{"id":110081,"date":"2025-05-17T12:40:45","date_gmt":"2025-05-17T17:40:45","guid":{"rendered":"https:\/\/milesfortis.com\/?p=110081"},"modified":"2025-05-17T12:40:45","modified_gmt":"2025-05-17T17:40:45","slug":"110081","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=110081","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.justice.gov\/opa\/pr\/department-justice-announces-settlement-litigation-between-federal-government-and-rare-breed\" target=\"_blank\" rel=\"noopener\">Department of Justice Announces Settlement of Litigation Between the Federal Government and Rare Breed Triggers<\/a><\/p>\n<div class=\"node-body\">\n<div>\n<div class=\"field-formatter--text-default field-text-format--wysiwyg text-formatted field_body\">\n<p>oday, in accordance with President Trump\u2019s Executive Order\u00a0<em>Protecting Second Amendment Rights<\/em>, as well as the Attorney General\u2019s Second Amendment Enforcement Task Force, the Department of Justice announced the settlement of litigation between the federal government and Rare Breed Triggers.<\/p>\n<p>\u201cThis Department of Justice believes that the 2nd Amendment is not a second-class right,\u201d said Attorney General Pamela Bondi. \u201cAnd we are glad to end a needless cycle of litigation with a settlement that will enhance public safety.\u201d<\/p>\n<p><strong>In June 2024, in\u00a0<em>Cargill v. Garland<\/em>, the Supreme Court held that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) exceeded its statutory authority by issuing a rule classifying a bump stock as a \u201cmachinegun.\u201d\u00a0In July 2024, the Northern District of Texas applied\u00a0<em>Cargill v. Garland\u00a0<\/em>to a device called a \u201cforced-reset trigger\u201d (FRT) and concluded that FRTs also cannot be classified as a \u201cmachinegun.\u201d<\/strong><\/p>\n<p>The Department\u2019s agreement with Rare Breed Triggers avoids the need for continued appeals in\u00a0<em>United States v. Rare Breed Triggers<\/em>\u00a0and continued litigation in other, related cases concerning the same issue. The settlement includes agreed-upon conditions that significantly advance public safety with respect to FRTs, including that Rare Breed will not develop or design FRTs for use in any pistol and will enforce its patents to prevent infringement that could threaten public safety. Rare Breed also agrees to promote the safe and responsible use of its products.<\/p>\n<p>The cases that will be resolved under the settlement agreement are:<\/p>\n<ul>\n<li><em>NAGR v. Garland<\/em>, 23-cv-830-O (N.D. Tex.), on appeal 24-10707 (5th Cir.).<\/li>\n<li><em>United States v. Rare Breed Triggers LLC<\/em>, No. 23-cv-369 (E.D.N.Y), on appeal 23-7276 (2d Cir.).<\/li>\n<li><em>United States v. Miscellaneous Firearms and Related Parts and Equipment Listed in Exhibit A,\u00a0<\/em>23-cv-17 (D.
