I know what you\u2019re thinking: What about the castle doctrine? Not to mention it\u2019s Texas. So what\u2019s going on?<\/p>\n<p>The comment section on the rather vague news reports are filled with opinionated social media experts claiming this guy will be out in no time and that he should totally sue local law enforcement for wrongful imprisonment. So, what\u2019s the truth?<\/p>\n<p>The truth is the castle doctrine isn\u2019t absolute. That means you can\u2019t do whatever the heck you feel like in your own home. Rules, people\u2026there are rules.<\/p>\n<p>Disclaimer: As always, please remember that I\u2019m not an attorney and this isn\u2019t legal advice. (Photo: CBS7)<\/em><\/figcaption><\/figure>\n<h5>The Shooting<\/h5>\n<p><a href=\"https:\/\/www.wtok.com\/2026\/01\/12\/man-charged-with-murder-after-he-shot-killed-an-armed-home-intruder-police-say\/\" target=\"_blank\" rel=\"noopener\">On January 9,<\/a>\u00a0local law enforcement in Big Spring, Texas responded to a shots fired call. It isn\u2019t clear who actually made that call, which is interesting. Most sources simply state police responded to the call. One claims Joel Adrian Florez (the alleged shooter) who made the call.<\/p>\n<p>When law enforcement arrived they found Florez and an as-yet-unnamed female standing outside the home. Florez told the police he\u2019d shot an armed intruder and when they entered the house, sure enough, there was Phillip Lozano, Jr., dead right there.<\/p>\n<p>Less than 24 hours later, Big Spring police had arrested Florez and charged him with murder (apparently the arrest took place around 8:57pm on January 10<sup>th<\/sup>). No details have been released to explain the probable cause behind the charge, and we\u2019re well past the 72-hour period. What we do know is Florez has been charged and the investigation is ongoing. That\u2019s it.<\/p>\n<h5>Theories, Rumors and Gossip<\/h5>\n<p>After spending more time digging and reading than I care to admit, all I can say is that the Big Spring shooting is surrounded by a lot of rumors. Here\u2019s some of the speculation and supposition that\u2019s swirling around the story . . .<\/p>\n<ul>\n<li>Gang activity<\/li>\n<li>A drug deal gone bad<\/li>\n<li>A love triangle involving the unnamed woman at the scene<\/li>\n<li>Long-standing mutual dislike between the men<\/li>\n<li>Little green men beamed down and staged it all, because aliens<\/li>\n<\/ul>\n<p>You get the idea. These are the standard sorts of rumors that surround a case like this, so take it all with a\u00a0<a href=\"https:\/\/blogger.googleusercontent.com\/img\/b\/R29vZ2xl\/AVvXsEihEHF658XFcs0It7rFJN6BueB8nJOwLYEws9QRIgylMMh6uCyNf52Dx1p9y9ydC5vqtjigyY7M4GndXpwYUVYKVwlMSZtj4BZ7lbfjAryFb0Q-jbFBWr7YbtsycGfv_uCZOIEAOcHs-yE\/s1600\/110_5722.JPG\" target=\"_blank\" rel=\"noopener\">Madison Boulder<\/a>-sized grain of salt. I\u2019d recommend simply waiting for details to be released as time passes. It almost always does. But the case is a good reason to think about the castle doctrine and its limitations.<\/p>\n<h5>The Truth About the Castle Doctrine<\/h5>\n<p>Like I said, the castle doctrine isn\u2019t absolute. Most states have some version of it in place, it just isn\u2019t always called the castle doctrine.<\/p>\n<p>Some states also have stand your ground laws. Remember, though, that while the two can support each other depending on the circumstances, castle doctrine and stand your ground laws\u00a0<em>are not<\/em>\u00a0the same thing. To keep it simple, we\u2019re just going to hit the high notes on castle doctrine in a \u201cgenerally speaking\u201d manner. (Laurie Skrivan\/ St. Louis Post-Dispatch via AP file)<\/em><\/figcaption><\/figure>\n<p>I won\u2019t bore you guys with the age-old history of the legal concepts behind castle doctrine, and I won\u2019t wade into the legalese that\u2019s best reserved for curing insomnia. In layman\u2019s terms, the castle doctrine reinforces your legal right to do defend yourself\u00a0 in your place of residence\u2026within reason. What\u2019s considered your residence depends (again) on the state, so check your local laws. In some states that extends to hotel rooms, places of business, and even occupied vehicles.