Maze \u201cpermanently [blocked] federal authorities from enforcing multiple provisions of the ATF\u2019s [\u2018engaged in the business\u2019 rule],\u201d <a class=\"x5l\" href=\"https:\/\/www.rocketcitynow.com\/article\/news\/state\/judge-blocks-parts-of-atf-rule-siding-with-alabama-collectors-and-nra\/525-b4aacb2e-6531-48e3-b645-63ba39c08053\" target=\"_blank\" rel=\"noopener external\">according<\/a> to Rocket City Now.<\/p>\n<div data-mp3u=\"https:\/\/media.breitbart.com\/media\/2025\/10\/federal-judge-biden-atf-rule-for-firearms-sales-cannot-be-used-against-nra-members-31103269.mp3\" data-mp3l=\"2:45\" data-mp3d=\"PT2M45S\">Maze\u2019s ruling applies to two plaintiffs \u2014 \u201cDon Butler of Talladega and David Glidewell of Ragland\u201d \u2014 and to members of the NRA.<\/div>\n<p>ATF\u2019s engaged in the business rule became final on April 10, 2024. The rule is designed to expand the occurrences of point-of-sale background checks by counting certain private sales as business sales, thereby requiring the transfer to be handled via a National Instant Criminal Background Check System (NICS) background check.<\/p>\n<p>As the rule prepared to be finalized, Breitbart News\u00a0<a href=\"https:\/\/www.breitbart.com\/2nd-amendment\/2024\/05\/23\/atf-director-cant-say-what-point-private-citizen-becomes-engaged-business-selling-guns\/\">noted<\/a> that then-ATF director Steven Dettelbach could not could not define a precise threshold for when private citizens are considered \u201cengaged in the business\u201d of selling guns. The ambiguity put law-abiding gun owners on edge, as they could not ascertain when they might be in violation of the rule and when they might not.<\/p>\n<p>A lawsuit,\u00a0<a class=\"x5l\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.alnd.190461\/gov.uscourts.alnd.190461.95.0.pdf\" target=\"_blank\" rel=\"noopener external\"><em>Butler v. Garland<\/em><\/a>, resulted, later to be augmented to\u00a0<em>Butler v. Bondi<\/em>.<\/p>\n<p class=\"a9d-pre\">In the case, \u201cPlaintiffs argue that Congress requires a person buy or sell multiple firearms before he can be deemed to be engaged the firearms\u2019 business, and ATF exceeded its authority by roping in persons who sell or offer to sell only one firearm.\u201d<\/p>\n<p class=\"a9d-pre\">Maze agreed with the plaintiffs, noting that the \u201cATF exceeded its authority when it interpreted the [the Gun Control Act of 1968] to possibly prohibit a single purchase or sale or a single offer to purchase or sell a firearm.\u201d<\/p>\n<p><iframe loading=\"lazy\" class=\"bnn-if-tweet optanon-category-C0005\" src=\"https:\/\/www.breitbart.com\/t\/assets\/html\/tweet-5.html#1973427024774701102\" width=\"560\" height=\"260\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-btlnk=\"https:\/\/twitter.com\/GunOwners\/status\/1973427024774701102\" data-rx=\"1\" data-otc=\"5\" data-bnewh=\"1600px\" data-mce-fragment=\"1\"><\/iframe>Maze pointed to case law, summarizing: \u201cCongress decided that a person is not engaged in the business of dealing in firearms unless he deals firearms \u2018as a regular course of trade or business\u2019\u2026 Regular means repeated or often. So regular business requires more than one firearm transaction involving a single firearm. Because the Final Rule says single transactions involving one firearm may be prohibited in some cases, it exceeds ATF\u2019s statutory authority.\u201d<\/p>\n<p>He continued to examine phrases in the ATF\u2019s final engaged in the business rule, showing again and again how the \u201cATF exceeded its authority,\u201d ruling:\u00a0\u201cThe court will enter a separate order that PERMANENTLY ENJOINS the Department of Justice, ATF, Acting ATF Director Daniel Driscoll, and Attorney General Pamela Bondi from enforcing these aspects of the \u2018Engaged in the Business\u2019 Final Rule against Plaintiffs Don Butler, David Glidewell, and any member of the NRA.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Federal Judge: Biden ATF Rule on Firearms Sales Cannot Be Used Against NRA Members On Tuesday, U.S. District Court Judge Corey L.
