{"id":119393,"date":"2026-10-24T16:13:57","date_gmt":"2026-10-24T21:13:57","guid":{"rendered":"https:\/\/milesfortis.com\/?p=119393"},"modified":"2026-10-24T16:13:57","modified_gmt":"2026-10-24T21:13:57","slug":"119393","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=119393","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/san.com\/media-miss\/us-switchblade-law-violates-second-amendment-appeals-court-says\/\" target=\"_blank\" rel=\"noopener\">US switchblade law violates Second Amendment, appeals court says<\/a><\/p>\n<p class=\"wp-block-paragraph\">A federal appeals court said in a ruling Wednesday that the U.S. restrictions on switchblades are <a id=\"https:\/\/news.bloomberglaw.com\/us-law-week\/federal-switchblade-ban-is-unconstitutional-fifth-circuit-rules\" href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/federal-switchblade-ban-is-unconstitutional-fifth-circuit-rules\" target=\"_blank\" rel=\"noopener noreferrer\" type=\"link\">unconstitutional.<\/a><\/p>\n<p class=\"wp-block-paragraph\">Under the <a id=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/25\/25-10754-CV0.pdf\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/25\/25-10754-CV0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" type=\"link\">Federal Switchblade Act,<\/a> it is illegal to sell, transport or manufacture the knives across state lines.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe determine that switchblade knives qualify as \u2018Arms\u2019 and are covered by the \u2018plain text\u2019 of\u00a0 the Second Amendment,\u201d U.S. Circuit Judge Jennifer Walker Elrod <a id=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/25\/25-10754-CV0.pdf\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/25\/25-10754-CV0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" type=\"link\">wrote in the ruling<\/a>. \u201cBecause the regulation implicates the amendment, the government bears the burden of establishing that the FSA comports with well-established principles of the Second Amendment and its regulatory tradition.
