Not unless you break the law and your rights are removed as punishment. If something can be taken, it is a privilege, and privileges can be removed anytime if whoever grants them decides to stop granting them.<\/span><\/p>\n<div class=\"thm-piano-mop-premium\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">This isn\u2019t exactly high-level constitutional law stuff, either. This is a basic understanding the Founding Fathers had from the get-go. It\u2019s why they fought a war against the most powerful nation on Earth. Having their rights respected was worth the risk.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Yet, for former Idaho Attorney General Jim Jones, rights don\u2019t really work like that, apparently. That\u2019s\u00a0<\/span><a href=\"https:\/\/thehill.com\/opinion\/judiciary\/3537225-conservatives-act-at-cross-purposes-on-gun-safety\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">based on his writing over at The Hill<\/span><\/a><span class=\"text-node\">.<\/span><\/p>\n<blockquote data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Two groups of conservatives made contradictory decisions last week on whether there should be a balance between the safety of the American public and the rights of a small, but very vocal, minority. A group of 15 Senate Republicans broke with their party and\u00a0<\/span><a href=\"https:\/\/www.cnn.com\/2022\/06\/23\/politics\/republican-senators-break-filibuster-gun-safety-bill\/index.html\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">voted for a modest gun safety bill<\/span><\/a><span class=\"text-node\">. At the same time, the GOP-appointed majority on the U.S. Supreme Court made sure that there will be more guns in public places. The Senate\u2019s action will save lives; the court\u2019s action will likely add to the tally of gun deaths.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The six Republican-appointed members of the Supreme Court struck down a century-old New York law requiring a showing of \u201cproper cause\u201d to obtain a license to carry a concealed handgun. Although\u00a0<\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">the ruling<\/span><\/a><span class=\"text-node\">\u00a0was an immediate blow to public safety, the longer-term effect of the decision will pose an even greater safety threat.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The court departed from\u00a0<\/span><a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/06\/23\/bruen-supreme-court-gun-rights-dangerous\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">a consensus view<\/span><\/a><span class=\"text-node\">\u00a0developed by lower courts over the last decade that allowed gun rights to be limited by concerns over public safety. Instead, it focused the inquiry solely on whether a restriction is based on \u201chistory or tradition.\u201d\u00a0<\/span><a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/06\/23\/supreme-court-ready-to-gut-gun-laws\/\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">If a similar historical analogue<\/span><\/a><span class=\"text-node\"> for a gun limitation cannot be found, it may well be unconstitutional, without regard to the effect on public safety.<\/span><span class=\"text-node\">\u2026<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">More than anything else,<\/span><strong data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">\u00a0our governmental entities and public servants must understand that private rights ought to give way to the public good<\/span><\/strong><span class=\"text-node\">. We don\u2019t believe a person\u2019s First Amendment rights extend to falsely yelling \u201cfire\u201d in a crowded theater. Second Amendment rights must also yield when they infringe upon the paramount right of the people to be safe in public places.<\/span><\/p>\n<\/blockquote>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Uh\u2026no.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Not only no, but hell no.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Of course, Jones invokes the old canard of yelling fire in a crowded theater, as most who try to justify an infringement on our gun rights tend to do, but you\u2019d think a former attorney general would understand that this was a hypothetical presented by a justice during a case\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">and<\/span><\/em><span class=\"text-node\">\u00a0that decision was ultimately overturned in part by\u00a0<\/span><em data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/Brandenburg_v._Ohio\" target=\"_blank\" rel=\"noopener\" data-pf_style_display=\"inline\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Brandenberg v. Ohio<\/span><\/a><\/em><span class=\"text-node\">. That case found that speech could only be regulated if it were likely to cause imminent lawless action.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Plus, let\u2019s understand that if we take Jones\u2019s word that private rights ought to give way to the public good, then the question becomes, where do we draw the line? It\u2019s clear that Jones favors restricting our right to keep and bear arms as a means of trying to ensure public safety, but what else is on the table?<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Can we seize his home so we can house the homeless? Can we seize his car so it can be used for public transportation? Can we lock Jones in chains and make him do road work for no reason other than we simply need the road to be built?<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Where would such a line be?<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The problem here is that the line would be subjective. What\u2019s \u201cfar enough\u201d for Jones wouldn\u2019t be far enough for someone else. There are those who actually do support things not unlike the examples mentioned above, after all.<\/span><\/p>\n<p class=\"added-to-list1\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">The way you deal with this is to draw a line with objective criteria. These are your personal rights, and they shouldn\u2019t be infringed upon simply because someone thinks it\u2019s good for the public. The truth is, the smallest minority is the individual. Empower them, and everyone is equally empowered.<\/span><\/p>\n<p class=\"added-to-list1 pf-delete\" data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\"><span class=\"text-node\">Our gun rights aren\u2019t up for debate. First of all, we don\u2019t buy the idea that gun control yields any of the benefits Jones seems to believe. Yet even if we did, rights don\u2019t work that way<\/span><span class=\"text-node\">.<\/span><\/p>\n<p data-pf_style_display=\"block\" data-pf_style_visibility=\"visible\">\u00a0And thank God for that.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Former Idaho AG doesn&#8217;t know how rights work When something is your right, it means it cannot just be taken away.
