{"id":86730,"date":"2022-10-15T11:52:53","date_gmt":"2022-10-15T16:52:53","guid":{"rendered":"https:\/\/milesfortis.com\/?p=86730"},"modified":"2022-10-15T11:52:53","modified_gmt":"2022-10-15T16:52:53","slug":"86730","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=86730","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.aol.com\/news\/exactly-laws-minors-possessing-guns-203009371.html\" target=\"_blank\" rel=\"noopener\">What exactly are the laws for minors possessing guns in North Carolina?<\/a><\/p>\n<p>When it comes to minors purchasing firearms in North Carolina, the rules are clear: No one under the age of 21 may buy handguns, and no one younger than 18 can buy long guns, such as shotguns or rifles.<\/p>\n<p>The state actually adheres to federal standards when it comes to such\u00a0<a class=\"link \" href=\"https:\/\/ncsheriffs.org\/wp-content\/uploads\/Master-Firearms-Publication-September-2016.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:age restrictions\" data-rapid_p=\"6\" data-v9y=\"1\">age restrictions<\/a>.<\/p>\n<p>But the\u00a0<a class=\"link \" href=\"https:\/\/ncsheriffs.org\/wp-content\/uploads\/Master-Firearms-Publication-September-2016.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:rules are different in North Carolina\" data-rapid_p=\"7\" data-v9y=\"1\">rules are different in North Carolina<\/a>\u00a0when it comes to the\u00a0<i>possession\u00a0<\/i>of firearms. And it can get a little confusing.<\/p>\n<ul class=\"caas-list caas-list-bullet\">\n<li>North Carolina law makes it a misdemeanor for someone\u00a0<a class=\"link \" href=\"https:\/\/www.ncleg.gov\/EnactedLegislation\/Statutes\/HTML\/BySection\/Chapter_14\/GS_14-269.7.html\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:under the age of 18\" data-rapid_p=\"8\" data-v9y=\"1\">under the age of 18<\/a>\u00a0to\u00a0<b>possess a\u00a0<i>handgun<\/i><\/b>.<\/li>\n<li>But there is no similar NC statute specifically addressing the possession of\u00a0<b>\u201clong guns\u201d<\/b>\u00a0\u2014 rifles, shotguns and carbines (except for a statute that allows children younger than 12 to handle firearms with permission from or under supervision of adults.).<\/li>\n<\/ul>\n<p>So what exactly are the rules for minors possessing or using guns? There are a few.<\/p>\n<p><span class=\"ng_z_sym_square_bullet\">\u25aa\u00a0<\/span><b>Under the age of 12.<\/b>\u00a0A child under the age of 12\u00a0<a class=\"link \" href=\"https:\/\/www4.ncleg.net\/enactedlegislation\/statutes\/html\/bysection\/chapter_14\/gs_14-316.html#:~:text=(a)%20It%20shall%20be%20unlawful,of%20the%20child's%20parent%20or\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:must have permission from their parent or guardian\" data-rapid_p=\"9\" data-v9y=\"1\">must have permission from their parent or guardian<\/a>\u00a0to possess or use a firearm, whether loaded or unloaded, or be under the supervision of an adult, says NC statute 14-316. Violation is a misdemeanor.<\/p>\n<p><span class=\"ng_z_sym_square_bullet\">\u25aa\u00a0<\/span><b>Keeping guns away from minors.<\/b>\u00a0According to\u00a0<a class=\"link \" href=\"https:\/\/www.ncleg.net\/enactedlegislation\/statutes\/html\/bysection\/chapter_14\/gs_14-315.1.html\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:North Carolina statute 14-315.1.\" data-rapid_p=\"10\" data-v9y=\"1\">North Carolina statute 14-315.1.<\/a>, people who possess firearms and live with minors have a responsibility to store firearms in a way that unsupervised minors cannot access them.<\/p>\n<p>The penalty for not doing this is a Class 1 misdemeanor \u2014 but only under certain circumstances:\u00a0<i>if\u00a0<\/i>that firearm is obtained without permission\u00a0<i>and\u00a0<\/i>the minor exhibits the weapon in a public place or in a threatening manner, carries it onto an \u201ceducational property,\u201d causes injury or death (not in self-defense) or uses it in the commission of a crime.<\/p>\n<p>The statute is long, but specifies that the adult may be responsible if the firearm is stored \u201cin a condition that the firearm can be discharged and in a manner that the person knew or should have known that an unsupervised minor would be able to gain access to the firearm.\u201d<\/p>\n<p><span class=\"ng_z_sym_square_bullet\">\u25aa\u00a0<\/span><b>No guns on school grounds.<\/b>\u00a0It is a Class 1 felony for\u00a0<b>anyone of any age<\/b>\u00a0to possess or carry (openly or concealed) any kind of\u00a0<a class=\"link \" href=\"https:\/\/www.ncleg.gov\/EnactedLegislation\/Statutes\/HTML\/BySection\/Chapter_14\/GS_14-269.2.html\" target=\"_blank\" rel=\"nofollow noopener\" data-ylk=\"slk:firearm on \u201ceducational property\u201d\" data-rapid_p=\"11\" data-v9y=\"1\">firearm on \u201ceducational property\u201d<\/a>\u00a0or to an extracurricular activity sponsored by a school. If that weapon is discharged, it\u2019s a Class F felony. (Note: does not apply to BB guns, stun guns, air rifles or air pistols.).<\/p>\n<p>It is also a Class 1 felony to\u00a0<b>encourage or aid a minor (less than 18 years old)<\/b>\u00a0to carry a firearm onto an educational property.<\/p>\n<p><b><span class=\"ng_z_sym_square_bullet\">\u25aa\u00a0<\/span>No permit needed for \u201clong guns.\u201d<\/b>\u00a0You do not need any kind of permit to own a \u201clong gun,\u201d which includes a rifle or shotgun, but you do need a North Carolina ID and the buyer must pass a background check. (You do need need a permit to purchase a handgun.)<\/p>\n<h3>Why is it a crime to improperly store a firearm, but not illegal for a minor to own a rifle?<\/h3>\n<p>In North Carolina, it is not illegal for a minor to possess a long gun, such as a shotgun or rifle. And yet, it can be a crime for a minor to access a firearm if a parent or guardian has not properly secured it.<\/p>\n<p>It all depends on what the minor does with the gun they access.<\/p>\n<p>From the state statute (G.S. 14-315.1), here are all the elements that must be present for improper storage of a firearm to be a crime:<\/p>\n","protected":false},"excerpt":{"rendered":"<p>What exactly are the laws for minors possessing guns in North Carolina?
