{"id":77700,"date":"2022-02-19T16:19:09","date_gmt":"2022-02-19T22:19:09","guid":{"rendered":"https:\/\/milesfortis.com\/?p=77700"},"modified":"2022-02-19T16:19:09","modified_gmt":"2022-02-19T22:19:09","slug":"77700","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=77700","title":{"rendered":""},"content":{"rendered":"<p>Reading through the <em>Heller<\/em> SCOTUS decision, these mandatory &#8216;safe storage&#8217; bills like this one are all unconstitutional.<\/p>\n<hr \/>\n<p><a href=\"https:\/\/bearingarms.com\/john-petrolino\/2022\/02\/19\/storage-bill-a-litigation-and-laundering-scheme-in-disguise-n55617\">Storage bill a litigation and laundering scheme in disguise<\/a><\/p>\n<p>So-called \u201csafe storage\u201d of firearms is a serious matter, however it\u2019s been greatly politicized. The term \u201csafe storage\u201d needs to be replaced by the more applicable term \u201cresponsible storage&#8221;. Trying to cram the individual storage needs of every American into a statutory definition is impossible. What gun owners know and somehow escapes the anti-freedom caucus, the storing of a firearm might be \u201csafe\u201d in one home or location, but not necessarily \u201csafe\u201d in another. Just like the ignorant and obtuse opinions of our congresscritters who trend left of center are varied, so are the needs of gun owners. There\u2019s no one size fits all solution to the storage debate.<\/p>\n<p>On February 8, 2022 Congressman Andy Levin from Michigan\u00a0<a href=\"https:\/\/andylevin.house.gov\/media\/press-releases\/levin-unveils-bill-reduce-firearm-deaths-children\" target=\"_blank\" rel=\"noopener\">introduced<\/a>\u00a0a new so-called \u201csafe storage\u201d bill, but in reality it seems to be a cloaked effort to open the doors for litigation against gun owners, and create a grant program to siphon funds into schools that subscribe to the pinko \u201cshall always be locked up\u201d mentality. On\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/6639?r=64&amp;s=1\" target=\"_blank\" rel=\"noopener\">H.R.6639 \u2013 Protect Children Through Safe Gun Ownership Act<\/a>:<\/p>\n<blockquote><p>Congressman Andy Levin (MI-09), member of the House Education and Labor Committee and the Gun Violence Prevention Task Force, today unveiled his Protect Children Through Safe Gun Ownership Act. As many as 4.6 million children live in homes with at least one loaded and unsecured firearm. Children finding easy access to firearms contribute to preventable tragedies, such as school shootings, youth suicides and unintentional shooting deaths among children. Firearms are the leading cause of death among children and teens according to Everytown for Gun Safety.<\/p>\n<p>The bill includes three main provisions to protect children from unsecured firearms: limitation on the transfer and use of handgun by minors, a new gun storage requirement and robust funding for the Department of Education to create a grant program centered around gun safety and safe storage education for parents and children.<\/p><\/blockquote>\n<p>The claim that \u201cFirearms are the leading cause of death among children and teens\u201d is a so-called statistic that needs to be buried and put to rest. Even on Everytown\u2019s page noting this misleading \u201cstatistic\u201d they say this includes \u201cchildren\u201d up to the age of 19. Without going too far into to weeds, it\u2019s difficult not to when we\u2019re being fed so many lies all the time, let\u2019s look at\u00a0<a href=\"https:\/\/nonprofitrisk.org\/resources\/articles\/perspectives-on-gangs-and-gang-violence\/#:~:text=Demographic%20studies%20of%20gangs%20cited,for%20longer%20periods%20of%20time.\" target=\"_blank\" rel=\"noopener\">another statistic<\/a>.<\/p>\n<p><!--more--><\/p>\n<blockquote><p>Demographic studies of gangs cited by Howell show that the typical age range for a gang is 12\u201324 with the average age of gang members 17\u201318 years old.<\/p><\/blockquote>\n<p>Conveniently the statistic includes \u201cchildren\u201d that fall into the average age demographic of gang members.<\/p>\n<p>What\u2019s Levin\u2019s<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/6639\/text?r=64&amp;s=1\" target=\"_blank\" rel=\"noopener\">\u00a0bill actually do<\/a>? It requires that firearms shall be stored via a \u201csecure gun storage or safety device\u201d if not on the person of the owner. It also opens up the doors for litigation. How litigation has anything but an effect in the aftermath of an event can be posed to serve as an actual deterrent it beyond me. Levin almost acts like because some people won\u2019t follow the law, they\u2019ll certainly be afraid of litigation?<\/p>\n<blockquote>\n<div class=\"deep-link\">\n<p class=\"lbexIndentParagraph H2E39EE126E584717A94E27D6C67FD158-content\">(4)\u00a0SECURE GUN STORAGE BY OWNERS.\u2014<\/p>\n<p class=\"lbexIndentSubpar H2E39EE126E584717A94E27D6C67FD158-content\">\u201c(A)\u00a0OFFENSE.\u2014<\/p>\n<p class=\"lbexIndentClause H2E39EE126E584717A94E27D6C67FD158-content\">\u201c(i)\u00a0IN GENERAL.\u2014It shall be unlawful for a person to keep, leave, or store any unsecured firearm that has moved in, or that has otherwise affected, interstate or foreign commerce, unless the person carries the firearm on his or her person or within such close proximity thereto that the person can readily retrieve and use the firearm as if the person carried the firearm on his or her person.