Whether it\u2019s Governor Andrew Cuomo or Attorney General Fash (Tish) James, they all want the citizenry disarmed and <a href=\"https:\/\/www.msn.com\/en-us\/news\/us\/new-york-ag-tish-james-files-lawsuit-seeking-to-dissolve-nra\/ar-BB17EKid\" target=\"_blank\" rel=\"noopener\">muzzled<\/a>,\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2020\/07\/01\/new-york-city-budget-billion-nypd-defund-police\/5354307002\/\" target=\"_blank\" rel=\"noopener\">police defunded<\/a>, and\u00a0<a href=\"https:\/\/nypost.com\/2021\/04\/21\/new-yorks-bail-laws-keep-putting-criminals-back-out-on-the-street\/\" target=\"_blank\" rel=\"noopener\">violent criminals<\/a>\u00a0<a href=\"https:\/\/nypost.com\/2020\/03\/05\/bail-reform-a-significant-reason-for-crime-spike-nypd-says\/\" target=\"_blank\" rel=\"noopener\">released among<\/a>\u00a0<a href=\"https:\/\/nypost.com\/2020\/02\/24\/support-for-bail-reform-nosedives-in-new-york-new-poll-shows\/\" target=\"_blank\" rel=\"noopener\">the public<\/a>. And if you thought that they can\u2019t possibly do any more damage than what they already did with the NY SAFE Act, you\u2019re absolutely wrong.<\/p>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_4\" class=\"gpt-ad ad-250 text-center\">This Tuesday, NY Democrats held a <a href=\"https:\/\/nynow.wmht.org\/blogs\/criminal-justice\/democrats-seek-new-gun-laws-in-new-york-to-curb-shootings\/\" target=\"_blank\" rel=\"noopener\">news conference calling for more gun control<\/a>. They have proposed several pieces of legislation that will embolden criminals while harassing ordinary people.<\/div>\n<\/div>\n<p><!--more--><\/p>\n<p>One of the proposals (<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/s3347\" target=\"_blank\" rel=\"noopener\">S3347<\/a>) does an end-run around the PLCAA (Protection of\u00a0<i>Lawful<\/i>\u00a0Commerce in Arms Act) by allowing crime victims to sue parties who had nothing to do with the commission of a crime, namely, the firearm manufacturers. There\u2019s a saying in Hindi,\u00a0<i>\u201cKare Kaun, Bhare Kaun,\u201d<\/i>\u00a0which translates to, \u201cOne commits, another remits,\u201d that is used in situations where someone who is not guilty of a misdeed pays the price while the real offender gets away with it. This old Hindi saying is a perfect fit for what New York Democrats are doing.<\/p>\n<p>Another insidious piece of legislation (<a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A07771&amp;term=&amp;Summary=Y&amp;Actions=Y&amp;Committee%26nbspVotes=Y&amp;Memo=Y&amp;Text=Y\" target=\"_blank\" rel=\"noopener\">A07771<\/a>) requires an individual to get a hunting license in order to be able to buy a shotgun or a rifle. California has already attempted this and is currently in court (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.casd.635622\/gov.uscourts.casd.635622.1.0.pdf\" target=\"_blank\" rel=\"noopener\">Jones v. Bonta<\/a>), having been sued by young adults (18-21) whose natural right to keep and bear arms has been made contingent on the acquisition of a hunting license. New York, not to be outdone by California, wants to make this a requirement for\u00a0<i>all<\/i>\u00a0adults, not just those in the 18 to 21 age range. If the Framers had hunting in mind, they would have quilled it down in the text of the Second Amendment, thereby prohibiting a vegetarian like me from keeping and bearing arms.<\/p>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_5\" class=\"gpt-ad ad-250 text-center\">In a throwback to the malevolence of the Jim Crow era with its literacy tests for voting, this bill mandates a five hour gun safety course and exam, and passing a shooting range test with 90% accuracy, which is higher than the <a href=\"https:\/\/twitter.com\/gunpolicy\/status\/1399845714285498381?s=20\" target=\"_blank\" rel=\"noopener\">78% accuracy<\/a>\u00a0<a href=\"https:\/\/archive.is\/21okQ\" target=\"_blank\" rel=\"noopener\">required of New York cops<\/a>.<\/div>\n<\/div>\n<p>Another bill in the New York Assembly (<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a7246\/amendment\/b\" target=\"_blank\" rel=\"noopener\">A7246B<\/a>) \u201crequires persons possessing any firearm to hold a firearms safety certificate.