{"id":66364,"date":"2021-03-30T17:19:29","date_gmt":"2021-03-30T23:19:29","guid":{"rendered":"https:\/\/milesfortis.com\/?p=66364"},"modified":"2021-03-30T17:19:29","modified_gmt":"2021-03-30T23:19:29","slug":"66364","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=66364","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.nationalreview.com\/2021\/03\/rahm-emanuel-hey-lets-strip-gun-owners-of-due-process-rights\/\">Rahm Emanuel: Hey, Let\u2019s Strip Gun Owners of Due-Process Rights<\/a><\/p>\n<p><span class=\"article-header__subtitle\">The former Chicago mayor\u2019s big idea is not new \u2014 and not constitutional, either.<\/span><\/p>\n<p><span class=\"drop\">I<\/span><span class=\"small_caps\">n<\/span>\u00a0another case of\u00a0<a href=\"https:\/\/www.nationalreview.com\/corner\/gun-control-polling-is-largely-meaningless\/\" target=\"_blank\" rel=\"noopener\">poll-driven confirmation bias<\/a>, Democrats have overestimated the popularity of their gun-control efforts as another House bill is\u00a0<a href=\"https:\/\/freebeacon.com\/guns\/democrats-face-gun-legislation-dilemma-as-support-for-house-background-check-bill-breaks-down\/\" target=\"_blank\" rel=\"noopener\">reportedly<\/a>\u00a0\u201cdead on arrival\u201d in the Senate.<\/p>\n<p>Alas, the bill didn\u2019t stall because of the\u00a0<a href=\"https:\/\/www.nationalreview.com\/magazine\/2021\/04\/05\/keep-the-senate-filibuster\/\" target=\"_blank\" rel=\"noopener\">infamous filibuster<\/a>\u00a0\u2014 though demanding a 60-vote threshold for legislation predominately aimed at red states shut out of the lawmaking process would be entirely legitimate \u2014 but because moderate Democrats like Joe Manchin and Jon Tester would likely have a difficult time supporting the House efforts. Manchin, who wrote a more modest \u201cuniversal background check bill\u201d a few years ago, represents a state where an estimated\u00a0<a href=\"https:\/\/worldpopulationreview.com\/state-rankings\/gun-ownership-by-state\" target=\"_blank\" rel=\"noopener\">54 percent of households have guns<\/a>. In Montana, the number is over 52 percent.<\/p>\n<p>But Democrat Rahm Emanuel\u00a0<a href=\"https:\/\/www.realclearpolitics.com\/video\/2021\/03\/28\/rahm_emanuel_to_pass_gun_bill_democrats_need_to_focus_on_the_criminals_instead_of_the_guns.html\" target=\"_blank\" rel=\"noopener\">has an idea<\/a>. The only way his party can pass gun-control legislation, he argued on ABC\u2019s\u00a0<em>This Week<\/em> on Sunday, is by focusing less on firearms and more on people. He reasons Democrats should compromise with Republicans by focusing on \u201ccriminals,\u201d \u201cmental health,\u201d and the No-Fly List.<\/p>\n<p><!--more--><\/p>\n<p><span style=\"letter-spacing: 0.13333em; text-transform: uppercase;\">Why the former mayor of crime-ridden Chicago believes that ignoring gunowners\u2019 First, Fourth, Fifth, and Sixth Amendment rights in an effort to strip them of their Second Amendment rights is any kind of compromise remains a great mystery.<\/span><\/p>\n<p>First, Emanuel says anyone with a \u201cdomestic-violence record\u201d should be \u201cbanned from buying a gun.\u201d This is an excellent idea. Also, it is already the law. Owning a gun after a domestic-violence conviction is\u00a0<a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-1117-restrictions-possession-firearms-individuals-convicted\" target=\"_blank\" rel=\"noopener\">illegal<\/a>\u00a0under federal law \u2014 and under numerous state laws. It is legal for the police to take guns when there is \u201creasonable fear of bodily injury\u201d to the partner or child.\u00a0 These regulations are occasionally abused by law enforcement but, at a minimum, there exists a rudimentary due process, rather than arbitrary gun confiscation. We can only deduce, then, that Emanuel means guns should be confiscated from those merely\u00a0<em>accused<\/em>\u00a0of domestic violence by another party.<\/p>\n<aside class=\"ad-unit ad-unit--center ad-unit--inline\">\n<div class=\"ad-unit__inner\">\n<p>Emanuel\u2019s second idea is to ban those with \u201ca mental-health issue, and a relationship and anything on violence on mental health\u201d from buying guns. Another good idea. And again, already the law. It is <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/922\" target=\"_blank\" rel=\"noopener\">illegal<\/a> to sell a firearm or ammunition to any person you know or have reasonable cause to believe \u201chas been adjudicated as a mental defective or has been committed to any mental institution.