{"id":117699,"date":"2026-07-06T13:28:45","date_gmt":"2026-07-06T18:28:45","guid":{"rendered":"https:\/\/milesfortis.com\/?p=117699"},"modified":"2026-07-06T13:28:45","modified_gmt":"2026-07-06T18:28:45","slug":"117699","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=117699","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/bearingarms.com\/tomknighton\/2026\/07\/06\/goa-has-major-problem-with-new-rules-from-atf-n1233084\" target=\"_blank\" rel=\"noopener\">GOA Has Major Problem With New Rules From ATF<\/a><\/p>\n<p><a title=\"ATF\" href=\"https:\/\/bearingarms.com\/tags\/atf\" target=\"_blank\" rel=\"noopener\">The ATF<\/a>\u00a0is changing rules aplenty, and they&#8217;re a massive departure from years gone by, when everyone in leadership there was as anti-gun as they came. It&#8217;s almost universally good news for us, to say the least.<\/p>\n<p>Yes, I&#8217;m happy overall with where things are headed.<\/p>\n<p>However, things aren&#8217;t perfect, and\u00a0<a title=\"GOA Argues ATF's Record Rules Barely a Good Start\" href=\"https:\/\/bearingarms.com\/tomknighton\/2026\/05\/20\/goa-argues-atfs-record-rules-barely-a-good-start-n1232593\" target=\"_blank\" rel=\"noopener\">Gun Owners of America<\/a>\u00a0is a little less than pleased by what we&#8217;re seeing.<\/p>\n<p>In particular, they have one problem,\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/goa-atf-fake-rollback-biden-dealer-rule\/?utm_source=google&amp;utm_medium=organic\" target=\"_blank\" rel=\"noopener noreferrer\">but it&#8217;s kind of a big one.<\/a><\/p>\n<blockquote><p>The pro-gun rights group Gun Owners of America is calling out the Bureau of Alcohol, Tobacco, Firearms and Explosives over what GOA calls a \u201cfake rollback\u201d of the Biden Administration\u2019s \u201cEngaged in the Business\u201d rule.<\/p>\n<p>GOA has been\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/goa-battles-entrenched-doj-over-bidens-engaged-in-the-business-final-rule\/\" target=\"_blank\" rel=\"noopener\">battling the Trump Administration Department of Justice<\/a>\u00a0over the rule ever since President Donald Trump took office for his second term. And while it looked like the DOJ had decided to\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/doj-drops-appeal-biden-gun-sales-rule\/\" target=\"_blank\" rel=\"noopener\">do away with the rule<\/a>\u00a0in recent proposed rulemaking, GOA says there\u2019s more to the story.<\/p>\n<h2 class=\"wp-block-heading\">GOA: The replacement rule keeps the Biden framework in place<\/h2>\n<p>\u201cThat rule tried to twist the Bipartisan Safer Communities Act to impose backdoor universal background checks by redefining who counts as a \u2018dealer,&#8217;\u201d GOA said in a recent\u00a0<a href=\"https:\/\/www.gunowners.org\/na20260629\/\" target=\"_blank\" rel=\"noreferrer noopener\">news release<\/a>\u00a0on the rule. \u201cNow, ATF has proposed a replacement rule that claims to \u2018rescind\u2019 the Biden rule, but in reality keeps key parts of its legal framework in place and leaves gun owners exposed.\u201d<\/p>\n<h2 class=\"wp-block-heading\">Your firearms list could still be used against you<\/h2>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cATF still treats everyday behavior by gun owners as suspicious: keeping a simple list of your firearms, reselling the same model within a short window, or even just offering to sell a firearm can be used as evidence that you are \u2018engaged in the business\u2019 without a license,\u201d GOA explained in the release. \u201cThe agency continues to push the idea that intent alone can be enough evidence to prosecute law-abiding gun owners as illegal firearms traffickers, despite the court\u2019s ruling and the clear limits Congress placed in law.\u201d<\/p><\/blockquote>\n<p>Consequently, GOA said, the ATF cannot keep the Biden-era \u201cEngaged in the Business\u201d framework on the books.<\/p>\n<p>\u201cThe rule must be rescinded in its entirety,\u201d GOA wrote.<\/p><\/blockquote>\n<p>I mean, that&#8217;s fair.<\/p>\n<p>Have you ever had a turn of your fortunes in a short period of time? One month, you&#8217;re doing great, then a couple of months later, everything went to crap?<\/p>\n<p>I suspect most of you have to some degree or another.<\/p>\n<p>One of the problems with this &#8220;engaged in the business&#8221; rule is that it&#8217;s too easy to take someone who is in this kind of situation, who bought a gun in March, then needs money for rent in June, and sells the gun, could be considered an illegal dealer when that&#8217;s not what&#8217;s happening.<\/p>\n<p>Literally no one would say that about someone who bought a car, then sold it in a short window of time. They&#8217;re not an unlicensed car dealer or anything. That&#8217;s true of any other physical product out there. People buy, then sell later on, and if money gets tight, they&#8217;re going to do it a bit quicker than they might otherwise.<\/p>\n<p>The idea that\u00a0<a title=\"No, Trump Didn't 'Reinstate' Supposed Gun Show Loophole\" href=\"https:\/\/bearingarms.com\/tomknighton\/2026\/05\/01\/no-trump-didnt-reinstate-supposed-gun-show-loophole-n1232392\" target=\"_blank\" rel=\"noopener\">selling a firearm<\/a>\u00a0could get you hammered as an illegal dealer is stupid, and it&#8217;s stupid even if it&#8217;s not about money getting tight. If I buy a product, it&#8217;s mine. I should be able to do what I want with it so long as no one else is endangered by my actions. That includes selling my property because I want to sell it.<\/p>\n<p>It might be different if I&#8217;m selling dozens of guns in that short window, but the problem with the rule, as I understand it, and as GOA understands it, is that it doesn&#8217;t differentiate between one sale and a hundred. That&#8217;s a big problem.<\/p>\n<p>For the most part, I like the new rules.
