protection<\/strong>.<\/li>\n<li>They are not\u00a0<strong>unusual<\/strong>,\u00a0<strong>high-powered<\/strong>, or\u00a0<strong>reserved for war<\/strong>\u2014they\u2019re the modern-day musket.<\/li>\n<\/ul>\n<p class=\"\">The\u00a0<em>Snope<\/em>\u00a0case is a perfect test. It\u2019s clean, it\u2019s direct, and it gives the Court the chance to finally say:\u00a0<strong>The Second Amendment applies to rifles like the AR-15. Period.<\/strong><\/p>\n<p class=\"\">Mark Smith explains that strategic justices sometimes\u00a0<strong>wait<\/strong>\u00a0to grant review until they\u2019re confident they have five solid votes\u2014<em>not just four<\/em>\u2014to win the case outright. That might be what\u2019s happening now. Thirteen relists mean they\u2019re either preparing to drop a bombshell decision or writing a dissent if the case gets wrongly denied.<\/p>\n<p class=\"\">And as Roger Katz warns in his AmmoLand News piece, if SCOTUS refuses to take\u00a0<em>Snope<\/em>, or worse, lets the ban stand, it would \u201cdamage Second Amendment jurisprudence\u2026profound and lasting.\u201d<\/p>\n<p class=\"\">The math doesn\u2019t lie. According to\u00a0<em>SCOTUSblog<\/em>, cases relisted 5+ times have nearly\u00a0<strong>a 40% chance<\/strong>\u00a0of being granted, especially if the Court plans a\u00a0<strong>summary reversal<\/strong>\u2014a quick smackdown without oral argument, like in\u00a0<em>Caetano<\/em>.<\/p>\n<p class=\"\">So what should we be watching for?<\/p>\n<ul>\n<li><strong>Grant of cert<\/strong>: The best-case scenario. Oral arguments and a full ruling.<\/li>\n<li><strong>Summary reversal<\/strong>: Also good. A fast correction directing lower courts to follow\u00a0<em>Heller<\/em>\u00a0and\u00a0<em>Bruen<\/em>.<\/li>\n<li><strong>Denial<\/strong>: A disaster for gun rights, letting anti-gun states keep rewriting the Second Amendment.<\/li>\n<\/ul>\n<p class=\"\">But as Mark Smith says:<\/p>\n<blockquote>\n<p class=\"\"><span style=\"font-size: 12pt;\"><strong>\u201cEvery day the Snope case is still alive at SCOTUS is a good day.\u201d<\/strong><\/span><\/p>\n<\/blockquote>\n<p class=\"\">Let\u2019s hope the Court finally backs the Constitution with action\u2014not just words. And if they do,\u00a0<em>Snope<\/em>\u00a0could be the next\u00a0<em>Heller<\/em>.
