Nia Gill (D- Essex) pushed back on some of Durr\u2019s claims about the bill violating the Constitution and the Supreme Court\u2019s June ruling&#8230;&#8230;<br \/>\n&#8220;<em>This is an exercise in legislation that we must do in order for the court to determine the legislative constitutionality of it,<\/em>\u201d Gill said.<\/p>\n<p><a href=\"https:\/\/newjerseymonitor.com\/2022\/10\/27\/fast-tracked-bill-to-limit-concealed-carry-stumbles-as-constitutional-concerns-mount\/\" target=\"_blank\" rel=\"noopener\">Fast-tracked bill to limit concealed carry stumbles as constitutional concerns mount<\/a><\/p>\n<p><span data-preserver-spaces=\"true\">A fast-tracked\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2022\/A4769\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">bill<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0to limit concealed carry in New Jersey hit a snag Thursday when Assembly leaders yanked it from a scheduled vote, conceding its broad restrictions could fold under constitutional scrutiny.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The canceled vote came the same day a Senate panel approved the bill along party lines \u2014 and with about 15 amendments that appear to be aimed at appeasing critics who have vowed to fight any new law in court. The bill, introduced two weeks ago, has already been\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2022\/10\/17\/bill-aimed-at-restricting-concealed-carry-gun-permits-advances-despite-debate\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">approved<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0along party lines by three Assembly committees.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Assemblyman Louis Greenwald (D-Camden), one of the bill\u2019s sponsors and the majority leader in the Assembly, said legislators plan to revise language in the bill to ensure \u201cit\u2019s directly in line with our legislative intent.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThat may help constitutional arguments at the end of the day,\u201d Greenwald said. \u201cThere\u2019s a focus on making sure that it\u2019s not too broad, not too vague, and that it withstands a challenge.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Greenwald said lawmakers still aim to pass the bill by the end of November.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cObviously, the day that the governor signs it, there\u2019s going to be legal challenges \u2014 those against it have already made that clear,\u201d said Assemblyman John McKeon (D-Essex), another bill sponsor. \u201cSo we\u2019re just doing everything we need to do to cross our t\u2019s and dot our i\u2019s. There\u2019s no lack of resolve. If anything, we\u2019re even more determined to get something to the governor\u2019s desk.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Legislators say they drafted the bill to counter the uptick in gun usage they\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2022\/06\/23\/new-jersey-officials-fear-more-gun-violence-after-supreme-court-ruling\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">anticipate<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0after about 300,000 gun owners applied for concealed carry permits in the wake of a U.S. Supreme Court\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2022\/06\/23\/u-s-supreme-court-expands-gun-rights-in-striking-down-new-york-concealed-carry-law\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">ruling<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0in June that affirmed a constitutional right to carry. In that ruling, the nation\u2019s highest court struck down a New York law requiring gun owners to prove a reason why they need to carry a concealed gun, prompting New Jersey to remove its similar \u201cjustifiable need\u201d requirement.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">New Jersey\u2019s bill would create new hurdles for gun owners seeking carry permits and carve out 25 categories of sensitive places where guns are prohibited, which range from beaches to bars to parks.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">But gun rights advocates have singled out various provisions of the bill they find problematic \u2014 and grounds for a court challenge. A federal judge in New York last week temporarily<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newjerseymonitor.com\/2022\/10\/24\/new-york-court-rulings-signal-trouble-for-new-jerseys-fresh-attempt-to-regulate-guns\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">\u00a0halted<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0a similar ban there on guns in sensitive places, citing constitutional concerns.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Some of the amendments made to New Jersey\u2019s bill since its introduction have addressed critics\u2019 concerns. After gun supporters complained about one provision that would allow the state\u2019s 565 municipalities to define their own sensitive places where guns would be banned, lawmakers amended the bill to remove it.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Scott Bach, president of the Association of New Jersey Rifle &amp; Pistol Clubs, on Wednesday sounded the alarm about other language in the bill referring to \u201cweapons.\u201d Such vague wording could refer to any everyday tool, including mops, kitchen cutlery, and knitting needles, the association warned in an alert to members.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Greenwald on Thursday conceded the weapons verbiage was one tweak legislators would make before rescheduling the bill for a full Assembly vote.<\/span><\/p>\n<div class=\" newsroomBlockQuoteContainer \">\n<blockquote>\n<div class=\"newsroomBlockQuoteSVGContainer\">We\u2019re just doing everything we need to do to cross our t\u2019s and dot our i\u2019s. If anything, we\u2019re even more determined to get something to the governor\u2019s desk.<b><br \/>\n\u2013 Assemblyman John McKeon<\/b><\/div>\n<\/blockquote>\n<\/div>\n<p><span data-preserver-spaces=\"true\">Earlier in the day, during the Senate\u2019s Law and Public Safety Committee, Sen. Linda Greenstein (D-Middlesex), the committee\u2019s chair, agreed some unclear language in the bill needs further consideration.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The committee made 15 amendments to the bill. Two amendments would remove requirements that someone with a carry permit stopped by police produce the gun for inspection and show proof of liability insurance. Two more would allow active and retired law enforcement officers to carry a handgun in sensitive places where the public can\u2019t take them.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Still, supporters and critics spent nearly three hours debating the bill Thursday, with some especially testy exchanges between the panel\u2019s Democratic members and Sen. (Photo by Dana DiFilippo | New Jersey Monitor)<\/em>\u00a0<\/figcaption><\/figure>\n<p>\u201cIf I were to sit here and list all the problems with this bill, we\u2019d be here until sometime next week,\u201d Durr told the panel.<\/p>\n<p>Durr especially objected to the increased fees proposed in the legislation, complaining they would \u201cmake it impossible for a person of modest means to protect him- or herself.\u201d<\/p>\n<p>He questioned the state\u2019s ongoing effort to reduce its prison population while tightening gun control at the same time.<\/p>\n<p>\u201cYou were making room (in prison) for all the responsible but unlucky gun owners who are going to unintentionally violate this bill,\u201d he said.<\/p>\n<p>Sen.
