But thus far, the agency hasn\u2019t been too eager to talk about it, and the reported rollout date for the new section to begin operations has already come and gone without any movement.<\/div>\n<div><\/div>\n<div>Officials from the DOJ only publicly confirmed the existence of the planned section for the first time on Friday night after more than a week of media reports.<\/div>\n<div><\/div>\n<div>\u201cThe 2nd Amendment is not a second-class right. After the prior administration\u2019s campaign to infringe on Americans\u2019 gun rights, the Justice Department is strongly committed to undoing the damage,\u201d Attorney General Pam Bondi (R.) wrote in a\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/x.com\/AGPamBondi\/status\/1997090996895498571\" target=\"_blank\" rel=\"noopener\">social media post<\/a>. \u201cThis unit within our Civil Rights Division will advance President Trump\u2019s pro-2nd Amendment agenda and protect the right to bear arms for all.\u201d<\/div>\n<div><\/div>\n<div>Details about the move were first reported by\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/www.reuters.com\/legal\/government\/us-justice-department-plans-gun-rights-office-within-civil-rights-unit-2025-11-25\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a><a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/www.reuters.com\/legal\/government\/us-justice-department-plans-gun-rights-office-within-civil-rights-unit-2025-11-25\/\" target=\"_blank\" rel=\"noopener\">\u00a0last week<\/a>, though the plans for the new entity appear to have been months in the making. In\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/dartmouthalumnimagazine.com\/articles\/advocate-enforcer\" target=\"_blank\" rel=\"noopener\">a September interview<\/a>\u00a0with an alumni publication for her alma mater, Assistant Attorney General and leader of the DOJ\u2019s Civil Rights Division Harmeet Dhillon announced that plans for the new section were already in the works as early as this summer.<\/div>\n<div><\/div>\n<div>According to planning documents provided to Congress and obtained by Reuters, the proposed new section would be tasked primarily with \u201cinvestigating local laws or policies limiting gun rights,\u201d and it would carry out that work \u201cusing existing funds and personnel.\u201d The documents also identified December 4th as the new section\u2019s expected opening date.<\/div>\n<div>However, the DOJ has yet to formally announce the new section beyond Bondi\u2019s social media post, and it remains absent from the Civil Rights Division\u2019s\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/www.justice.gov\/crt\/our-work\" target=\"_blank\" rel=\"noopener\">organization page<\/a>.<\/div>\n<div><\/div>\n<div>The DOJ also has not responded to\u00a0The Reload\u2019s requests for comment on details about the new division.<\/div>\n<div><\/div>\n<div><\/div>\n<p><!--more--><\/p>\n<div><\/div>\n<div>Yet while the logistics and start date of the section remain murky, the promise of such a move for gun-rights advocates is self-evident. The symbolic value alone of having an institutionalized arm of the world\u2019s largest law office dedicated to pursuing its interests across the country is an\u00a0achievement. It stands in contrast to the unprecedented actions taken by the prior administration to\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/thereload.com\/president-biden-formally-launches-gun-control-office\/\" target=\"_blank\" rel=\"noopener\">elevate gun-control interests<\/a>\u00a0into a\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/thereload.com\/firearms-trade-group-asks-trump-to-dismantle-bidens-white-house-gun-office\/\" target=\"_blank\" rel=\"noopener\">since-disbanded<\/a>\u00a0executive-level office.<\/div>\n<div><\/div>\n<div>Unlike the Biden administration\u2019s Office of Gun Violence Prevention, however, a new Second Amendment section under the Civil Rights Division would have active enforcement authority. That could translate to real upside for gun-rights advocates. The Civil Rights Division has already shown a willingness to flex its muscles against progressive jurisdictions seen as violating the gun rights of their respective residents.<\/div>\n<div><\/div>\n<div>In March, it\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/thereload.com\/analysis-trump-admin-ramps-up-scrutiny-of-local-gun-restrictions-member-exclusive\/\" target=\"_blank\" rel=\"noopener\">launched<\/a>\u00a0a first-of-its-kind \u201cpattern or practice\u201d investigation into the Los Angeles County Sheriff\u2019s Department for its slow processing of concealed handgun license applications.\u00a0Merging that case-by-case intervention into a centralized body with a singular mission should create greater opportunities for oversight and enforcement actions across\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/thereload.com\/analysis-trump-admin-ramps-up-scrutiny-of-local-gun-restrictions-member-exclusive\/\" target=\"_blank\" rel=\"noopener\">more jurisdictions<\/a>. That\u2019s certainly where expectations appear to be among the gun policy community, as evidenced by the\u00a0<a href=\"https:\/\/archive.is\/o\/PXEXu\/https:\/\/thereload.com\/gun-rights-groups-cheer-new-doj-second-amendment-division\/\" target=\"_blank\" rel=\"noopener\">fanfare and controversy<\/a>\u00a0mere reports of the new division have generated to date.<\/div>\n<div><\/div>\n<div>Of course, there are also serious caveats to consider.<\/div>\n<div><\/div>\n<div>The DOJ\u2019s lack of transparency to this point about the new section means we just don\u2019t know how ambitious the new plans are or what they will look like in practice. There\u2019s little reason to doubt the veracity of the reports from\u00a0Reuters, particularly considering Assistant Attorney General Dhillon\u2019s past public comments. But the fact that the reorganization will likely occur without any additional funding or personnel raises the possibility that the move will amount to little more than slapping a new name on the same work we\u2019ve already seen.<\/div>\n<div><\/div>\n<div>And finally, there\u2019s reason to question the staying power of the new section and its work. What can be created through a unilateral reorganization can also be disbanded through the same means under a subsequent administration. Just look at the unceremonious dismantling of the White House Office of Gun Violence Prevention from earlier this year.<\/div>\n<div><\/div>\n<div>Ultimately, the mere existence of a dedicated federal civil rights office focused on the Second Amendment is an important achievement for the gun-rights movement.