<\/p>\n<h5>Nope, You Can\u2019t Do That<\/h5>\n<p>There are a few key issues that could result in you catching a murder charge in what might appear to be straightforward castle doctrine-protected defensive gun use. Here\u2019s a quick breakdown on some yes and no issues:<\/p>\n<ul>\n<li>You must be inside your residence. If you\u2019re not, the only legal justification for going inside after an intruder is if you have good reason to believe there\u2019s someone else in danger in there (a child, a spouse, etc.). No, your dog doesn\u2019t count.<\/li>\n<li>The threat must be imminent and clear. That means it isn\u2019t enough for a person to just be in your house. Before you get all cranky about that, stop and think about it. It\u2019s entirely possible to have an\u00a0<a href=\"https:\/\/abcnews.go.com\/US\/da-mulls-shooting-alzheimers-patient-enter-home\/story?id=21080904#:~:text=The%20Georgia%20version%20of%20the,he%20was%20getting%20his%20mail.\" target=\"_blank\" rel=\"noopener\">elderly Alzheimer patient<\/a>, a drunk neighbor, or a random Girl Scout wander right into your home. My first suggestion is to keep your doors locked, but the second is to take time to properly identify an actual threat.<\/li>\n<li>The home invader doesn\u2019t have to be waving a gun in your face to reasonably be considered a threat. There are many factors that come into play with a credible threat, and the truth is that almost anything can be a weapon, including a person\u2019s own body when there\u2019s a\u00a0<a href=\"https:\/\/www.usconcealedcarry.com\/blog\/disparity-of-force\/\" target=\"_blank\" rel=\"noopener\">disparity of force<\/a>\u00a0issue.<\/li>\n<li>Edison (<a href=\"https:\/\/americanhistory.si.edu\/lighting\/bios\/swan.htm\" target=\"_blank\" rel=\"noopener\">Swan<\/a>,\u00a0<a href=\"https:\/\/www.sciencefocus.com\/science\/who-really-invented-the-light-bulb\" target=\"_blank\" rel=\"noopener\">Davy<\/a>,\u00a0<a href=\"https:\/\/penncapital-star.com\/commentary\/meet-lewis-latimer-who-made-the-light-bulb-longer-lasting-michael-coard\/\" target=\"_blank\" rel=\"noopener\">Latimer<\/a>) didn\u2019t invent the lightbulb for funzies. You need to see the threat to identify it and to be sure it isn\u2019t your college-age daughter showing up unannounced at 2:00am because their boyfriend dumped her (yes,\u00a0<a href=\"https:\/\/abc7ny.com\/post\/teen-killed-by-father-janae-hairston-mistaken-shooting-dad-kills-daughter\/11408068\/\" target=\"_blank\" rel=\"noopener\">it\u2019s happened in multiple cases<\/a>\u00a0and it\u2019s resulted in\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/tennessee-cops-dad-who-killed-timea-batts-said-she-scared-him\/#:~:text=According%20to%20an%20affidavit%2C%2029,on%20a%20$1%20million%20bond.\" target=\"_blank\" rel=\"noopener\">the kid\u2019s death<\/a>).<\/li>\n<li>Don\u2019t put the home invader\u2019s boots on and go kick your door in after the fact. You\u2019ll get caught and not only is it illegal, it\u2019s stupid. I don\u2019t care if your Uncle Fred who\u2019s a cop said you should do that. Just\u2026don\u2019t.<\/li>\n<li>When the threat stops, you need to stop. This isn\u2019t Hollywood, and there are no\u00a0<em>coup de grace<\/em>\u00a0headshots to prevent an untimely resurrection. You shoot to stop the threat and when the immediate threat ends, so does your shooting.