Rifles, which typically fall into the loosely defined &#8220;assault weapons&#8221; category, were specified as the weapon in less than 3% of homicides in 2020. Handguns were specified as the weapon in 45% of homicides.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Biden floated a renewal of the &#8220;assault weapons&#8221; ban during a speech Tuesday that the White House billed as his answer to the problem of rising crime rates nationwide. However, when he brought up the need for such a ban, he did so both in the context of street crime and mass shootings.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cWe have to act for all those kids gunned down on our streets every single day that never make the news. There\u2019s a mass shooting every single day in this country in the streets of America \u2014 every single day,\u201d Biden said during the speech in Wilkes-Barre, Pennsylvania.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">The FBI&#8217;s\u00a0<a tabindex=\"0\" href=\"https:\/\/www.ojp.gov\/ncjrs\/virtual-library\/abstracts\/analysis-recent-mass-shootings\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">definition<\/a>\u00a0of mass shooting involves \u201cany incident in which at least four people are murdered with a gun,\u201d and although the term typically evokes the image of a headline-grabbing school massacre, mass shootings can include street violence if the victim count reaches that threshold.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Biden appeared to be citing data from the\u00a0<a tabindex=\"0\" href=\"https:\/\/www.gunviolencearchive.org\/\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">Gun Violence Archive<\/a>, a shooting tracker used by many news outlets and advocacy groups that defines mass shootings as any incident in which multiple people are shot, even if there is no loss of life. That figure supports Biden\u2019s claim; however, when mass shootings are defined by the criteria historically used by law enforcement, the number of mass shootings this year drops far below an average of one per day.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cYou know, we\u2019re living in a country awash with weapons of war, weapons that weren\u2019t designed to hunt, were designed to take on an enemy,\u201d Biden said during the speech. \u201cThat\u2019s what they\u2019re designed to do. For God\u2019s sake, what\u2019s the rationale for these weapons outside of a war zone?\u201d<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Biden\u2019s efforts to tie street violence to &#8220;assault weapons&#8221; ignore the reality of how criminals operate, said Amy Swearer, a legal fellow in the Meese Center for Legal and Judicial Studies at the Heritage Foundation.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cMost of the time when criminals are committing crimes in public, they want a type of firearm that is concealable, which is why they want handguns,\u201d Swearer told the\u00a0<i>Washington Examiner<\/i>.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">She pointed to a 2004 study sponsored by the Justice Department that found no meaningful evidence the &#8220;assault weapons&#8221; ban had lowered gun violence.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cThey should have taken it a step further and said, you\u2019re also dealing with a ban, a prospective ban, with aspects of a firearm that aren&#8217;t inherently related to solving the problem of crime,\u201d Swearer said.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">That\u2019s because pistol grips, barrel shrouds, and the other components of a rifle that typically classify it as an &#8220;assault weapon&#8221; don\u2019t make the firearm inherently more useful to a committed mass shooter, she said.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">The\u00a0<a tabindex=\"0\" href=\"https:\/\/www.ojp.gov\/pdffiles1\/nij\/grants\/204431.pdf\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">2004 study<\/a>\u00a0noted that military-style weapons \u201cwere used in only a small fraction of gun crimes prior to the ban: about 2% according to most studies and no more than 8%.\u201d<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cAlthough the ban has been successful in reducing crimes with\u201d such weapons in the decade it stood, the study noted that \u201cany benefits from this reduction are likely to have been outweighed by steady or rising use of nonbanned semiautomatics with\u201d large-capacity magazines, \u201cwhich are used in crime much more frequently than\u201d military-style weapons.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cTherefore, we cannot clearly credit the ban with any of the nation\u2019s recent drop in gun violence,\u201d according to the study.<\/p>\n<p data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\"><!--more--><\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Even in the context of mass shootings, rather than everyday street violence, military-style weapons do not play the dominant role claimed by Democrats.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Everytown for Gun Safety, a gun control advocacy group,\u00a0<a tabindex=\"0\" href=\"https:\/\/www.everytown.org\/solutions\/assault-weapons\/%C2%A0\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">notes<\/a>\u00a0that &#8220;assault weapons&#8221; account for 25% of mass shooting deaths.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cThe most common weapon used to commit mass shootings is a handgun,\u201d according to the\u00a0<a tabindex=\"0\" href=\"https:\/\/www.theviolenceproject.org\/mass-shooter-database\/\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">Violence Project<\/a>, a nonpartisan research group. \u201cEighty percent of all mass shooters used at least one handgun during their crime.\u201d<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Nevertheless, groups such as Everytown point to the deadlier nature of &#8220;assault weapons&#8221; and their ammunition to argue those types of firearms do not belong in the hands of civilians.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Enforcing a ban as sweeping as one on &#8220;assault weapons&#8221; could also prove challenging to cities and states that already can\u2019t keep up with the pace of illegal gun trafficking.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Democrats in many cities are declining to prosecute some gun-related offenses that violate laws already on the books \u2014 either because their police departments don\u2019t have the manpower to collect evidence for cases or because liberal district attorneys are resisting bringing gun charges.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">In Philadelphia, for example, shootings this year have climbed to the highest levels ever recorded in the city.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">But its district attorney, Larry Krasner, has argued against targeting illegal gun possession.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">\u201cYou can make massive numbers of gun arrests, and you do not see significant reductions in shooting,\u201d Krasner said in an interview with the\u00a0<i><a tabindex=\"0\" href=\"https:\/\/www.nytimes.com\/2022\/08\/11\/us\/philadelphia-gun-violence-shootings.html\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">New York Times<\/a><\/i>\u00a0this month.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">The progressive position has pitted Krasner against the Philadelphia Police Department and Democratic Mayor Jim Kenney.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">For more than two years, Kenney has\u00a0<a tabindex=\"0\" href=\"https:\/\/www.phillyvoice.com\/philadelphia-coronavirus-guns-shootings-krasner-kenney-prosecution-jails-police-outlaw\/\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">pushed<\/a>\u00a0Krasner to prosecute more gun offenses.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">Gun-related prosecutions have dropped in Philadelphia, even as shootings have exploded.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">A\u00a0<i><a tabindex=\"0\" href=\"https:\/\/www.inquirer.com\/news\/philadelphia-gun-arrests-2021-convictions-vufa-20210330.html\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">Philadelphia Inquirer<\/a><\/i>\u00a0review of data last year found that on Krasner\u2019s watch, suspects arrested on a charge of illegal gun possession had a slightly better-than-not chance of escaping conviction.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">That marked a sharp decline in gun possession prosecutions from 2017, when suspects arrested on charges related to gun offenses had a 63% chance of getting convicted.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">In 2021, the city made\u00a0<a tabindex=\"0\" href=\"https:\/\/www.nytimes.com\/2022\/08\/11\/us\/philadelphia-gun-violence-shootings.html\" target=\"_blank\" rel=\"noopener\" data-t=\"{&quot;n&quot;:&quot;destination&quot;,&quot;t&quot;:13,&quot;b&quot;:1,&quot;c.t&quot;:7}\">no arrests<\/a>\u00a0in roughly 75% of deadly shootings.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">That pattern is not confined to Philadelphia, and additional restrictions on firearms could further burden struggling law enforcement agencies.<\/p>\n<p class=\"\" data-t=\"{&quot;n&quot;:&quot;blueLinks&quot;}\">The popularity of &#8220;assault weapons,&#8221;
