{"id":86810,"date":"2022-10-19T14:28:49","date_gmt":"2022-10-19T19:28:49","guid":{"rendered":"https:\/\/milesfortis.com\/?p=86810"},"modified":"2022-10-19T14:28:49","modified_gmt":"2022-10-19T19:28:49","slug":"86810","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=86810","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.thetruthaboutguns.com\/california-judge-blocks-release-of-gun-owners-personal-information\/\" target=\"_blank\" rel=\"noopener\">California Judge Blocks Release of Gun Owners\u2019 Personal Information<\/a><\/p>\n<p>Last fall, California\u2019s oleaginous governor signed a bill into law that allows the\u00a0<a href=\"https:\/\/reason.com\/2021\/09\/27\/california-will-let-violence-prevention-researchers-know-that-you-have-a-gun\/\" target=\"_blank\" rel=\"noopener\">distribution of personal information<\/a>\u00a0of the state\u2019s gun\u00a0buyers with academic researchers. Researchers like gun\u00a0control advocate\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/wintemute-co-skew-data-on-handgun-ownership-and-suicide-rates-in-newly-published-study\/\" target=\"_blank\" rel=\"noopener\">Garen Wintemute<\/a>\u00a0who runs the UC Davis California Firearm Violence Research Center, a producer of anti-gun\u00a0\u201cresearch\u201d used to back efforts to limit Second Amendment rights.<\/p>\n<p>Sharing California gun\u00a0owners\u2019 personal data is a situation that\u2019s ripe for abuse. And given the state\u2019s record of\u00a0<a href=\"https:\/\/www.thetruthaboutguns.com\/intimidation-california-ag-posted-the-names-of-all-carry-permit-holders-after-bruen-ruling\/\" target=\"_blank\" rel=\"noopener\">doxxing gun owners<\/a>, it puts law-abiding citizens at risk. That\u2019s why a group of gun\u00a0rights orgs sued to block the data dumps. And the state\u2019s abysmal record played into San Diego Superior Court Judge Katherine Bacal\u2019s decision. As she wrote . . .<\/p>\n<p><em>Defendant responds plaintiffs cannot establish irreparable harm because the personal identifying information has already been shared with researchers as recently as November of 2021. Opp. at 17. Yet this does not account for the potential ongoing and future harms that could occur by continuous use of the information. Additionally, although the most recent sharing of plaintiffs\u2019 personal identifying information occurred in November of 2021, this does not necessarily mean that future requests for data would not occur in the interim. Furthermore, and while this motion has been pending,\u00a0<strong>a massive data breach reportedly occurred that leaked personal identifying information from the firearm databases for concealed carry applicants in or about June of 2022<\/strong>. See ROA # 85 at 5. Accordingly, plaintiffs have shown that the balance of harms weighs in favor of issuing the injunction. (emphasis added)<\/em><\/p>\n<p>Judge Bacal has\u00a0<a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6386\/attachments\/original\/1665786220\/37-2022-00003676-CU-CR-CTL_ROA-114_10-13-22_Tentative_Rulings_1665703986902.pdf\" target=\"_blank\" rel=\"noopener\">issued an injunction<\/a>\u00a0blocking the distribution of the information. Here\u2019s the Firearms Policy Coalition\u2019s press release . . .<\/p>\n<p><em>Today, Firearms Policy Coalition (FPC) announced that San Diego Superior Court Judge Katherine Bacal has issued a preliminary injunction in its lawsuit challenging California\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB173\" target=\"_blank\" rel=\"noopener\">Assembly Bill 173<\/a>, which requires the state\u2019s Department of Justice to share the personal identifying information of millions of gun\u00a0and ammunition owners with other parties for non-law-enforcement purposes. The ruling in\u00a0<a href=\"https:\/\/www.firearmspolicy.org\/brandeis\" target=\"_blank\" rel=\"noopener\">Barba v. Bonta<\/a>, which was affirmed by the judge in full, can be viewed at\u00a0<a href=\"http:\/\/fpclegal.org\/\" target=\"_blank\" rel=\"noopener\">FPCLegal.org<\/a>.<\/em><\/p>\n<p><em>\u201cDefendant responds plaintiffs cannot establish irreparable harm because the personal identifying information has already been shared with researchers as recently as November of 2021.
