{"id":63512,"date":"2021-01-03T00:18:50","date_gmt":"2021-01-03T06:18:50","guid":{"rendered":"https:\/\/milesfortis.com\/?p=63512"},"modified":"2021-01-03T00:18:50","modified_gmt":"2021-01-03T06:18:50","slug":"63512","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=63512","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.deseret.com\/utah\/2021\/1\/2\/22205108\/gun-laws-conceal-concealed-carry-permit-constitutional-legislature-violence-lawmakers-2nd-amendment\">Will Utah become the next state to drop concealed carry permit?<\/a><\/p>\n<p id=\"cZmnFt\">A Utah lawmaker is furthering his bid to make Utah the next state to allow concealed carrying of firearms without a permit.<\/p>\n<p id=\"d98fiE\">And in case that doesn\u2019t work, another lawmaker is looking to suspend that permit requirement amid a declared state of emergency \u2014 whether that be for an earthquake, a flood and, yes, a pandemic.<\/p>\n<p id=\"UwPw3W\">Rep. Walt Brooks, R-St. George, is sponsoring\u00a0<a href=\"https:\/\/le.utah.gov\/~2021\/bills\/static\/HB0060.html\">HB60<\/a>\u00a0in the\u00a0<a href=\"https:\/\/www.deseret.com\/utah\/2020\/3\/15\/21175823\/gun-rights-second-amendment-red-flag-laws-legislature-holds-bills-frustrating-advocates-on-all-sides\">Utah Legislature\u2019s<\/a>\u00a0upcoming 2021 general session, set to begin Jan. 19. The bill\u2019s language mirrors legislation he\u00a0<a href=\"https:\/\/www.deseret.com\/utah\/2020\/3\/5\/21166410\/carry-concealed-gun-utah-lawmaker-unveils-bill-to-drop-need-for-permit\">filed in the final days of the 2020 session<\/a>, which would remove the state\u2019s requirement for law-abiding Utahns over the age of 21 to have a permit to lawfully carry a concealed firearm.<\/p>\n<p id=\"R6k7Xn\">\u201cEvery single person has the right to protect themselves,\u201d Brooks said, arguing that right should extend to people uncomfortable with openly carrying firearms. \u201cIt\u2019s allowing a law-abiding citizen to be allowed (to put their gun) under their jacket or a wife to put it in her purse.\u201d<\/p>\n<p id=\"flvqyE\">Currently, 16 states allow concealed carrying of firearms without a permit: Alaska, Arizona, Arkansas, Idaho, Kansas, Kentucky, Maine, Mississippi, Missouri, New Hampshire, Oklahoma, South Dakota, Vermont, West Virginia, North Dakota (residents only) and Wyoming (residents only). Four others allow permitless concealed carry with certain limitations: Illinois, Montana, New Mexico and Washington.<\/p>\n<p><!--more--><\/p>\n<p id=\"YoGMMf\">Utah law currently allows people who are legally able to possess a firearm to openly carry their guns in public. A permit is only required for carrying a concealed firearm.<\/p>\n<p id=\"JCrDBT\">Brooks said he\u2019s confident his bill will win the support it needs to become law \u2014 from both the Legislature and Gov.-elect Spencer Cox.<\/p>\n<p id=\"p0xtoL\">\u201cBoth Gov.-elect Cox and Lt. Gov.-Elect (Deidre) Henderson have said they would support a constitutional carry bill and look forward to working with the sponsors on the details,\u201d Cox\u2019s spokeswoman, Jennifer Napier-Pearce, said in a text Wednesday.<\/p>\n<p id=\"0CpOQh\">In 2013\u00a0<a href=\"https:\/\/www.deseret.com\/2013\/3\/22\/20449775\/gov-gary-herbert-vetoes-constitutional-carry-bill#gov-gary-herbert-speaks-to-the-media-about-his-decision-to-veto-house-bill-76-which-would-give-utahns-the-right-to-carry-a-concealed-weapon-without-a-permit-on-friday-march-22-2013\">Gov. Gary Herbert vetoed a similar bill<\/a>, at the time arguing Utah\u2019s permitting system \u201chas been in place for decades, and in its current form for more than 15 years. In that time, it has become a national model.