{"id":67469,"date":"2021-05-03T01:12:35","date_gmt":"2021-05-03T06:12:35","guid":{"rendered":"https:\/\/milesfortis.com\/?p=67469"},"modified":"2021-05-03T01:12:35","modified_gmt":"2021-05-03T06:12:35","slug":"67469","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=67469","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/bearingarms.com\/tomknighton\/2021\/04\/29\/desantis-bill-florida-preemption-n44457\">DeSantis Gets Bill To Strengthen Florida Preemption Law<\/a><\/p>\n<p>The state of Florida has been previously referred to as the \u201cGunshine State.\u201d Despite a flurry of bad laws in the wake of Parkland, they tend to be pretty pro-gun. It doesn\u2019t make the post-Parkland idiocy any better, mind you, but it does look like just a blip on the radar.<\/p>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_4\" class=\"gpt-ad ad-250 text-center\">One of the many good laws regarding firearms on the books up that way is their preemption law.<\/div>\n<\/div>\n<p>Now, it looks like lawmakers\u00a0<a href=\"https:\/\/floridapolitics.com\/archives\/424891-legislature-votes-to-widen-scope-of-gun-control-preemption\/\" target=\"_blank\" rel=\"noopener\">want to make that law even better<\/a>.<\/p>\n<blockquote>\n<div class=\"btArticleBody portfolioBody btTextLeft\">\n<div class=\"bt_bb_wrapper\">\n<p>The Legislature has passed a bill further restricting local governments\u2019 ability to pass gun control measures.<\/p>\n<p>The bill (<strong><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2021\/1884\" target=\"_blank\" rel=\"noopener\">SB 1884<\/a><\/strong>) clarifies that existing preemptions on local firearm and ammunition laws also apply to unwritten rules and policies. The legislation would also make clear local governments can\u2019t bypass court cases simply by scrapping gun laws.<\/p>\n<p>Rep.\u00a0<strong>Cord Byrd<\/strong>, a Neptune Beach Republican who has carried the issue in the House, said the Legislature needs to shore up the law because of defiant local officials. He cited multiple examples just this year of local governments passing ordinances despite preemption laws in place since 1987. It\u2019s the same reason in 2011 that the Legislature put in penalties for local officials who vote for local ordinances regardless of state law.<\/p>\n<p>\u201cLocal governments thumbed their nose at this body, thumbed their nose at this Legislature, and said we do not care,\u201d Byrd said.<\/p>\n<p>Rep.\u00a0<strong>Carlos Guillermo Smith,\u00a0<\/strong>an Orlando Democrat, criticized Byrd directly on the bill, saying since Byrd represents gun owners who have sued local governments over such regulations, he stands to profit from this legislation.<\/p>\n<p>Byrd pushed back on that, saying he wants to send a message so strong, governments stop wasting taxpayer money passing laws they have no right to consider.<\/p>\n<p>\u201cI hope I never take another preemption case again,\u201d he said.<\/p>\n<\/div>\n<\/div>\n<\/blockquote>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_5\" class=\"gpt-ad ad-250 text-center\"><\/div>\n<\/div>\n<p>The bill passed the House, 78-39, which isn\u2019t really a surprise.<\/p>\n<p><!--more--><\/p>\n<p>The truth of the matter is that a preemption law has to have teeth if it\u2019s going to be effective. Otherwise, it\u2019s just words on a page, and that\u2019s less than useless in protecting gun rights.<\/p>\n<p>At no point should local governments be making gun control laws when the state says they can\u2019t. Granted, no one should be making gun control laws at all, but that\u2019s especially true when it\u2019s illegal to do so. Further, making it so local governments can\u2019t dodge the ramifications of lawsuits challenging those laws by simply repealing the law.<\/p>\n<p>No, they need to feel the heat they bring down on themselves.<\/p>\n<p>Of course, Rep. Smith wants to make this about Byrd profiting from the law, but if the law has its desired effect, how could he? If it stops communities from trying to create their own gun control laws, then wouldn\u2019t he run out of preemption cases to work? Honestly, if anything, it looks like Byrd is trying to reduce the amount of business he has.<\/p>\n<p>I can respect that.<\/p>\n<p>Just like I can respect any state trying to make damn sure local communities don\u2019t try and cook up their own hare-brained schemes for gun control.<\/p>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_6\" class=\"gpt-ad ad-250 text-center\">The bill now heads to Gov. Ron DeSantis for his signature.
