Erik Jaffe, an attorney for Schaerr Jaffe who represents the Firearms Policy Coalition, which\u00a0<a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2021\/10\/FPC-guns-nysrpa-amicus.pdf\">submitted a brief<\/a>\u00a0in this case, said people treat Second Amendment rights differently because they are afraid of\u00a0<a href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11145&amp;pri=21153&amp;pw=275597&amp;mi=16393&amp;url=https%3A%2F%2Fwww.guns.com%2F\" rel=\"ugc\">guns<\/a>.\u00a0<\/em><\/p>\n<p><em>\u201cLet\u2019s ask the question, are they being consistent in how they apply constitutional principles to that right,\u201d Jaffe said in a phone call. \u201cI understand they don\u2019t like the right and I understand people are terrified of\u00a0<a href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11145&amp;pri=21153&amp;pw=275597&amp;mi=16393&amp;url=https%3A%2F%2Fwww.guns.com%2F\" rel=\"ugc\">guns<\/a>, I get that. \u2026 People are terrified of all kinds of things, yet if it were speech, we would never, never let courts get away with what they\u2019ve gotten away with in New York and California.\u201d\u00a0<\/em><\/p>\n<p><em>Yet\u00a0<a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2021\/10\/nysrpa-cruz-amicus-brief.pdf\">another brief in the case<\/a>\u00a0was filed by\u00a0Texas Senator Ted Cruz and 24 fellow Republicans including Minority Leader Mitch McConnell, who take an originalist view that individuals should be able to carry\u00a0<a href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11145&amp;pri=21153&amp;pw=275597&amp;mi=16393&amp;url=https%3A%2F%2Fwww.guns.com%2F\" rel=\"ugc\">guns<\/a> in public because the framers of the constitution said so.\u00a0<\/em><\/p>\n<p><em>\u201cThe inclusion of an individual right in the Constitution reflects the Framers\u2019 determination not only that the benefits of guaranteeing that right outweigh the costs, but that no future legislature\u2014 including Congress\u2014should have the ability to second-guess that determination,\u201d their brief states.\u00a0<\/em><\/p>\n<p><em>The senators\u2019 brief argues the framers understood the\u00a0<a title=\"This is an affiliate ad link.\" href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11297&amp;pri=9659&amp;pw=275597&amp;mi=16365&amp;url=https%3A%2F%2Fwethepeopleholsters.com%2F\" target=\"_blank\" rel=\"noopener ugc,nofollow\">gun<\/a>\u00a0violence risks posed by the carrying of\u00a0<a href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11145&amp;pri=21153&amp;pw=275597&amp;mi=16393&amp;url=https%3A%2F%2Fwww.guns.com%2F\" rel=\"ugc\">guns<\/a>\u00a0and decided to allow it anyway so the court should follow that precedent despite arguments that allowing more\u00a0<a href=\"https:\/\/www.avantlink.com\/click.php?tt=ale&amp;ti=11145&amp;pri=21153&amp;pw=275597&amp;mi=16393&amp;url=https%3A%2F%2Fwww.guns.com%2F\" rel=\"ugc\">guns<\/a>\u00a0on the streets leads to more gun\u00a0violence.