<\/li>\n<li>Home defense isn\u2019t for defense of property, not even in Texas. Yes, I\u2019m sure you\u2019ve heard Texas allows shooting in defense of property, but that doesn\u2019t make it a good idea. If some dude is stealing your truck out of the driveway, call the police and let him drive away. Creating a deadly confrontation by waltzing out your front door with a gun isn\u2019t going to look reasonable to a prosecutor or a jury because, well, it\u2019s not.<\/li>\n<li>Even in castle doctrine states, your defensive actions must be considered reasonable.<\/li>\n<li>If you\u2019re\u00a0<a href=\"https:\/\/www.channel3000.com\/news\/crime\/man-who-shot-killed-home-intruder-now-facing-drug-charges\/article_02949281-2b38-5b2b-b209-0f997d7e12b3.html\" target=\"_blank\" rel=\"noopener\">breaking the law<\/a>\u00a0when you decide to shoot someone under what you think is the absolute power of castle doctrine, you\u2019re going to have a bad time. You can\u2019t be committing a crime at the time and you must be\u00a0<a href=\"https:\/\/abcnews.go.com\/US\/author-texas-castle-doctrine-defense-law-designed-defendants\/story?id=65978174\" target=\"_blank\" rel=\"noopener\">legally allowed to be in the residence.<\/a>\u00a0(Think about a soon-to-be-ex-husband under a temporary restraining order barging into what\u00a0<em>was<\/em>\u00a0the marital home where his soon-to-be-ex-wife still resides).<\/li>\n<li>Generally speaking, you can\u2019t wantonly\u00a0<a href=\"https:\/\/www.shootingnewsweekly.com\/self-defense\/personal-defense-tip-do-not-shoot-through-doors\/\" target=\"_blank\" rel=\"noopener\">shoot through the front door<\/a>. For the millionth time, this isn\u2019t a movie or Joe Biden\u2019s vacation home.<\/li>\n<li>You can\u2019t invite someone to your house for the purpose of shooting them. (Tom Fox\/The Dallas Morning News via AP, File)<\/em><\/figcaption><\/figure>\n<h5>What Good is the Castle Doctrine?<\/h5>\n<p>As with all aspects of self-defense, there are a lot of factors to take into consideration. That\u2019s just one reason it\u2019s so important to be well trained, not only in the use of your firearms but also in the legal side. There\u2019s no shortage of \u201cexperts\u201d on social media and cases like the one in which Joel Florez has been charged certainly bring out the most confident among them. It\u2019s mostly a toxic blend of ignorance and misplaced confidence, but you can\u2019t deny they\u2019re absolutely convinced of their rightness.<\/p>\n<p>The castle doctrine is a legal protection that gives you legal backing for defending yourself and your loved ones from a home invader. It\u2019s important to remember, though, that it isn\u2019t absolute and it certainly isn\u2019t a Get Out of Jail Free card. It\u2019s a legal layer of protection for lawful gun owners in reasonable self-defense situations. Think of it as a legal net that\u2019s in place to catch you if the worst should happen\u2026assuming your actions are considered after the fact as reasonable and justified.<\/p>\n<p>Remember that when you decide to own a firearm for defensive purposes, you\u2019re taking on a major responsibility. Your gun shouldn\u2019t be your instant, knee-jerk reaction to conflict. It\u2019s a tool for the application of lethal force, and it should be treated with respect. Far too many people, people who I could call out by name, obviously believe if they\u2019re ever involved in a self-defense shooting they\u2019ll be just fine because they\u2019ll be \u201cright.\u201d<\/p>\n<p>Sorry, guys, that isn\u2019t how this works. Americans have greater freedoms than any other nation on Earth, but this isn\u2019t the wild west, and you don\u2019t have\u00a0<em>carte blanche<\/em>\u00a0to do as you please with your gun. Be smart. Know the law.
