Rogue DOJ Lawyers Rebel Against Trump, Still Fighting GOA in Court Over Biden\u2019s Gun Control<\/a><\/p>\n

Washington, D.C. \u2013<\/strong>\u00a0Rogue lawyers inside the Department of Justice (DOJ) are actively resisting the Trump administration\u2019s pro-Second Amendment agenda, continuing to fight against Gun Owners of America (GOA) and Gun Owners Foundation (GOF) in federal court over Biden-era gun control policies.<\/p>\n

A Policy Repealed\u2014But Not Forgotten<\/h3>\n

The controversy centers on the\u00a0Biden administration\u2019s \u201czero tolerance\u201d policy<\/a>, a rule that allowed the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to strip federal firearms licenses from dealers for minor paperwork errors. The policy was\u00a0repealed in April<\/a>, with Attorney General Pam Bondi declaring it had \u201cunfairly targeted law-abiding gun owners.\u201d ATF Acting Director Daniel Driscoll\u00a0admitted in May<\/a>\u00a0that dealers were punished for \u201csimple mistakes such as forgetting to put their license number on forms.\u201d<\/p>\n

Yet despite those public reversals, DOJ lawyers have refused to drop their defense of the old policy. According to court filings, they informed GOA that the government has \u201cno plans to abandon its previous arguments\u201d in the ongoing lawsuit.<\/p>\n

Gun Owners Foundation<\/a>\u00a0highlighted the stakes in a statement on X, warning that without a permanent ruling in court, nothing prevents the policy from coming back.<\/p>\n

GOA: The Fight Isn\u2019t Moot<\/em><\/p><\/blockquote>\n

GOA leaders say the case is about more than just one rule\u2014it\u2019s about stopping the ATF from using executive \u201cpolicies\u201d to bypass Congress.<\/p>\n<\/div>\n

\u201cThe case is not moot, because an ATF policy like \u2018zero tolerance\u2019 is not a law, and does not go through formal processes like notice and comment rulemaking,\u201d\u00a0explained GOA<\/a>\u00a0Senior Vice President Erich Pratt. He warned that agency bureaucrats could bring back the rule \u201cat a moment\u2019s notice, scrawled on the back of a napkin.\u201d<\/p><\/blockquote>\n

An Internal DOJ Revolt?<\/h3>\n

What makes this battle unusual is that the Trump administration itself has already repudiated \u201czero tolerance.\u201d Even DOJ and ATF press releases now emphasize fairness, discretion, and respect for the Second Amendment. But the lawyers still handling the case are the same ones who defended the rule under Biden\u2014and they\u2019re refusing to let go.<\/p>\n

GOA argues this amounts to an internal rebellion: \u201cTo rule in Defendants\u2019 favor, this Court would have to overcome Defendants\u2019 own agreement with Plaintiffs\u2019 arguments, ignoring the chorus of support Plaintiffs\u2019 position enjoys from numerous websites ending in \u2018dot gov,\u2019\u201d the\u00a0group wrote in its brief<\/a>.<\/p>\n

The Bigger Picture<\/h3>\n

This lawsuit is one of several where GOA is pushing for permanent victories against anti-gun policies, including ATF\u2019s \u201cEngaged in the Business\u201d rule and state-level permit schemes used as backdoor gun control. Pratt summarized the frustration bluntly:<\/p>\n
