\u201cFACT CHECKERS\u201d FAIL TO ADDRESS CRITICAL CHANGE IN DEFINITION OF RECEIVER, INADVERTENTLY PROVE \u201cFALSE CLAIM\u201d TRUE<\/a><\/p>\n

Washington, D.C. \u2013 So-called \u201cfact checkers\u201d and Big Tech inadvertently validated Gun Owners of America\u2019s concerns while targeting a tweet as disinformation for censorship.<\/p>\n<\/div>\n

\n

Immediately following passage of the \u201cUntraceable Firearms\u201d section of H.R. 7910, Gun Owners of America\u00a0tweeted<\/a>\u00a0that the bill would \u201ccriminalize disassembling, cleaning, and re-assembling your gun without a firearm manufacturer\u2019s license.\u201d<\/p>\n<\/div>\n

Despite labeling the tweet \u201cfalse,\u201d the\u00a0Associated Press\u2019\u00a0source\u00a0presumes\u00a0Gun Owners of America\u2019s interpretation might be valid, acknowledges that the bill\u2019s language is \u201cconfusing and ambiguous,\u201d and instead claims that no one is likely to \u201cever be charged under this statute.\u201d<\/p>\n<\/div>\n

The Supreme Court usually declares such laws \u201cvoid for vagueness\u201d under the 5th\u00a0Amendment, but that hardly makes policy analyses of unconstitutionally vague legislation untrue!<\/p>\n<\/div>\n

\n

In fact, GOA was merely\u00a0pointing out<\/a>\u00a0that the definition of a \u201cghost gun\u201d was so vague that it included many unserialized parts on guns in circulation today, like a slide on a handgun or an upper receiver on a rifle or shotgun.<\/p>\n<\/div>\n

\n

With \u201cassembling\u201d a \u201cghost gun\u201d criminalized by H.R. 7910, gun owners would no longer be able to disassemble their firearms, clean them, and \u201cassembl[e]\u201d them back into \u201ca functional firearm\u201d if even one unserialized part meets the new definition of a \u201cghost gun.\u201d The fact-checkers claim that this only applies to manufacturers, but the bill states \u201cit shall be unlawful for any person to manufacture\u2026a ghost gun.\u201d<\/p>\n<\/div>\n

\n

That is why\u00a0all\u00a0of the\u00a0Associated Press\u2019\u00a0sources lean heavily on the qualifier \u201cserialized.\u201d<\/p>\n<\/div>\n

\n

For example, the \u201cAP\u2019S ASSESSMENT\u201d emphasized that the ban didn\u2019t apply to \u201cfirearms [with] serial numbers\u201d and a Giffords gun control activist emphasized that the law wouldn\u2019t affect \u201ca firearm that is serialized.\u201d\u00a0 Again, they must have intentionally skipped over the other portion of the same\u00a0bill that changes the current definition<\/a>\u00a0of parts that would be subject to serialization or otherwise be classified as \u201cghost guns.\u201d\u00a0 Our research indicates that several parts of most modern firearms would meet this new definition (see examples mentioned above).<\/p>\n<\/div>\n

Therefore, if most guns today are made up of multiple unserialized \u201cghost gun\u201d parts, as the bill proposes, then you won\u2019t be able to clean your gun without violating the law unless you have a firearm manufacturer\u2019s license.<\/p>\n<\/div>\n

Big picture: these anti-gun Democrats didn\u2019t even do their own research, because when ATF tried the same definition change last year, GOA and our activists fought back, and ATF later acknowledged and backtracked\u00a0[Page 24727<\/a>]\u00a0this change.<\/p>\n<\/div>\n
