{"id":111263,"date":"2025-07-19T10:51:13","date_gmt":"2025-07-19T15:51:13","guid":{"rendered":"https:\/\/milesfortis.com\/?p=111263"},"modified":"2025-07-19T10:51:13","modified_gmt":"2025-07-19T15:51:13","slug":"111263","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=111263","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/07\/19\/trump-supreme-court-gun-regulations\/85243201007\/\" target=\"_blank\" rel=\"noopener\">Trump DOJ wants Supreme Court to bring down hammer on gun rules<\/a><\/p>\n<div class=\"gnt_ar_b\">\n<p class=\"gnt_ar_b_p\">WASHINGTON \u2212 After the\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" data-t-l=\":b|e|k|\u2691u\">Supreme Court<\/a>\u00a0in 2022 made it\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/06\/23\/supreme-courts-gun-rights-decision-explained\/7711453001\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/06\/23\/supreme-courts-gun-rights-decision-explained\/7711453001\/\" data-t-l=\":b|e|k|\u2691u\">harder to restrict<\/a>\u00a0who can arm themselves in public, some states took a different approach.<\/p>\n<p class=\"gnt_ar_b_p\">Five Democrat-led, mostly densely populous states passed laws that prohibit bringing a handgun onto someone else\u2019s property without that person\u2019s express consent.<\/p>\n<p class=\"gnt_ar_b_p\">Now the Trump administration wants the\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" target=\"_blank\" rel=\"noopener\" data-autotag=\"a173914f-749b-454a-81ed-e37783d9c6f6\" data-t-l=\":b|e|k|\u2691u\">Supreme Court<\/a>\u00a0to declare that such rules in Hawaii, California, New York, Maryland and New Jersey violate the Constitution.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cThe United States has a substantial interest in the preservation of the right to keep and bear arms and in the proper interpretation of the Second Amendment,\u201d Solicitor General John Sauer\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1046\/357921\/20250501150148754_24-1046-Cert-Amicus-US.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1046\/357921\/20250501150148754_24-1046-Cert-Amicus-US.pdf\" data-t-l=\":b|z|k|\u2691u\">wrote<\/a>\u00a0in explaining why the Department of Justice wants the high court to weigh in.<\/p>\n<p class=\"gnt_ar_b_p\">That\u2019s not the only example of how the change in administrations is affecting litigation over gun regulations.<\/p>\n<\/div>\n<p><!--more--><\/p>\n<div class=\"gnt_ar_b\">\n<aside class=\"gnt_x__c gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-news-politics-4-ac1\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"llx\"><span style=\"font-size: 28px; font-weight: 900;\">Justice Department stopped defending federal handgun rule<\/span><\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">In a move alarming to groups working to prevent gun violence, the DOJ declined to continue to defend a federal law setting 21 as the minimum age to own a handgun after an appeals court ruled the restriction unconstitutional.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cFor the government to step back and say, `Hey, here\u2019s a major piece of federal firearms legislation that was passed by Congress; we\u2019re just not going to bother to defend it any longer,\u2019 that\u2019s a really, really significant thing,\u201d said Esther Sanchez-Gomez, litigation director for the Giffords Law Center.<\/p>\n<aside class=\"gnt_x__c gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-news-politics-5-ac2\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"llx\" data-x-c=\"2\">The DOJ has also <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-796\/362807\/20250610170630641_24-796opp.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-796\/362807\/20250610170630641_24-796opp.pdf\" data-t-l=\":b|z|k|\u2691u\">told the Supreme Court<\/a>\u00a0that the federal government no longer opposes all aspects of a Missouri law \u2013\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.stlpr.org\/2023-03-07\/missouri-banned-police-from-enforcing-federal-gun-laws-a-judge-ruled-thats-unconstitutional\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.stlpr.org\/2023-03-07\/missouri-banned-police-from-enforcing-federal-gun-laws-a-judge-ruled-thats-unconstitutional\" data-t-l=\":b|z|k|\u2691u\">blocked by lower courts<\/a>\u00a0after the Biden administration and others challenged it \u2013 that would penalize state police for enforcing federal gun control laws.