South Dakota: Three Pro-Gun Bills Signed by Governor Noem<\/a><\/p>\n

Last week, South Dakota Governor Kristi Noem signed a trio of pro-gun measures that strengthen our right to self-defense in the Mount Rushmore State.\u00a0\u00a0These measures will go into effect on July 1, 2022.<\/strong><\/p>\n

Senate Bill 195<\/a>\u00a0clarifies South Dakota\u2019s current Stand your Ground law by establishing that the burden of proof, by clear and convincing evidence, lies on the party seeking to overcome the immunity provided under this law.\u00a0 This measure clarifies the burden of proof and who bears the burden of proof in Stand your Ground self-defense cases.\u00a0\u00a0\u00a0<\/strong><\/p>\n

House Bill 1162<\/a>\u00a0updates the definition of \u201cloaded firearm\u201d under South Dakota law to designate that a firearm is considered loaded only if a round is chambered.\u00a0\u00a0This update provides easier methods of storing firearms in an \u201cunloaded\u201d manner,\u00a0while still maintaining utility\u00a0in self-defense situations when seconds matter.<\/p>\n

Senate Bill 212<\/a>, as amended on the Senate Floor,\u00a0reduces the cost of South Dakota carry permits to $0.\u00a0 SB 212 allows those who wish to use South Dakota\u2019s reciprocity agreements with other states,\u00a0to\u00a0do so and not be heavily burdened by what is essentially a\u00a0tax on their right to self-defense.<\/p>\n","protected":false},"excerpt":{"rendered":"