\u201d From the text of the bill, there doesn\u2019t appear to be any grandfathering clause either (not that it would make the bill any better). This is a willful burden created to harass gun owners, the process itself being the punishment for the alleged sin of gun ownership.<\/p>\n<p>Of course, any safety course and exam will come with a \u201cfee\u201d which is a reanimation of the Jim Crow poll tax for an enumerated right. Democrats love to throw around \u201cdisparate impact\u201d when talking about the outcome of legislation, but are intentionally laying down the framework for such disparate impact, demanding that the working poor of every race spend several hours and hundreds of dollars to obey Democrat diktats.<\/p>\n<p>The most dangerous aspect of\u00a0<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a7246\/amendment\/b\" target=\"_blank\" rel=\"noopener\">A7246B<\/a>\u00a0is that the state will keep a record of who has a firearms safety certificate, which is a de facto registry of gun owners. (Currently, only handguns and \u201cassault weapons\u201d are required to be registered with the state.) Such a registry is guaranteed to be abused in the future both during\u00a0<a href=\"https:\/\/www.nydailynews.com\/new-york\/newspaper-handgun-permit-map-draws-criticism-article-1.1227606\" target=\"_blank\" rel=\"noopener\">times of peace<\/a>\u00a0and\u00a0<a href=\"https:\/\/bearingarms.com\/tomknighton\/2017\/09\/06\/governor-virgin-islands-orders-gun-confiscation-ahead-irma-n30792\" target=\"_blank\" rel=\"noopener\">unrest<\/a>.<\/p>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_6\" class=\"gpt-ad ad-250 text-center\">And it doesn\u2019t end there! <a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A07771&amp;term=&amp;Summary=Y&amp;Actions=Y&amp;Committee%26nbspVotes=Y&amp;Memo=Y&amp;Text=Y\" target=\"_blank\" rel=\"noopener\">A07771<\/a>\u00a0also requires prospective gun owners to \u201cprovide notarized proof of a passed drug test and mental health evaluation.\u201d Most mentally ill people are not violent and non-mentally ill people can turn violent. What\u2019s the next step in the process? Allowing a crime victim to sue a psychologist who provided the approval for an individual who turns violent, thereby making sure that no psychologist ever signs off on a firearm purchase? (I bet it is. Remember when\u00a0<a href=\"https:\/\/www.bbc.com\/news\/world-europe-20025626\" target=\"_blank\" rel=\"noopener\">seismologists got convicted in Italy<\/a>\u00a0for failing to predict an earthquake?)<\/div>\n<\/div>\n<p>The drug use certification is preposterous for a couple of reasons. First of all, narcotics are outlawed, and it hasn\u2019t dawned upon these legislative geniuses that banning something or making it harder to obtain only mushrooms a thriving black market. Secondly, New York Democrats have made\u00a0<a href=\"https:\/\/www.nytimes.com\/2016\/03\/23\/nyregion\/fighting-heroin-ithaca-looks-to-injection-centers.html\" target=\"_blank\" rel=\"noopener\">ridiculous proposals<\/a>\u00a0to give syringes and other drug paraphernalia to drug addicts. Clearly, the irony of demanding a drug test while aiding and abetting drug consumption with public money is lost on them.<\/p>\n<p>My state is a pathetic mess. Not a day goes by when I don\u2019t dream of moving away to a freedom-respecting, low-tax state. But I am, as of this writing, staying here to fight. I urge the readers of this article to alert your New Yorker friends and have them\u00a0<a href=\"https:\/\/nyassembly.gov\/mem\/search\/\" target=\"_blank\" rel=\"noopener\">contact their Assembly Members<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.nysenate.gov\/find-my-senator\" target=\"_blank\" rel=\"noopener\">State Senators<\/a>\u00a0to make sure they know that these bills are oppressive and idiotic.<\/p>\n<div class=\"my-4\">\n<div id=\"div-gpt-300x250_7\" class=\"gpt-ad ad-250 text-center\">In the long run, if Bill of Rights aficionados want to save our freedoms, we need to stop playing defense in the courts and start playing offense culturally. That means taking non-gun owners to the range (assuming you can find ammo these days). The pandemic and riots last year have led to a sudden increase in the number of gun owners, but that\u2019s not enough, especially in a state like New York.
