The Second Amendment is not a second-class right, and under my watch, the Department will actively enforce the Second Amendment just like it actively enforces other fundamental constitutional rights.\u201d<\/strong><\/span><\/p><\/blockquote>\n<h3>Points brought to the DOJ\u2019s attention in the FOID complaint:<\/h3>\n<ul>\n<li>The reason for the law was to dissuade minorities (specifically African Americans during a time of racial riots\/unrest and distrust amongst racial groups and law enforcement) from seeking police permission to legally own firearms.<\/li>\n<li>Funding for FOID cards and carry licenses is used now as a \u201cpiggy bank\u201d by the IL General Assembly to fund other projects, leading to delays in processing (with a documented case of a 20-month wait).<\/li>\n<li>A woman with no criminal record was charged with a crime for possessing a single-shot rifle in her home without a FOID.<\/li>\n<\/ul>\n<blockquote><p><span style=\"font-size: 12pt; color: #000000;\"><strong>\u201cATF is a law enforcement agency within the DOJ dedicated to reducing violent crime and protecting the public. ATF\u2019s mission focuses on administering Federal criminal laws and regulating the firearms and explosives industries,\u201d\u00a0Buge\u2019s response continued.\u00a0\u201cIn support of this mission, ATF implements policy and regulations to enforce laws created by Congress. As such, we encourage you to reach out to your State congressional delegation with your recommendations regarding firearm laws. We hope this information proves helpful to you.\u201d<\/strong><\/span><\/p><\/blockquote>\n<h4>Right. In Illinois. How helpful.<\/h4>\n<p><strong>Translation: ATF only deals with federal issues, and your state complaint is outside of its jurisdiction, so DOJ forwarding it to them can\u2019t go anywhere. If you want relief, contact your state representatives, the Democrat ones who are passing citizen disarmament edicts, and ask them not to. We\u2019re washing our hands of it.<\/strong><\/p>\n<p><!--more--><\/p>\n<p>It\u2019s not unfair to note that as far as priorities go, the response, and thus official policy, was entrusted to not a director, not a deputy director, and not even an assistant deputy director, but to an\u00a0<em>acting\u00a0<\/em>assistant deputy director. How many levels of bureaucracy are there? I\u2019ll stipulate it probably\u00a0<em>is<\/em>\u00a0unfair to follow that up by wondering who makes the coffee.<\/p>\n<p><strong>But it\u2019s all a far cry from Pam Bondi\u2019s fine words about \u201cstates and localities\u201d (and from President\u00a0<a href=\"https:\/\/www.ammoland.com\/2025\/02\/trump-order-on-second-amendment-raises-hopes-and-questions\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"d1969a6f35e57f499dd38aa938af8397\">Donald Trump\u2019s fine words about the Second Amendment<\/a>), and once again raises the question \u201c<a href=\"https:\/\/www.ammoland.com\/2025\/04\/whos-minding-the-store-doj-siding-with-letitia-james-against-gun-companies\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"3cde1e6a618f97b2ccea381daa5eb90e\">Who\u2019s minding the store?<\/a>\u201d<\/strong><\/p>\n<p><strong>That\u2019s especially concerning in light of\u00a0<a href=\"https:\/\/www.justice.gov\/d9\/2025-04\/ag-bondi-memo-second-amendment-enforcement-task-force.pdf\" target=\"_blank\" rel=\"noopener\" data-uri=\"f0d2e35e8c8d782470fcb3152a2a3368\">Bondi\u2019s April 8 memo<\/a>\u00a0to all hands declaring, \u201cIt is the policy of this Department of Justice to use its full might to protect the Second Amendment rights of law-abiding citizens.\u201d<\/strong><\/p>\n<p>To that end, gun owners have been promised a Second Amendment Task Force, and been led to expect great things from the appointment of John Sauer as Solicitor General, Harmeet Dhillon as head of the Office of Civil Rights, and a general housecleaning over at ATF to include a focus on violent criminals to be kept on track by \u201c<a href=\"https:\/\/www.thetruthaboutguns.com\/robert-leider-named-atf-assistant-director-and-chief-counsel\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"9fba4e561688c0355dbbf912757ec22d\">staunch supporter of the Second Amendment<\/a>\u201d General Counsel Robert Leider.<\/p>\n<p><strong>Instead, we see\u00a0<a href=\"https:\/\/www.firearmsnews.com\/editorial\/atf-doj-abuse-bipolar-guns\/521074\" target=\"_blank\" rel=\"noopener\" data-uri=\"d8b102e73d11d1bc2ddcd70583a8c101\">bipolar mood swings on guns<\/a>, and DOJ \u201cusing its full might\u201d to argue that\u00a0<a href=\"https:\/\/www.ammoland.com\/2025\/05\/doj-says-machineguns-not-protected-by-2nd-amendment-and-silence-of-gun-groups-is-deafening\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"5e627cdc2a55367e5e4938955c734198\">machineguns are not protected by the Second Amendment<\/a>, which essentially nullifies what the Founders intended. If machine guns aren\u2019t protected, the Second Amendment is a dead letter and anyone who maintains otherwise is a fraud.<\/strong><\/p>\n<p>While\u00a0<a href=\"https:\/\/www.firearmspolicy.org\/fpc-statement-on-horrifically-flawed-doj-brief-in-machine-gun-ban-prosecution\" target=\"_blank\" rel=\"noopener\" data-uri=\"90ceca68663068dad3267ead0f66fcd1\">Firearms Policy Coalition responded<\/a>\u00a0that what is needed is a \u201cSecond Amendment Czar,\u201d\u00a0 with all due respect, any appointee will still be feeding from the same hand. This correspondent has been practically alone with the recommendation that surprises and disappointment will continue to happen as long as the\u00a0<a href=\"https:\/\/www.ammoland.com\/2025\/04\/task-forces-exclusion-of-gun-owner-advocates-means-continuing-doj-disappointments\/\" target=\"_blank\" rel=\"noopener\" data-uri=\"18ff4c8d33e2d345c007c1a325a2ad80\">DOJ Task Force excludes independent gun owner advocate representation<\/a>.<\/p>\n<p>If our \u201cBeautiful Second Amendment\u201d president can appoint an advisory council for Homeland Security including, among others, \u201cconservative media star\u201d\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/trump-announces-conservative-media-star-gop-governor-others-homeland-security-advisory-council\" target=\"_blank\" rel=\"noopener\" data-uri=\"0820c19a68c1fcee08a50ca23a153fcf\">Mark Levin<\/a>, what\u2019s the hangup on including independent Second Amendment scholars, lawyers, advocacy group leaders, and subject matter\/technical experts to advise on rules, legislation, and legal arguments before DOJ says something wrong and offensive, and makes gun voters feel like they\u2019re being used?<\/p>\n<p><strong>Like the line goes, Madam Attorney General, Mr. President, help us help you. Either that or stop telling us how deeply and sincerely you care.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Really?
