Hanaway filed a lawsuit against the ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives) Tuesday, seeking to end the requirement that law-abiding Americans must register suppressors and short barrel rifles and shotguns.<\/div>\n<div><\/div>\n<div class=\"main_byline\">A press statement <a class=\"x5l\" href=\"https:\/\/ago.mo.gov\/attorney-general-hanaway-sues-atf-to-defend-the-second-amendment-and-stop-unlawful-federal-overreach\/\" target=\"_blank\" rel=\"noopener external\">issued by Hanaway<\/a>\u00a0notes her argument that when Congress zeroed the National Firearms Act (NFA) taxes on suppressors and short barrel rifles and shotguns, the basis for any registration scheme was undone.<\/div>\n<div><\/div>\n<\/div>\n<\/header>\n<div class=\"entry-content\">\n<p>Yet, as the release points out, \u201cEven so, the federal government continues to enforce extensive registration and data\u2011collection requirements, backed by criminal penalties, that Missouri argues no longer have a valid constitutional justification and conflict with the rights guaranteed by the Second Amendment.\u201d<\/p>\n<p><iframe loading=\"lazy\" class=\"bnn-if-tweet\" src=\"https:\/\/www.breitbart.com\/t\/assets\/html\/tweet-5.html#2097422392163180879\" width=\"560\" height=\"260\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-btlnk=\"https:\/\/x.com\/AGCHanaway\/status\/2097422392163180879\" data-bnewh=\"941px\" data-mce-fragment=\"1\"><\/iframe>&nbsp;<\/p>\n<p>Hanaway said, \u201cLaw and order and the Second Amendment go hand in hand. A government that respects the Constitution has empowered, law\u2011abiding citizens who can protect themselves and their families. It does not paper over rights with red tape.\u201d<\/p>\n<p>She added, \u201cThe ATF\u2019s heavy-handed restrictions on suppressors threaten lawful firearm use and undermine the rights protected by the Second Amendment.\u201d<\/p>\n<p>Hanaway\u2019s case, in which she is joined by plaintiff Dave Marshak, is filed with the United States District Court for the Eastern District of Missouri.<\/p>\n<p>On August 5, 2026, Breitbart News\u00a0<a href=\"https:\/\/www.breitbart.com\/2nd-amendment\/2026\/08\/05\/plaintiffs-secure-ruling-nfa-registration-is-unconstitutional\/\">noted<\/a>\u00a0that plaintiffs in the case brought by Silencer Shop, Palmetto State Armory, and others, secured a ruling that the suppressor registration requirements were unconstitutional.
