{"id":83646,"date":"2022-07-21T18:36:42","date_gmt":"2022-07-21T23:36:42","guid":{"rendered":"https:\/\/milesfortis.com\/?p=83646"},"modified":"2022-07-21T18:36:42","modified_gmt":"2022-07-21T23:36:42","slug":"83646","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=83646","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.ammoland.com\/2022\/07\/breaking-lapd-stops-enforcing-californias-high-capacity-magazine-ban\/#axzz7ZgQ3Ez8X\" target=\"_blank\" rel=\"noopener\">LAPD Stops Enforcing California\u2019s \u2018High-Capacity\u2019 Magazine Ban<\/a><\/p>\n<p>The Los Angeles Police Department has stopped enforcing California\u2019s state law banning \u201chigh-capacity\u201d magazines, according to an internal LAPD email obtained by the Second Amendment Foundation\u2019s Investigative Journalism Project.<\/p>\n<p>The email was sent Wednesday morning to all LAPD personnel by\u00a0<a href=\"https:\/\/www.lapdonline.org\/command-staff\/eskridge-ernest\/\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"48e591e5abcdfeb4b0b41d62588a6d6e\">Commander Ernest Eskridge<\/a>, assistant commanding officer of the department\u2019s Detective Bureau.<\/p>\n<p>Eskridge noted that on June 23, the \u201cUnited States Supreme Court vacated the ruling in\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=4540467538923292545&amp;q=Duncan+v.+Bonta&amp;hl=en&amp;as_sdt=40006&amp;as_vis=1\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"908bae32c64f95f98598e09096c4a87e\"><em>Duncan v. Bonta<\/em><\/a>\u00a0and remanded the case back to the 9<sup>th<\/sup>\u00a0Circuit Court of Appeal for further consideration in light of its recent decision in\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-uri=\"aa69a089a656e83718e5188a6811b7dc\"><em>New York State Rifle and Pistol Association v. Bruen<\/em><\/a>.\u201d<\/p>\n<p>Because of this ruling, Eskridge said in the email, all sworn LAPD personnel shall not \u201cinvestigate, detain or arrest\u201d anyone for possessing a magazine capable of holding more than ten rounds unless they are already legally barred from possession of ammunition in the state.<\/p>\n<p>There were three issues in\u00a0<em>Duncan v. Bonta:\u00a0<\/em>whether a law prohibiting law-abiding citizens from possessing magazines in common use violates the Second Amendment, whether confiscating legally obtained magazines violated the \u201ctakings clause,\u201d and whether the \u201ctwo-step\u201d approach of the 9<sup>th<\/sup>\u00a0Circuit and other courts applied to Second Amendment cases is constitutional and meets Supreme Court precedents.<\/p>\n<p>In\u00a0<em>Bruen<\/em>, the Supreme Court held that the Second and Fourteenth Amendments protect an individual\u2019s right to carry a handgun for self-defense outside the home and that New York\u2019s \u201cspecial need\u201d requirement for a concealed-carry permit violates those protections.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.ammoland.com\/wp-content\/uploads\/2022\/07\/LAPD-memo-2-600x356.jpg\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>LAPD Stops Enforcing California\u2019s \u2018High-Capacity\u2019 Magazine Ban The Los Angeles Police Department has stopped enforcing California\u2019s state law banning \u201chigh-capacity\u201d magazines, according to an internal LAPD email obtained by the Second Amendment Foundation\u2019s Investigative Journalism Project.