<\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">\u201cThis is the first time we\u2019ve seen a Justice Department really actively fight for the Second Amendment rights of all Americans,&#8221; said Hannah Hill, vice president of the National Foundation for Gun Rights.<\/p>\n<p class=\"gnt_ar_b_p\">Hill said it&#8217;s taken the administration longer than she&#8217;d hoped to take a stand and her group is eager for President\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" data-autotag=\"26f031d1-9924-4f10-b4e6-019d076113d5\" data-t-l=\":b|e|k|\u2691u\">Donald Trump<\/a>\u00a0to repeal federal regulations \u2212 including rules on untraceable &#8220;ghost guns&#8221; that the Supreme Court\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/03\/26\/supreme-court-biden-regulations-ghost-guns\/76430782007\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/03\/26\/supreme-court-biden-regulations-ghost-guns\/76430782007\/\" data-t-l=\":b|e|k|\u2691u\">upheld<\/a>\u00a0in March.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;But you&#8217;re seeing a slow pivot of a massive ship back toward the Constitution,&#8221; she said. &#8220;And I&#8217;m extremely encouraged by the trajectory.&#8221;<\/p>\n<h2 class=\"gnt_ar_b_h2\">Trump: `No one will lay a finger on your firearms&#8217;<\/h2>\n<p class=\"gnt_ar_b_p\">During a 2024 campaign stop to address thousands of members of the National Rifle Association in Pennsylvania, Trump\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.c-span.org\/program\/campaign-2024\/donald-trump-speaks-at-national-rifle-association-gathering\/638311\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.c-span.org\/program\/campaign-2024\/donald-trump-speaks-at-national-rifle-association-gathering\/638311\" data-t-l=\":b|z|k|\u2691u\">promised<\/a>\u00a0that \u201cno one will lay a finger on your firearms\u201d if voters put him back in the White House.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;Your Second Amendment will always be safe with me as your president,&#8221;\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2024\/02\/09\/trump-nra-biden-memory-south-carolina\/72538612007\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2024\/02\/09\/trump-nra-biden-memory-south-carolina\/72538612007\/\" data-t-l=\":b|e|k|\u2691u\">Trump said<\/a>.<\/p>\n<figure class=\"gnt_em gnt_em_img\">\n<div class=\"gnt_em_img_ccw gnt_em_img_ccw__cap gnt_em_img_ccw__crd\" data-c-caption=\"During his 2024 campaign for president, Donald Trump speaks at the annual National Rifle Association meetingi n Dallas, Texas, on May 18, 2024.\" data-c-credit=\"Carlos Barria, REUTERS\">Soon after taking office, Trump signed an <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/protecting-second-amendment-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/protecting-second-amendment-rights\/\" data-t-l=\":b|z|k|\u2691u\">executive order<\/a>\u00a0directing a review of Biden-era firearm policies and of the positions the government has taken in gun-related litigation.<\/div>\n<\/figure>\n<p class=\"gnt_ar_b_p\">Legal challenges to firearm rules\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.thetrace.org\/2025\/06\/gun-rights-lawsuits-decline-bruen-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.thetrace.org\/2025\/06\/gun-rights-lawsuits-decline-bruen-trump\/\" data-t-l=\":b|z|k|\u2691u\">spiked<\/a>\u00a0after the court created a new test for gun laws in its 2022 decision striking down a New York law that\u00a0required\u00a0state\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2021\/11\/03\/public-carry-supreme-court-hints-opposition-new-york-gun-law\/6250165001\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-t-l=\":b|e|k|\u2691u\">residents\u00a0to have\u00a0&#8220;proper cause&#8221; to carry a handgun<\/a>.<\/p>\n<p class=\"gnt_ar_b_p\">The court said gun rules must be similar to a historical regulation on weapons to pass constitutional muster.