ATF Backtracks On Permit Denials After Backlash From Pro-Second Amendment Group<\/a><\/p>\n

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) backtracked Tuesday after Gun Owners of America (GOA) posted screenshots on X of the denial of an application for items covered by the National Firearms Act of 1934 (NFA).<\/p>\n

The reconciliation bill\u00a0signed<\/a>\u00a0into law by President Donald Trump in July 2025 contained provisions that reduced the taxes on suppressors, short-barreled rifles, short-barreled shotguns and guns described as \u201cany other weapon\u201d to $0. According to screenshots\u00a0posted<\/a>\u00a0on X by GOA from legal documents\u00a0filed<\/a>\u00a0Monday, a member of the gun-rights group requested tax stamps for a\u00a0suppressor<\/a>\u00a0and a\u00a0short-barreled Winchester 1300 shotgun<\/a>, leading ATF to respond on the social media site.\u00a0\u00a0(RELATED: Chris Murphy Wants To Jack Up Taxes On Certain Accessories And Guns Sky High)<\/a><\/strong><\/p>\n

\u201cOn January 28, 2026, the Bureau of Alcohol, Tobacco, Firearms and Explosives (\u2018ATF\u2019) \u2018disapproved\u2019 two Form 1 Applications to Make and Register NFA Firearms related to making a suppressor and a short-barreled rifle that had been submitted by a member of Plaintiff Gun Owners of America,\u201d GOA said in its Monday filing. \u201cAs Plaintiffs explain in the attached notice of supplemental authority, ATF\u2019s disapproval of these Form 1s demonstrates that the National Firearms Act is not a \u2018shall-issue\u2019 scheme as Defendants argue. And it shows that ATF determined that the exercise of Second Amendment rights an illegitimate reason to acquire a firearm.\u201d<\/p>\n

ATF just DENIED a GOA member\u2019s Form 1 because he wanted a suppressor to \u201cexercise my God-given right.\u201d\u00a0@ATFHQ<\/a>\u00a0said this was an \u201cinsufficient answer.\u201d<\/p>\n

\u201cThis is why I spent the last year lobbying for the repeal of the National Firearms Act using the one big beautiful bill in the budget reconciliation process, because you shouldn\u2019t have to ask the government for permission to exercise your right to make a firearm or transfer a firearm, and especially when the government can just deny you arbitrarily, whether it\u2019s on purpose, whether it\u2019s a mistake, it\u2019s not a right if you have to ask permission to do it,\u201d GOA director of federal affairs Aidan Johnston told the Daily Caller News Foundation.<\/p>\n

The Form 1 applications had a box, listed as \u201c4I\u201d asking for a reason why the applicant, whose name is redacted, wanted the NFA items.<\/p>\n

\u201cEXERCISE MY GOD GIVEN RIGHT,\u201d was the explanation provided in both documents by the GOA member. ATF denied the applications, citing, \u201cINSUFFICENT REASON \u2013 4I \u2013 STATE REASON, NOT ACTUAL.\u201d<\/p>\n

ATF\u00a0posted<\/a>\u00a0on X Tuesday claiming that the issue was being rectified after GOA\u2019s post from Monday received over 270,000 views.<\/p>\n

\u201cATF is aware of the report regarding a Form 1 denial for \u2018insufficient answer,\u2019\u201d the agency said. \u201cWith high application volumes, occasional admin errors occur, which we promptly correct when identified. This specific matter has been resolved.\u201d<\/p>\n

The Department of Justice (DOJ) argued that the decision to grant permits under the NFA worked similarly to laws that mandated agencies \u201cshall issue\u201d concealed carry permits in a Nov. 20\u00a0filing<\/a>\u00a0responding to GOA\u2019s lawsuit asking that the law be thrown out on Second Amendment grounds.<\/p>\n

\u201cWhen this GOA member followed up with ATF by email, asking \u2018[p]lease provide me with a complete list of acceptable reasons to ATF to make a firearm because my reason is obviously not what the examiner wanted to read,\u201d ATF doubled down, stating that \u2018Box 4i needs a clear, legal reason why you are manufacturing the weapon,\u2019\u201d GOA said in another\u00a0document<\/a>\u00a0filed Monday, which included the\u00a0email<\/a>\u00a0from ATF that apparently admitted the denial of at least the suppressor was erroneous.<\/p>\n

\u201cThe silencer should not have been disapproved for the reason stated,\u201d ATF said in the email. \u201cYou will need to resubmit the form and supporting documentation again as we are unable to open or amend a form once final determination is made on it.\u201d<\/p>\n

The Supreme Court\u00a0invalidated<\/a>\u00a0New York\u2019s \u201cgood cause\u201d requirement for pistol permits in June 2022, with Associate Justice Clarence Thomas, who authored the court\u2019s\u00a0opinion<\/a>, citing historical gun laws and the debate around the ratification of the 14th Amendment as reasons New York\u2019s concealed carry law, which was characterized as \u201cdiscretionary issue,\u201d was unconstitutional.<\/p>\n