<\/p>\n<\/div>\n<div class=\"deep-link\">\n<p class=\"lbexIndentClause HC4B501FEA0924F269DEEE9BF872315D0-content\">\u201c(ii)\u00a0UNSECURED FIREARM.\u2014In clause (i), the term \u2018unsecured firearm\u2019 means a firearm that is not secured by a secure gun storage or safety device.<\/p>\n<\/div>\n<div class=\"deep-link\">\n<p class=\"lbexIndentSubpar HD26399E6EF7248C9B9159EE0DF6A0083-content\">\u201c(B)\u00a0PRIVATE RIGHT OF ACTION.\u2014<\/p>\n<p class=\"lbexIndentClause HD26399E6EF7248C9B9159EE0DF6A0083-content\">\u201c(i)\u00a0IN GENERAL.\u2014An individual who is injured as a result of a violation of subparagraph (A) (or, in the case of an individual who has died as a result of such a violation, a member of the family of, or the estate of, the individual) may bring a civil action against the violator or any other person who, when the violation occurred, was in control of any premises on which the violation occurred if the violator or the person in control of the premises knew or should have known that there was an unsecured firearm on the premises, in a court of competent jurisdiction, for compensatory and punitive damages, injunctive and declaratory relief, and such other relief as the court deems appropriate.<\/p>\n<\/div>\n<\/blockquote>\n<p>Another section of the bill includes a provision that:<\/p>\n<blockquote><p>It shall be unlawful for any parent or guardian to provide written consent under paragraph (3) unless the parent or guardian has actual knowledge that the possession or use of the handgun by the juvenile will be in the presence and under the active supervision of the transferor or another adult who is not prohibited by Federal, State, or local law from possessing a firearm.<\/p><\/blockquote>\n<p>The actual impetus of that section of the bill is not really known nor can it be fully rationalized. Like most things in the world, permission to do \u201cthings\u201d in general, is granted in good faith. How an adult is to have \u201cactual knowledge\u201d falls into the stranger than fiction world of\u00a0<em>Minority Report<\/em>\u00a0ideologies.<\/p>\n<p>The other area that\u2019s worth exploring is the third portion of the rollout, the grant program. From the\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/6639\/text?r=64&amp;s=1\" target=\"_blank\" rel=\"noopener\">bill<\/a>:<\/p>\n<blockquote><p>(a) In General.\u2014From the amounts made available to carry out this Act, the Secretary of Education shall award grants, on a competitive basis, to eligible local educational agencies to provide parents with educational materials on gun safety and the importance and necessity of secure gun storage.<\/p>\n<p>(b) Application.\u2014To be eligible to receive a grant under this section, an eligible local educational agency shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.<\/p>\n<p>(c) Authorized Uses Of Funds.\u2014In addition to using a grant received under this section for the purposes described in subsection (a), an eligible local educational agency may use such grant to\u2014<\/p>\n<p>(1) provide educational materials on gun safety for parents, including best practices on how to keep guns secure from children;<\/p>\n<p>(2) conduct information sessions on gun safety that are publicly accessible; or<\/p>\n<p>(3) hire or assign an individual to monitor the activities carried out under the grant.<\/p><\/blockquote>\n<p>A grant program is something I could get behind, 100%. However, we all know that the devil is in the details. These grants are not going to be issued out to Bob\u2019s Firearms Academy, state run gun rights organizations, grassroots groups, USCCA instructors, NRA instructors, and so on and so forth. No, the people actually qualified and experienced in educating on the topic would be cut out of the equation. The grants would apply only to a \u201celigible local educational agency\u201d, which is\u00a0<a href=\"http:\/\/uscode.house.gov\/view.xhtml?req=(title:20%20section:7801%20edition:prelim)\" target=\"_blank\" rel=\"noopener\">defined as<\/a>:<\/p>\n<blockquote><p>The term \u201clocal educational agency\u201d means a public board of education or other public authority legally constituted within a State for either administrative control or direction of, or to perform a service function for, public elementary schools or secondary schools in a city, county, township, school district, or other political subdivision of a State, or of or for a combination of school districts or counties that is recognized in a State as an administrative agency for its public elementary schools or secondary schools.<\/p><\/blockquote>\n<p>Levin and the ilk of anti-freedom caucus members who were high fiving each other in the press release are misguided and purposefully misrepresenting reality. They do get points for using the term \u201ccommonsense\u201d eight times in the press release. Kudos! for you for getting that number on the gun grabbing BINGO card.<\/p>\n<p>Like every storage provision bill in existence, should this proposal become law, it will not contribute to the public safety in any way or manner. This would just give more charges to be pressed on those that are negligent and open the door wider for litigation. It also states we\u2019re essentially supposed to be clairvoyant.