<\/p>\n<h2 class=\"gnt_ar_b_h2\">Lower courts divided over age restriction on handguns<\/h2>\n<p class=\"gnt_ar_b_p\">As the administration was changing hands in January, the New Orleans-based\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2024\/07\/25\/supreme-court-reins-in-right-wing-appeals-court\/74379438007\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2024\/07\/25\/supreme-court-reins-in-right-wing-appeals-court\/74379438007\/\" data-t-l=\":b|e|k|\u2691u\">5<sup>th<\/sup>\u00a0U.S. Circuit Court of Appeals<\/a>\u00a0said a decades-old federal law banning handgun purchases by 18- to 20-year-olds fails that test.<\/p>\n<aside class=\"gnt_x__c gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-news-politics-7-ac4\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"llx\" data-x-c=\"4\"><\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">&#8220;The history of firearm use, particularly in connection with militia service, contradicts the premise that eighteen-to-twenty-year-olds are not covered by the plain text of the Second Amendment,&#8221; U.S. Circuit Judge Edith Jones\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-30033-CV0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-30033-CV0.pdf\" data-t-l=\":b|z|k|\u2691u\">wrote for the court.<\/a><\/p>\n<p class=\"gnt_ar_b_p\">In July, the DOJ told a lower court that the government is not going to appeal that decision to the Supreme Court.<\/p>\n<p class=\"gnt_ar_b_p\">But the high court may still take up the issue.<\/p>\n<aside class=\"gnt_ar_b_sp\">More:\u00a0<a class=\"gnt_ar_b_sp_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/06\/05\/supreme-court-mexico-gunmakers-cartel-violence\/82274404007\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-t-l=\":b|e|spike click:31|\u2691u\">Supreme Court rules Mexico can&#8217;t sue US gunmakers over cartel violence<\/a><\/aside>\n<p class=\"gnt_ar_b_p\">In June, the Richmond-based 4<sup>th<\/sup>\u00a0U.S. Circuit Court of Appeals reached the opposite conclusion as the 5<sup>th<\/sup>\u00a0Circuit, ruling against a similar challenge.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;From English common law to America&#8217;s founding and beyond, our regulatory tradition has permitted restrictions on the sale of firearms to individuals under the age of 21,&#8221; U.S. Circuit Judge J. Harvie Wilkinson III\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.ca4.uscourts.gov\/opinions\/232085.P.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.ca4.uscourts.gov\/opinions\/232085.P.pdf\" data-t-l=\":b|z|k|\u2691u\">wrote for the court<\/a>.<\/p>\n<aside class=\"gnt_x__c gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-news-politics-8-ac5\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"llx\" data-x-c=\"5\"><\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">The four 18- to 20-year-olds challenging the age restriction have\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/25-24.html\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/25-24.html\" data-t-l=\":b|z|k|\u2691u\">appealed<\/a>\u00a0that decision to the Supreme Court.<\/p>\n<p class=\"gnt_ar_b_p\">The DOJ has not yet filed its response.<\/p>\n<h2 class=\"gnt_ar_b_h2\">Debate over the right to carry a gun in public<\/h2>\n<p class=\"gnt_ar_b_p\">In its brief supporting a challenge to Hawaii\u2019s law prohibiting the carrying of handguns onto someone else\u2019s property without their consent, the government said that the rule \u201ceffectively nullifies\u201d the general right to carry a gun in public that the court upheld in 2022.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cSomeone carrying a firearm for self-defense cannot run errands without fear of criminal sanctions,\u201d Sauer told the court.<\/p>\n<p class=\"gnt_ar_b_p\">Sanchez-Gomez, the litigation director for the Giffords Law Center, said property owners have always had the ability to restrict weapons. But Hawaii\u2019s law makes the default that handguns aren\u2019t allowed unless there\u2019s express permission, rather than that they are allowed unless they\u2019re expressly prohibited.