This historic ruling means no state in the Fifth Circuit can ban suppressors, and we&#8217;re one step closer to the Supreme Court reaching the same conclusion.<\/p>\n<p>The court ruling states, &#8220;Peterson left open the question whether silencers are Second Amendment &#8216;Arms.&#8217;. 161 F.4th at 339. They are. Under the Second Amendment, \u201cArms\u201d comprises \u201cweapons of offence,\u201d \u201carmour of defence,\u201d and \u201canything that a man wears for his defence, . . . takes into his hands, or useth in wrath to cast at or strike another.\u201d Heller, 554 U.S. at 581 (citation modified). To \u201cbear arms,\u201d in sum, means to \u201cwear, bear, or carry . . . for the purpose . . . of being armed and ready for offensive or defensive action in case of conflict with another person.\u201d Id. at 584 (ellipses in original).