\u201d<\/p>\n<p>Emanuel is likely talking about red-flag laws that empower the police to confiscate guns from Americans on the strength of a third-party accusation. California, for instance, already has a law (a grossly unconstitutional one, I would argue) that bars anyone who has checked into a mental facility \u2014 even, for say, nervous exhaustion or an addiction problem \u2014 from owning firearms for the rest of their lives. Even if a person shows a preponderance of evidence that he would use firearms in a safe and lawful manner, he may never buy a gun.<\/p>\n<p>Not only do such laws unduly deprive Americans of their rights, but they also stigmatize mental illnesses that have nothing to do with potential violence or criminality. It is also a good way to discourage gun owners who suffer from, say, depression or suicidal thoughts from seeking the help they need.<\/p>\n<p>Yet, Emanuel\u2019s most egregious proposal is \u201cNo Fly, No Buy.\u201d The idea here is to confiscate the guns of American citizens who\u2019ve been arbitrarily placed on various secret government no-fly and watch lists without any probable cause, any assumption of innocence, or any due process.<\/p>\n<\/div>\n<\/aside>\n<p>One can vividly imagine how such lists could be abused by Democrats, who believe the National Rifle Association is a \u201cterrorist organization\u201d and most conservatives are \u201cwhite supremacists.\u201d Emanuel, for instance, said that the \u201cProud Boys are a domestic terrorist group\u201d that would fall under the law. Whatever you think of members of the Proud Boys or Antifa, or whatever group you find most detestable, they are made up of individuals. Emanuel wants to divest adherents of their constitutional rights for thought crimes. That\u2019s not how this works.<\/p>\n<p>\u201cNo Fly, No Buy\u201d is not a new idea. A few years ago, Democrats attempted to pass a similar bill. It was then that Connecticut senator Chris Murphy had despicably\u00a0<a href=\"https:\/\/www.washingtonpost.com\/news\/powerpost\/wp\/2016\/06\/20\/chris-murphy-republicans-have-decided-to-sell-weapons-to-isis\/\" target=\"_blank\" rel=\"noopener\">accused<\/a>\u00a0Republicans, who opposed summarily convicting Americans who were on opaque extrajudicial government lists compiled by a bunch of bureaucrats, of having \u201cdecided to sell weapons to ISIS.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--center ad-unit--inline\">\n<div class=\"ad-unit__inner\">\n<p>These aren\u2019t your parents\u2019 \u201cliberals.\u201d<\/p>\n<\/div>\n<\/aside>\n<p>It\u2019s true, of course, that the majority of the people who are capriciously tagged by law enforcement on these lists are Muslims. Most of the approximately 1 million people on the list don\u2019t even know they\u2019re suspected terrorists, or how to present exculpatory evidence or challenge the designation. Then again, to extricate yourself from the lists is also prohibitively expensive, entailing a convoluted process often beyond the reach of an average citizen.<\/p>\n<p>Back in 2014, the<em>\u00a0Intercept<\/em>\u00a0reported on an \u201cintelligence source\u201d leak that found\u00a0<a href=\"https:\/\/www.techdirt.com\/articles\/20140805\/11295828116\/nearly-40-those-governments-terrorist-watchlist-have-no-affiliation-with-recognized-terrorism-groups.shtml\" target=\"_blank\" rel=\"noopener\">280,000 people<\/a>\u00a0on government lists who were not associated in any way with potential terrorist organizations. Who knows what the number is today. Ponder this scenario: Civil-rights hero John Lewis\u00a0<a href=\"http:\/\/www.cnn.com\/2004\/ALLPOLITICS\/08\/20\/lewis.watchlist\/\" target=\"_blank\" rel=\"noopener\">was once on a no-fly list<\/a>. Does Emanuel believe Lewis deserved to lose all his constitutional rights? Even the ACLU, erstwhile friend of the Constitution, has\u00a0<a href=\"https:\/\/www.aclu.org\/blog\/washington-markup\/use-error-prone-and-unfair-watchlists-not-way-regulate-guns-america\" target=\"_blank\" rel=\"noopener\">\u201cstrongly\u201d argued this step would undermine civil liberties<\/a>.<\/p>\n<p>What Emanuel doesn\u2019t seem to understand is that guns don\u2019t have rights. People do.
