{"id":116881,"date":"2026-05-19T15:47:36","date_gmt":"2026-05-19T20:47:36","guid":{"rendered":"https:\/\/milesfortis.com\/?p=116881"},"modified":"2026-05-19T15:47:36","modified_gmt":"2026-05-19T20:47:36","slug":"116881","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=116881","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/tennesseeconservativenews.com\/tennessee-legislation-expanding-castle-doctrine-protections-awaits-governors-approval\/\" target=\"_blank\" rel=\"noopener\">Tennessee Legislation Expanding Castle Doctrine Protections Awaits Governor\u2019s Approval<\/a><\/p>\n<p>The Tennessee Conservative [By Paula Gomes] \u2013<\/p>\n<p>Legislation that lowers the standard for use of deadly force on private property,\u00a0<a role=\"link\" href=\"https:\/\/www.wjhl.com\/news\/local\/attorneys-explain-tennessee-bill-expanding-use-of-deadly-force\/\" target=\"_blank\" rel=\"noreferrer noopener\">expanding Castle Doctrine<\/a>\u00a0protections, is awaiting Governor Bill Lee\u2019s approval.<\/p>\n<p>Tennessee lawmakers passed\u00a0<a role=\"link\" href=\"https:\/\/wapp.capitol.tn.gov\/apps\/BillInfo\/Default?BillNumber=HB1802&amp;GA=114\" target=\"_blank\" rel=\"noreferrer noopener\">HB1802\/SB1847<\/a>, sponsored by Representative Kip Capley (R-Summertown-District 71) and Senator Joey Hensley (R-Hohenwald-District 28),\u00a0<a role=\"link\" href=\"https:\/\/tennesseeconservativenews.com\/legislation-lowering-standard-for-use-of-deadly-force-to-become-tennessee-law-after-intense-debate\/\" target=\"_blank\" rel=\"noreferrer noopener\">after intense debate<\/a>.<\/p>\n<figure class=\"wp-block-embed is-type-wp-embed is-provider-tennessee-conservative wp-block-embed-tennessee-conservative\">\n<div class=\"wp-block-embed__wrapper\">The legislation allows for the use of deadly force if a person <em>\u201creasonably believes deadly force is immediately necessary to prevent the other\u2019s imminent commission of arson, burglary, robbery, aggravated robbery, or aggravated cruelty to animals\u201d<\/em>\u00a0in the event the person using deadly force cannot protect their property any other way or if the use of force by other means would expose them or someone else to risk of death, serious bodily injury or grave sexual abuse.<\/div>\n<div><\/div>\n<\/figure>\n<p>Shooting someone in the back is not justified under the bill\u2019s protections and Tennessee\u2019s current self-defense standards are not erased by the legislation, still requiring a threat involving serious bodily injury or death.<\/p>\n<p>To fall under self-defense statutes, an amendment clarified that in using deadly force, a person must not be engaged in conduct that would constitute a felony or Class A misdemeanor, such as inviting someone onto your property to sell you illegal drugs, and is present where they lawfully reside.<\/p>\n<p>When the bill passed in the Senate, it did not include the House amendment and had to be returned for concurrence, but the legislation is ready for Lee to take action on, and is slated to take effect July 1st, 2026.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Tennessee Legislation Expanding Castle Doctrine Protections Awaits Governor\u2019s Approval The Tennessee Conservative [By Paula Gomes] \u2013 Legislation that lowers the standard for use of deadly force on private property,\u00a0expanding Castle Doctrine\u00a0protections, is awaiting Governor Bill Lee\u2019s approval.
