Mike DeWine signs \u2018stand your ground\u2019 bill<\/a><\/p>\n<div class=\"InContent_Center_Background\">\n<div class=\"InContent_Center_Padding\">\n<div id=\"InContent_Center_7WZJ7RGGDZHXNCUJJMS4I5XRSE\" class=\"ad-observer\">\n<p>COLUMBUS, Ohio\u2014Gov. Mike DeWine on Monday signed a controversial \u201cstand your ground\u201d bill that would eliminate Ohio\u2019s \u201cduty to retreat\u201d before using force in self-defense.<\/p>\n<p>Senate Bill 175, fast-tracked through the Ohio General Assembly last month by DeWine\u2019s fellow Republicans, will make Ohio the 36th state to no longer require people to retreat before they can justifiably hurt or kill someone in self-defense.<\/p>\n<p>The governor had previously hinted that he would veto SB175, saying he first wanted lawmakers to pass his package of gun reforms that they sat on for more than a year. But in a release sent Monday afternoon, the governor stated that the measure removes an \u201cambiguity in Ohio\u2019s self-defense law.\u201d<\/p>\n<p>\u201cI have always believed that it is vital that law-abiding citizens have the right to legally protect themselves when confronted with a life-threatening situation,\u201d DeWine said in a statement. The governor added that he signed the bill in a \u201cspirit of cooperation\u201d with the newly seated 134th Ohio General Assembly.<\/p>\n<p>Until now, under Ohio law, people have been justified in using deadly force in self-defense so long as they aren\u2019t the aggressor, believe they are in imminent danger of death or great bodily harm, and are in their home or vehicle. The new law, which takes effect in 90 days, removes the \u201chome or vehicle\u201d requirement, and instead states that the defendant need only be in a place where they lawfully have the right to be.<\/p>\n<p>Proponents of the measure say it gives law-abiding citizens the right to protect themselves. The Buckeye Firearms Association said in a release that DeWine promised them and other gun-rights groups multiple times that he would sign such a bill.<\/p>\n<p>\u201cWhile this bill changes one technicality in Ohio law, it does not change the near universal and well-established standard for use of lethal force, nor does it give criminals a free pass to commit violent crime,\u201d Buckeye Firearms said in a statement.<\/p>\n<p>\u201cCrimes can happen quickly and without warning. Most victims have a split second to react with the best course of action for their survival,\u201d said John Weber, Ohio state director for the National Rifle Association Institute for Legislative Action, in a statement. \u201cBy signing SB 175, Gov. DeWine ensures the law favors victims and not criminals.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p><!--more--><\/p>\n<div class=\"InContent_Center_Background\">\n<div class=\"InContent_Center_Padding\">\n<div id=\"InContent_Center_BOIFI5D7J5BNPMP2PGL7YUX2C4\" class=\"ad-observer\"><\/div>\n<\/div>\n<\/div>\n<p id=\"VJFHCPZCY5HSXK5L3L5TVVUZAQ\" class=\"article__paragraph article__paragraph--left\">But Democrats, along with some Senate Republicans, have\u00a0<a href=\"https:\/\/www.cleveland.com\/open\/2020\/12\/ohio-house-passes-stand-your-ground-bill-after-emotional-debate.html\">sharply criticized the bill<\/a>, saying (among other things) that it would result in more violence and death &#8212; particularly against minorities.<\/p>\n<div class=\"InContent_Center_Background\">\n<div class=\"InContent_Center_Padding\">\n<div id=\"InContent_Center_VJFHCPZCY5HSXK5L3L5TVVUZAQ\" class=\"ad-observer\">\u201cOnly cowards would pass and sign a bill that has been proven to disproportionately harm Black people,\u201d said House Minority Leader Emilia Sykes, an Akron Democrat, in a statement. \u201cOnly cowards would support a bill that allows people to shoot first and ask questions later. The blood of the lives lost from the signing and passage of this bill rest solely on those who supported it.\u201d<\/div>\n<div><\/div>\n<div class=\"ad-observer\">Dayton Mayor Nan Whaley, a Democrat, <a href=\"https:\/\/twitter.com\/nanwhaley\/status\/1346203175901126663\" target=\"_blank\" rel=\"noopener\">said on Twitter<\/a>\u00a0that she \u201ccan\u2019t express\u201d her level of disappointment with DeWine for signing the bill after he pledged to respond to\u00a0<a href=\"https:\/\/www.washingtonpost.com\/nation\/2019\/08\/05\/do-something-dewine-dayton-ohio-mass-shooting-vigil\/\" target=\"_blank\" rel=\"noopener\">public calls for him to \u201cdo something\u201d<\/a>\u00a0against gun violence following a 2019 mass shooting in Dayton.<\/div>\n<\/div>\n<\/div>\n<div class=\"InContent_Center_Background\">\n<div class=\"InContent_Center_Padding\">\n<div id=\"InContent_Center_S47SAMIEOVH3ND77XJREL5RICE\" class=\"ad-observer\"><\/div>\n<\/div>\n<\/div>\n<p id=\"KBXDHYNZ2BCVRA5UAQMLONW7QE\" class=\"article__paragraph article__paragraph--left\">\u201cGov. DeWine has made clear he opposes this dangerous policy, but he once again folded to the extreme elements in his own party,\u201d Whaley stated. \u201c\u2018Our state needs principled leaders who will stand up for what is right &#8212; not what is politically easy.\u201d<\/p>\n<div class=\"InContent_Center_Background\">\n<div class=\"InContent_Center_Padding\">\n<div id=\"InContent_Center_KBXDHYNZ2BCVRA5UAQMLONW7QE\" class=\"ad-observer\">DeWine\u2019s gun-reform plan, which <a href=\"https:\/\/nam01.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.cleveland.com%2Fopen%2F2019%2F08%2Fgov-mike-dewine-calls-for-gun-background-checks-red-flag-law-in-wake-of-dayton-mass-shooting.html&amp;data=02%7C01%7CLJohnston%40cleveland.com%7Cf5e0ac7448794be2a6ee08d7fce87f80%7C1fe6294574e64203848fb9b82929f9d4%7C0%7C0%7C637255947804672238&amp;sdata=m2estZ3PgfifLJ2Ka%2BTubhHt7doG7rjyS1cMotaEtEg%3D&amp;reserved=0\">he proposed after the Dayton shooting<\/a>, would create a voluntary state-level background check process for gun sales between private sellers and expand the state\u2019s existing \u201cpink-slip\u201d law to allow authorities to send people with drug or alcohol problems to a psychiatric hospital, where they cannot legally have access to guns. The governor has also asked state lawmakers to toughen state penalties for a number of gun-related crimes.<\/div>\n<\/div>\n<\/div>\n<div class=\"InContent_Center_Background\">\n<div class=\"InContent_Center_Padding\">\n<div id=\"InContent_Center_QUV6VWTTJBCR5ADHFU4ZERXEA4\" class=\"ad-observer\"><\/div>\n<\/div>\n<\/div>\n<p id=\"DM7HVEJ4IBAWVPYNH6F6J7FJWU\" class=\"article__paragraph article__paragraph--left\">Republican lawmakers wrapped up their session last month without taking any action on any of those proposals. Newly elected Ohio Senate President Matt Huffman, a Lima Republican, was lukewarm about the future of DeWine\u2019s gun plan when talking with reporters Monday.<\/p>\n<p class=\"article__paragraph article__paragraph--left\">\u201cI do think that there\u2019s an opportunity to look at some of the issues that the governor brought up in his bill, or the bill that was introduced on his behalf, and to talk about some of the Second Amendment issues,\u201d Huffman said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ohio Gov.