\u201d<\/p>\n<p id=\"D6S5zg\">But since then, Brooks said studies have shown concealed carry permit laws don\u2019t have an impact on violence or crime. After four years of grappling with the issue, he said he\u2019s ready to make the case that Utah should do away with the concealed carry permit requirement altogether.<\/p>\n<p id=\"x2g29Q\">\u201cThis is really not a left and right issue,\u201d Brooks said. \u201cThis is just a good data issue.\u201d<\/p>\n<p id=\"9ZyvnO\">Brooks pointed specifically to a\u00a0<a href=\"https:\/\/www.journalacs.org\/article\/S1072-7515(18)32074-X\/pdf\">2019 study by the Journal of the American College of Surgeons<\/a>, which found state level concealed carry laws had no impact over 30 years, from 1986 to 2015, on homicide, violent crime and public health indicators.<\/p>\n<p id=\"Bu7wDL\">\u201cSo basically it does no good to take away someone\u2019s right to carry,\u201d Brooks said. \u201cThey see no difference.\u201d<\/p>\n<p id=\"btXKF6\">Rep. Cory Maloy, R-Lehi, hopes Brooks\u2019 bill wins approval, but he\u2019s also running a more targeted bill,\u00a0<a href=\"https:\/\/le.utah.gov\/~2021\/bills\/static\/HB0061.html\">HB61<\/a>, to suspend the concealed carry permit requirement during a declared state of emergency. If Brooks\u2019 bill passes, it will make Maloy\u2019s bill moot. But Maloy said he\u2019s still sponsoring the legislation in case Brook\u2019s bill doesn\u2019t succeed, arguing it would allow Utahns to exercise their Second Amendment rights discreetly amid times of fear and uncertainty.<\/p>\n<aside id=\"EhqtZD\">\n<div class=\"c-read-more\">\n<blockquote><p><span style=\"font-size: 16px; font-weight: 400;\">\u201cEspecially in the early days of the pandemic, we were having shortages all over the place. People were feeling very unsure, very nervous about their ability to provide for their families and their safety,\u201d Maloy said, pointing to hoarding of cleaning supplies, toilet paper and ammunition as indicators that Utahns and Americans had \u201cgreat concern for their persons and their families.\u201d<\/span><\/p><\/blockquote>\n<\/div>\n<\/aside>\n<p id=\"h5bcNz\">So whether that\u2019s in the wake of an earthquake that fractures Utah\u2019s infrastructure \u2014 or amid a pandemic that disrupts everyday life \u2014 Maloy said Utahns should be able to legally carry their guns, regardless whether that firearm is out in the open or under a jacket.<\/p>\n<p id=\"V9fBCh\">\u201cPeople should be able to exercise that right in a time when people may be scared or feeling insecure or in danger,\u201d Maloy said.<\/p>\n<p id=\"xprwph\">The bills are expected to meet their fair share of pushback on Capitol Hill from those who have been pushing Utah for\u00a0<a href=\"https:\/\/www.deseret.com\/opinion\/2019\/10\/13\/20908386\/what-can-really-be-done-about-gun-control-red-flag-laws-legislation-shootings\">more gun restrictions<\/a>, not less.<\/p>\n<p id=\"viyeAE\">\u201cWe are living through a gun violence crisis in America, and some politicians in Utah not only don\u2019t seem to care about it, they are running bills that will make it more likely that people will shoot each other,\u201d said Katie Matheson, spokeswoman for the left-leaning Alliance for a Better Utah. \u201cWe shouldn\u2019t wait until we have a crisis in Utah. We need our representatives to wake up \u2014 these bills are tragedies waiting to happen.