{"id":65736,"date":"2021-03-12T07:01:27","date_gmt":"2021-03-12T13:01:27","guid":{"rendered":"https:\/\/milesfortis.com\/?p=65736"},"modified":"2021-03-12T07:01:27","modified_gmt":"2021-03-12T13:01:27","slug":"65736","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=65736","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/americanmilitarynews.com\/2021\/03\/bill-expanding-new-mexicos-red-flag-gun-law-fizzles\/\">Bill expanding New Mexico\u2019s \u2018red-flag\u2019 gun law fizzles<\/a><\/p>\n<p>A controversial bill to expand New Mexico\u2019s so-called red-flag gun law appears to be a victim of more pressing priorities in this year\u2019s 60-day legislative session.<\/p>\n<p>\u201cFor all intents and purposes, it\u2019s gone, unless something really radical changes,\u201d one of the sponsors, Rep. Daymon Ely, D-Corrales, said Wednesday. \u201cBut there are just too many other priorities this time.\u201d<\/p>\n<p>Ely said he hopes to bring the measure back during the Legislature\u2019s 30-day legislative session next year.<\/p>\n<p>\u201cIt\u2019s a calendar management problem,\u201d he said of the bill\u2019s likely demise this year.<\/p>\n<p>House Bill 193 sought to amend New Mexico\u2019s Extreme Risk Firearm Protection Order Act by adding law enforcement officers to the list of people who could seek a court order to temporarily take firearms from a person considered a threat, among other changes.<\/p>\n<p>Under current law, police officers may only seek a court order if it is requested by a family member, a school official, an employer or someone who has had a \u201ccontinuing personal relationship\u201d with a person considered a threat to themselves or others. The change would allow an officer to seek a court order based on his or her own observations, \u201cabsent receipt of credible information from a reporting party.\u201d<\/p>\n<p><!--more--><\/p>\n<p>The other sponsor, Rep. Joy Garratt, D-Albuquerque, said she, too, looks forward to reintroducing the measure next year.<\/p>\n<p>\u201cWe\u2019ve gotten feedback from the courts and law enforcement that it needs those tweaks, which is why we\u2019re doing them,\u201d she said.<\/p>\n<p>Garratt said concerns about the bill were blown out of proportion.<\/p>\n<p>\u201cIt\u2019s not something that\u2019s going to be used hundreds and hundreds of times as some of the opponents suggested,\u201d she said. \u201cWhen there\u2019s really an imminent risk of somebody harming themselves or harming others with a firearm, that\u2019s what it\u2019s for.\u201d<\/p>\n<p>Ely said \u201cthere is no question\u201d the law \u201cneeds fixing.\u201d<\/p>\n<p>\u201cIn an ordinary session, it probably would be [a priority bill],\u201d he said. \u201cBut this is one where we\u2019re trying to dig out of this economy as quickly as possible and get New Mexico on a really productive track, and I think we\u2019re doing it.\u201d<\/p>\n<p>Miranda Viscoli, co-president of New Mexicans to Prevent Gun Violence, said she was \u201cextremely disappointed\u201d the bill wasn\u2019t considered on the floor of each chamber.<\/p>\n<p>\u201cThis was a crucial amendment that would directly save lives,\u201d she said. \u201cI already know of one suicide that happened because law enforcement couldn\u2019t step in, could not petition [a court].\u201d<\/p>\n<p>Viscoli called the changes \u201csimple amendments\u201d designed to keep New Mexico communities safer from gun violence.<\/p>\n<p>Gun control measures, however, typically generate stiff opposition and hourslong committee and floor debates.<\/p>\n<p>Ely said no one should question his commitment to the red-flag gun law or other gun control legislation.<\/p>\n<p>\u201cI have no problems fighting for it,\u201d he said, adding the priority this year is \u201cfighting for getting New Mexico back to prosperity as quickly as possible.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bill expanding New Mexico\u2019s \u2018red-flag\u2019 gun law fizzles A controversial bill to expand New Mexico\u2019s so-called red-flag gun law appears to be a victim of more pressing priorities in this year\u2019s 60-day legislative session. \u201cFor all intents and purposes, it\u2019s gone, unless something really radical changes,\u201d one of the sponsors, Rep.
