{"id":88818,"date":"2022-12-23T14:14:13","date_gmt":"2022-12-23T20:14:13","guid":{"rendered":"https:\/\/milesfortis.com\/?p=88818"},"modified":"2022-12-23T14:14:13","modified_gmt":"2022-12-23T20:14:13","slug":"88818","status":"publish","type":"post","link":"https:\/\/milesfortis.com\/?p=88818","title":{"rendered":""},"content":{"rendered":"<p><a href=\"https:\/\/www.saf.org\/saf-sues-new-jersey-over-new-concealed-carry-law\/\" target=\"_blank\" rel=\"noopener\">SAF SUES NEW JERSEY OVER NEW CONCEALED CARRY LAW<\/a><\/p>\n<p>BELLEVUE, WA \u2013 The Second Amendment Foundation today filed a\u00a0<a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2022\/12\/01-Complaint.pdf\">federal lawsuit<\/a>\u00a0against the State of New Jersey, challenging the state\u2019s new gun control law prohibiting licensed concealed carry in an expanded list of so-called \u201csensitive places,\u201d and further criminalizes carrying an operable handgun \u201cwhile in a vehicle.\u201d<\/p>\n<p>Joining SAF are the Firearms Policy Coalition, the Coalition of New Jersey Firearm Owners and the New Jersey Second Amendment Society, along with three private citizens, Nicholas Gaudio, Jeffrey M. Muller and Ronald Koons. Plaintiffs are represented by attorney David D. Jensen, David Jensen PLLC, of Beacon, N.Y.<\/p>\n<p>The lawsuit was filed in U.S. District Court for the District of New Jersey. The case is known as\u00a0<em>Koons et al v. Reynolds et al.<\/em><\/p>\n<p>Named as defendants are Atlantic County Prosecutor William Reynolds, Camden County Prosecutor Grace C. Macaulay, Sussex County Prosecutor Annemarie Taggart, New Jersey Attorney General Matthew J. Platkin and State Police Supt. Patrick Callahan, in their official capacities.<\/p>\n<p>Shortly after New Jersey Gov. Phil Murphy signed the new legislation on Dec. 22, SAF and its partners quickly filed the lawsuit.<\/p>\n<p>\u201cWe are asking for a declaratory judgment against certain tenets of the new legislation,\u201d explained SAF founder and Executive Vice President Alan M. Gottlieb. \u201cWe are also seeking a preliminary and\/or permanent injunction restraining the defendants and their officers, agents and other employees from enforcing the challenged segments of the law.<\/p>\n<p>\u201cThe specific sections of law violate the right to bear arms protected by the Second Amendment,\u201d he continued. \u201cThere is no established historical tradition that could be used to justify these restrictions. This new legislation literally criminalizes licensed concealed carry just about everywhere, making a mockery of the right to bear arms protected by the Second Amendment.\u201d<\/p>\n<p>\u201cNew Jersey\u2019s Legislature and Governor have shown that they do not wish to heed the Supreme Court\u2019s guidance as to the bounds of the right to bear arms in\u00a0<em>Bruen<\/em>,\u201d said SAF\u2019s Executive Director Adam Kraut. \u00a0\u201cDespite clear directives as to a citizens\u2019 right to bear arms, New Jersey continues to thumb its nose at the constitutional rights of its citizens in the name of \u2018safety\u2019. Such disregard for the rights of New Jerseyans will not be tolerated. As such, we are seeking to vindicate the rights of our members and the public in an expeditious manner.
