Trump signed the \u201cProtecting Second Amendment Rights\u201d executive order in February, his Department of Justice has done exactly the opposite\u2014relentlessly defending the federal government\u2019s unconstitutional gun control regime. Instead of using the Justice Department\u2019s vast power to secure Americans\u2019 right to keep and bear arms, the Trump DOJ has used it to fight against the People\u2014even taking extreme positions in court to resist injunctions that block the government\u2019s enforcement of gun laws that\u00a0<a href=\"https:\/\/www.firearmspolicy.org\/reese\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.firearmspolicy.org\/reese&amp;source=gmail&amp;ust=1762978486172000&amp;usg=AOvVaw1ZwCwQS9mX_i6coG4J6JqQ\">federal judges have already found unconstitutional<\/a>.<\/p>\n<p>Last month, the Administration\u2019s Solicitor General, D. John Sauer\u2014the government\u2019s top appellate lawyer, often called the \u201c10th Justice\u201d for his influence with the Supreme Court\u2014<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1259\/379286\/20251009151027698_24-1259RushOpp.pdf\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1259\/379286\/20251009151027698_24-1259RushOpp.pdf&amp;source=gmail&amp;ust=1762978486172000&amp;usg=AOvVaw3FA774CcKF-O_lp4MahJ_z\">urged the Court<\/a>\u00a0to deny review in a case challenging the National Firearms Act\u2019s (NFA) registration and taxation scheme for short-barreled rifles. The Administration argued that the NFA\u2019s intrusive requirements are \u201cconsistent with this Nation\u2019s historical tradition of firearm regulation,\u201d effectively endorsing the very federal overreach the Second Amendment was written to prevent.<\/p>\n<p>In an effort to convince the Court to dodge the question of unconstitutional federal restrictions, the Trump DOJ suggested that the Court should focus on \u201claws banning AR-15 rifles.\u201d Yet, when the opportunity arose for the Administration to support\u00a0<a href=\"https:\/\/www.firearmspolicy.org\/Viramontes\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.firearmspolicy.org\/Viramontes&amp;source=gmail&amp;ust=1762978486172000&amp;usg=AOvVaw0OlzXo0oi8V2OsSZzMyE9F\">exactly such a case<\/a>\u2014a challenge to an AR-15 rifle ban out of Illinois\u2014the Trump DOJ was silent.<\/p>\n<p>Rather than support good Supreme Court vehicles, the Trump DOJ has chosen to game the system and throw its weight behind bad cases likely to strengthen the government\u2019s power and weaken individual liberty, such as\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1234\/362144\/20250602174403309_HemaniPetition.pdf\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-1234\/362144\/20250602174403309_HemaniPetition.pdf&amp;source=gmail&amp;ust=1762978486172000&amp;usg=AOvVaw14Fz2NZCmi-W0ltaa4VlMn\"><em>United States v. Hemani<\/em><\/a>, which the Supreme Court recently agreed to hear.<\/p>\n<p>The Trump DOJ\u2019s continuing adversarial posture to the Second Amendment doesn\u2019t end there. In\u00a0<a href=\"https:\/\/www.firearmspolicy.org\/peterson\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.firearmspolicy.org\/peterson&amp;source=gmail&amp;ust=1762978486172000&amp;usg=AOvVaw24OYpLhbGf8W7lJ0VW0iZK\"><em>United States v.
