In the 66-page\u00a0<a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/08\/136%20summary%20judgment%20opinion.pdf\" data-mrf-link=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/08\/136%20summary%20judgment%20opinion.pdf\">opinion<\/a>, Hendrix said that because taxes on suppressors, short-barreled rifles, short-barreled shotguns and other items had been reduced to $0 by legislation\u00a0<a href=\"https:\/\/dailycaller.com\/2025\/07\/04\/donald-trump-big-beautiful-bill-signing-july-4\/\" data-mrf-link=\"https:\/\/dailycaller.com\/2025\/07\/04\/donald-trump-big-beautiful-bill-signing-july-4\/\">signed<\/a> by President Donald Trump in July 2025, the registration and paperwork imposed by the NFA exceeded Congress\u2019 authority under the taxation power.<\/p>\n<blockquote class=\"twitter-tweet\" data-twitter-extracted-i1786042540504289337=\"true\">\n<p dir=\"ltr\" lang=\"en\">BREAKING:<\/p>\n<p>A district court in Texas just granted our summary judgment motion finding that the NFA exceeds congressional authority for the untaxed items, without reaching the Second Amendment question.<\/p>\n<p>More to follow soon as we read the ruling.\u00a0<a href=\"https:\/\/t.co\/IyNbRWBc9x\" data-mrf-link=\"https:\/\/t.co\/IyNbRWBc9x\">pic.twitter.com\/IyNbRWBc9x<\/a><\/p>\n<p>\u2014 SAF (@2AFDN)\u00a0<a href=\"https:\/\/x.com\/2AFDN\/status\/2085047612345053497?ref_src=twsrc%5Etfw\" data-mrf-link=\"https:\/\/x.com\/2AFDN\/status\/2085047612345053497?ref_src=twsrc%5Etfw\">August 5, 2026<\/a><\/p><\/blockquote>\n<p>\u201cIn 2025, Congress eliminated the NFA\u2019s transfer and making taxes for four categories of firearms: short-barreled shotguns, short-barreled rifles, silencers, and a final, defined group of miscellaneous firearms,\u201d Hendrix wrote. \u201cBecause today\u2019s NFA does not generate any revenue from untaxed firearms, its regulatory provisions cannot be upheld under the taxing power. And there is no sign in the NFA\u2019s text, structure, or statutory history that Congress invoked any other power in crafting the NFA provisions at issue. Thus, the regulatory provisions must be enjoined as unconstitutional because they exceed Congress\u2019s enumerated powers.\u201d<\/p>\n<p>After the Senate parliamentarian\u00a0<a href=\"https:\/\/dailycaller.com\/2025\/06\/25\/gop-senators-john-thune-elizabeth-macdonough-big-beautiful-bill\/\" data-mrf-link=\"https:\/\/dailycaller.com\/2025\/06\/25\/gop-senators-john-thune-elizabeth-macdonough-big-beautiful-bill\/\">struck<\/a>\u00a0language that removed those items from NFA\u2019s purview, Congress reduced the taxes to $0.<\/p>\n<p><!--more--><\/p>\n<p>The Department of Justice (DOJ) has\u00a0<a href=\"https:\/\/dailycaller.com\/2026\/07\/21\/you-may-have-missed-it-but-dojs-making-big-admissions-about-suppressors-in-legal-filings\/\" data-mrf-link=\"https:\/\/dailycaller.com\/2026\/07\/21\/you-may-have-missed-it-but-dojs-making-big-admissions-about-suppressors-in-legal-filings\/\">admitted<\/a>\u00a0in multiple legal filings since May 2025 that the \u201cbeneficial use\u201d of suppressors overwhelms their misuse by criminals.