\u201d<\/p>\n<aside id=\"o5IHm9\">\n<div class=\"c-read-more\">\n<p><span style=\"font-size: 16px; font-weight: 400;\">Brooks said he\u2019s positive removing the concealed carry permit requirement won\u2019t make any difference of gun violence in Utah. \u201cThere have been plenty of states with plenty of years of experience and plenty of study showing this is a good safe policy.\u201d<\/span><\/p>\n<\/div>\n<\/aside>\n<p id=\"7DLi7c\">Brooks said he \u201chas to chuckle\u201d when people express concerns about doing away with the concealed carry class Utahns are required to take in order to obtain the permit, saying those who question whether that\u2019s a good idea \u201chave never taken that course.\u201d<\/p>\n<p id=\"X3YGhD\">\u201cIt doesn\u2019t teach you how to use a weapon,\u201d he said, arguing it\u2019s up to individual responsibility to learn how to operate a gun safely before carrying one. \u201cOur laws should balance personal responsibility with wisdom and reason. And it should across the board. Why do we need so many regulations? This person should be responsible for their actions, and when people make mistakes, then they\u2019re liable.\u201d<\/p>\n<aside id=\"A8jMRh\">\n<div class=\"c-read-more\">\n<p><span style=\"font-size: 16px; font-weight: 400;\">Clark Aposhian, Utah Shooting Sports Council chairman, said the bill wouldn\u2019t be a \u201chuge leap\u201d but rather a \u201ctiny, tiny step in the permissibility of carrying a gun.\u201d He called it a \u201ccommonsense carry\u201d bill, and one that would bring more logic to Utah\u2019s current gun laws.<\/span><\/p>\n<\/div>\n<\/aside>\n<p id=\"Yj99WC\">\u201cIt\u2019s not like we\u2019re venturing out into something that no other state has done,\u201d Aposhian said, also citing other state data about no impact on crime or violence. \u201cI seriously doubt Utahns in general &#8230; will notice any change whatsoever in their day-to-day life with this.\u201d<\/p>\n<p id=\"s8ljBS\"><a href=\"https:\/\/www.deseret.com\/utah\/2020\/11\/27\/21515321\/pink-pistols-salt-lake-city-lgbtq-pro-gun-2nd-amendment-trans-deaths-hate-crime-southern-poverty-law\">Ermiya Fanaeian<\/a>, who co-founded the Utah chapter of March for Our Lives before she\u00a0<a href=\"https:\/\/www.deseret.com\/utah\/2020\/11\/27\/21515321\/pink-pistols-salt-lake-city-lgbtq-pro-gun-2nd-amendment-trans-deaths-hate-crime-southern-poverty-law\">reopened the Salt Lake Chapter of the Pink Pistols<\/a>, a pro-gun, pro-LGBTQ group, said she thinks both bills \u201cdo indeed keep the values of the Second Amendment in mind and in many ways are keeping an idea of how to remove bureaucratic procedure that makes accessing protection inaccessible for everyday Utahns.\u201d<\/p>\n<p id=\"REw2PS\">\u201cHowever, with this in mind we also understand the need of concealed carry permits and why they were introduced to begin with,\u201d Fanaeian said. \u201cAnd those concerns are still very much valid today.\u201d<\/p>\n<aside id=\"VashRK\">\n<div class=\"c-read-more\">\n<h4><a href=\"https:\/\/www.deseret.com\/utah\/2020\/11\/27\/21515321\/pink-pistols-salt-lake-city-lgbtq-pro-gun-2nd-amendment-trans-deaths-hate-crime-southern-poverty-law\" data-analytics-link=\"readmore\">How a Utah gun control advocate changed her mind and launched a pro-gun group<\/a><\/h4>\n<\/div>\n<\/aside>\n<p id=\"cOI0fk\">Fanaeian said she would like to see the bills \u201calso introduce initiatives that would address these concerns in more impactful ways,\u201d including funding for community programs encouraging widespread gun safety.<\/p>\n<p id=\"WLamSs\">\u201cI hope any legislative initiative to make guns more accessible would also be followed with this as well,\u201d she said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Will Utah become the next state to drop concealed carry permit?
