{"id":64510,"date":"2021-02-04T03:19:20","date_gmt":"2021-02-04T09:19:20","guid":{"rendered":"https:\/\/milesfortis.com\/?p=64510"},"modified":"2021-02-04T03:19:20","modified_gmt":"2021-02-04T09:19:20","slug":"64510","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=64510","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.stltoday.com\/news\/local\/govt-and-politics\/plan-to-invalidate-federal-gun-laws-wins-approval-in-missouri-house\/article_92beddbb-3b72-5d0b-b5ea-38f1950417d6.html\">Plan to invalidate federal gun laws wins approval in Missouri House<\/a><\/p>\n<div class=\"row lee-text-row\">\n<div class=\"col-md-8 fixed-col-left main-content\">\n<div class=\"lee-article-text first-p\">\n<p>JEFFERSON CITY \u2014 The Missouri House on Wednesday gave first-round approval to a proposal that would prevent local law enforcement from enforcing federal gun laws that aren\u2019t on the books in Missouri.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>The \u201cSecond Amendment Preservation Act,\u201d sponsored by Rep.\u00a0<a href=\"https:\/\/www.house.mo.gov\/MemberDetails.aspx?district=139&amp;year=2020&amp;code=R\" target=\"_blank\" rel=\"noopener\">Jered Taylor<\/a>, R-Nixa, seeks to invalidate federal laws or other actions deemed to infringe on a person\u2019s Second Amendment right to bear arms.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Lawmakers approved the proposal Wednesday on a 107-43 vote.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p><!--more--><\/p>\n<div class=\"row lee-text-row\">\n<div class=\"col-md-8 fixed-col-left main-content\">\n<div class=\"lee-article-text\">\n<p>Under the original version of Taylor\u2019s measure, individual officers would be held liable if they were found to knowingly enforce or attempt to enforce federal gun laws nullified in Missouri.<\/p>\n<\/div>\n<div class=\"hidden-print asset-breakout-container \">An amendment by Taylor, and approved by the House, struck an officer\u2019s individual liability, instead allowing people to sue individual police departments if they infringe upon their rights, with a minimum fine of $50,000.<\/div>\n<div class=\"hidden-print asset-breakout-container \"><\/div>\n<div class=\"lee-article-text\">\n<p>\u201cIt would be against the department rather than the individual,\u201d Taylor said.<\/p>\n<\/div>\n<div id=\"tncms-region-article_instory_top\" class=\"tncms-region hidden-print\">\n<div id=\"tncms-block-891462\" class=\"tncms-block\">Rep. <a href=\"https:\/\/www.house.mo.gov\/MemberDetails.aspx?year=2021&amp;code=R&amp;district=080\" target=\"_blank\" rel=\"noopener\">Peter Merideth<\/a>, D-St. Louis, said this amounted to defunding the police \u2014 a slogan Republicans used against Democrats during the 2020 campaign.<\/div>\n<\/div>\n<div class=\"lee-article-text\">\n<p>\u201cIn other words, if we don\u2019t like the way a department is behaving, we should defund the police,\u201d Merideth said in summarizing Taylor\u2019s amendment.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p>\u201cWe\u2019re not preventing those funds from going to the department,\u201d Taylor said.<\/p>\n<div class=\"row lee-text-row\">\n<div class=\"col-md-8 fixed-col-left main-content\">\n<div class=\"lee-article-text\">\n<p>Local law enforcement has voiced concerns the measure could imperil their efforts to collaborate with federal agents through crime task forces. It is unclear whether edits to the measure Wednesday will convince law enforcement groups to support the measure.<\/p>\n<p>Rep. <a href=\"https:\/\/www.house.mo.gov\/MemberDetails.aspx?year=2021&amp;code=R&amp;district=079\" target=\"_blank\" rel=\"noopener\">LaKeySha Bosley<\/a>, D-St. Louis, said there was a statement from Greene County Sheriff Jim C. Arnott, circulating among lawmakers, that criticizes the bill.<\/p>\n<\/div>\n<div class=\"hidden-print asset-breakout-container \">\u201cWe need state laws that will make it easier to keep our communities safe, not those that have unintended consequences and silence law enforcement officials,\u201d the statement says.<\/div>\n<div class=\"hidden-print asset-breakout-container \"><\/div>\n<div class=\"lee-article-text\">\n<p>Attorney General Eric Schmitt, a Republican who has emphasized collaborating with federal agents to fight violent crime, did not voice an opinion on the legislation when the Senate took up a similar measure last month. His spokesman again declined to comment on Wednesday.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>The measure still requires a final House vote before advancing to the Senate for consideration.<\/p>\n<p>Gov. Jay Nixon, a Democrat, vetoed a similar measure in 2013. More recent attempts to invalidate federal gun laws sputtered during President Donald Trump\u2019s administration.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"row lee-text-row\">\n<div class=\"col-md-8 fixed-col-left main-content\">\n<div class=\"lee-article-text\">\n<p>But with Democratic President Joe Biden in the White House, and Democrats in control of Congress, multiple Republicans worried about potential federal firearm restrictions that have yet to be enacted.<\/p>\n<\/div>\n<div class=\"hidden-print asset-breakout-container subscriber-ad\">Debate follows <a href=\"https:\/\/www.stltoday.com\/news\/local\/crime-and-courts\/st-louis-homicide-rate-in-2020-highest-in-50-years-with-262-killings\/article_b3c323a7-bc38-55bc-812b-08990b0eb289.html\" target=\"_blank\" rel=\"noopener\">an extremely bloody year in the city of St. Louis<\/a>\u00a0with 262 killings and a record homicide rate.<\/div>\n<div class=\"hidden-print asset-breakout-container \"><\/div>\n<div class=\"lee-article-text\">\n<p>Democrats sent out a news release during debate on the nullification measure touting the party\u2019s \u201csolutions to rampant Missouri gun violence.\u201d<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Among the proposals is one requiring people to report lost or stolen firearms, one requiring firearm sellers to verify the age of buyers and a third bill allowing localities to issue their own firearm rules.<\/p>\n<\/div>\n<div class=\"hidden-print asset-breakout-container subscriber-ad\">Passage of the measures is unlikely in the GOP-controlled Legislature.<\/div>\n<div class=\"lee-article-text\">\n<p>Taylor\u2019s legislation is\u00a0<a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HB85&amp;year=2021&amp;code=R\" target=\"_blank\" rel=\"noopener\">House Bills 85 and 310<\/a><em>.<\/em><\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Plan to invalidate federal gun laws wins approval in Missouri House JEFFERSON CITY \u2014 The Missouri House on Wednesday gave first-round approval to a proposal that would prevent local law enforcement from enforcing federal gun laws that aren\u2019t on the books in Missouri.