<\/p>\n<p class=\"gnt_ar_b_p\">When the court limited states&#8217; control over who could publicly carry guns, she said, the focus turned to where in public they could bring them.<\/p>\n<figure class=\"gnt_em gnt_em_img\">\n<div class=\"gnt_em_img_ccw gnt_em_img_ccw__cap gnt_em_img_ccw__crd\" data-c-caption=\"During his 2024 campaign for president, Donald Trump speaks at the annual National Rifle Association meetingi n Dallas, Texas, on May 18, 2024.\" data-c-credit=\"Carlos Barria, REUTERS\">Alex McCourt, an assistant professor with the Johns Hopkins Center for Gun Violence Solutions, said the Supreme Court could take up the case not so much because the Trump administration wants them to but because one appeals court upheld Hawaii\u2019s rule while a different appeals court rejected New York\u2019s.<\/div>\n<\/figure>\n<aside class=\"gnt_x__c gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-news-politics-9-ac6\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"llx\" data-x-c=\"6\" data-google-query-id=\"COOz57iiyY4DFcOWywEdhdcPQA\">\n<div id=\"google_ads_iframe_\/7103\/usatoday\/native-article_link\/news\/politics_6__container__\"><\/div>\n<\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">\u201cThe fact that we have these differing opinions across the country probably weighs even heavier in the Supreme Court\u2019s mind,&#8221; font-weight: 900;\">Justice Department backs challenge to bans on AR-15s<\/span><\/div>\n<\/figure>\n<p class=\"gnt_ar_b_p\">In June, the justices\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/06\/02\/supreme-court-assault-weapons-high-capacity-magazine-bans\/82879343007\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/06\/02\/supreme-court-assault-weapons-high-capacity-magazine-bans\/82879343007\/\" data-t-l=\":b|e|k|\u2691u\">declined<\/a>\u00a0to hear a challenge to Maryland\u2019s ban on assault-style weapons, although Justice Brett Kavanaugh said he expects his colleagues \u201cwill address the AR-15 issue soon, in the next term or two.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">Days later, the Justice Department urged the Chicago-based 7<sup>th<\/sup>\u00a0U.S. Circuit Court of Appeals to strike down a similar law in Illinois.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cBecause the Act is a total ban on a category of firearms that are in common use by law-abiding citizens for lawful reasons, it is flatly unconstitutional,\u201d lawyers for the DOJ wrote in a\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.documentcloud.org\/documents\/25982595-24-3060-united-states-amicus-brief\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.documentcloud.org\/documents\/25982595-24-3060-united-states-amicus-brief\/\" data-t-l=\":b|z|k|\u2691u\">legal brief<\/a>\u00a0supporting the challenge.<\/p>\n<aside class=\"gnt_x__c gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-news-politics-10-ac7\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"llx\" data-x-c=\"7\" data-google-query-id=\"CNj9rruiyY4DFeiVywEdA9w2JA\">\n<div id=\"google_ads_iframe_\/7103\/usatoday\/native-article_link\/news\/politics_7__container__\">The Firearms Policy Coalition, one of the groups fighting Illinois\u2019 law, called the DOJ\u2019s filing a critical step toward Trump fulfilling his promise to defend the Second Amendment.<\/div>\n<\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">\u201cWe hope Solicitor General Sauer will stand with us on this issue at the Supreme Court,\u201d coalition president Brandon Combs said in a\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.firearmspolicy.org\/fpc-lauds-us-doj-support-in-lawsuit-challenging-illinois-pica-ban-on-assault-weapons-magazines\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"link\" data-id=\"https:\/\/www.firearmspolicy.org\/fpc-lauds-us-doj-support-in-lawsuit-challenging-illinois-pica-ban-on-assault-weapons-magazines\" data-t-l=\":b|z|k|\u2691u\">statement<\/a>, \u201cwhen this case inevitably heads up.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Trump DOJ wants Supreme Court to bring down hammer on gun rules WASHINGTON \u2212 After the\u00a0Supreme Court\u00a0in 2022 made it\u00a0harder to restrict\u00a0who can arm themselves in public, some states took a different approach.
